AN ORDINANCE TO ACCEPT THE LOWEST/
BEST BID FOR THE 2001 STREET MAINTENANCE PROGRAM
AND DECLARING AN EMERGENCY
WHEREAS, after advertising, receiving and opening bids on May 16, 2001 bids
were received for the 2001 Street Maintenance Program; and
WHEREAS, Council has determined that the lowest and best bid for said project is
from, Shelly and Sands, Inc. in the amount of $1,530,185.93; and
WHEREAS, Council has determined that there may be a legitimate need to declare
the relocation of the utilities in connection with the above-referenced project as a
"single source" procurement, for reason that the company owning the utilities in
question has the exclusive rights to relocate such utilities; and
WHEREAS, it is in the best interest of the City to execute this contract as soon as
possible so that construction can start early in the spring of 2001; and
NOW THEREFORE BE IT ORDAINED by the Council of the City of Dublin,
Ohio, _~ of the elected members concurring:
Section 1. That the bid from Shelly and Sands, Inc. in the amount of
$1,530,185.93 be, and hereby is, accepted.
Section 2. That the City Manager is hereby authorized and directed to execute a
contract with Shelly and Sands, Inc. for completion of said project pursuant to the
bid specifications and documents on file in the office of the City Engineer.
Section 3. That this Ordinance be, and the same hereby is, declared to be an
emergency measure for the preservation of the public peace, health or welfare of the
residents of this City, and, therefore, this Ordinance shall take effect and be in force
immediately upon its passage.

2001 Street Maintenance Bid Acceptance
Date: May 16, 2001
On May 16, 2001 three (3) bids were received and publicly opened and read for the 2001 Street
Maintenance Program, as was previously submitted to City Council on March 19, 2001.
All bids have been reviewed and it is recommended that we award this contract to Shelly and
Sands, Inc., of Columbus, Ohio, the lowest and best bidder. Shelly and Sands, Inc.'s bid was
~. $1,530,185.93. The Engineer's estimate was $1,622,500.
+,... I recommend approval of this contract to Shelly and Sands, Inc. Attached is an emergency
Ordinance for approval by City Council prior to awarding the contract to Shelly and Sands, Inc.
Sufficient funds have been included in the current budget for this work.
