AN ORDINANCE TO ACCEPT
AN ANNEXATION OF 29.56+/- ACRES IN JEROME TOWNSHIP,
UNION COUNTY TO THE CITY OF DUBLIN
WHEREAS, on March 12, 2001, the Union County Commissioners approved the
annexation petition filed by Harrison W. Smith, Jr., 37 W. Broad Street, Suite
725, Columbus, OH 43215, Agent for Petitioners Richard S. and Elaine E.
Valentin, 6707 Paul Road, Westerville, OH 43082; and
WHEREAS, Council is of the opinion that this territory should be annexed to the
City of Dublin.
NOW, THEREFORE, _B~T ORDAINED, by the Council of the City of
Dublin, State of Ohio, of the elected member concurring that:
Section 1. That the petition for the annexation of 29.56+/- acres (see attached
legal description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest date allowed by law.

AGENT FOR PETITIONERS
A public hearing was held at 1:30 p:m. in the office of the Union County Commissioners
for the purpose of considering a Petition for Annexation of 29.56 acres, more or less, in Jerome
Township, City of Dublin, Union County, Ohio.
In attendance at the hearing were the 3 County Commissioners, Mr. Jack Reynolds, Mr.
Ben Hale, Mr. Michael Stevens, Richard and Elaine Valentin, Bill Adams, and Court Reporter,
Tammy Hammond.
Commissioner Don Fraser indicated that the statutory requirements regarding the filing of
the petition had been met. Copies of the Proof of Publication, notices of filing of the annexation
petition, and statement of services were presented to the Board.
Mr. Reynolds had several exhibits to the Board with a map of the City of Dublin
indicating the natural progression process with this annexation. He also had a copy of the City of
Dublin's plan. Mr. Reynolds stated that the County Engineer reviewed the map for accuracy.
Mr. Stevens stated to the Board the police and utility services, and the mutual aid
agreement available.
~,.,, Commissioner Mitchell stated to Mr. Stevens that the mutual aid agreement and the
police services is a weak reason to pass an annexation. Mr. Mitchell also stated that the map
needs to be updated, it is years old and doesn't show Metro Parks.
r Mr. Valentine stated to the board that he would like to be annexed to Dublin because to
likes the services that Dublin can give.
Commissioner Fraser-made a motion to approve the annexation petition. Resolution
follows.

A motion was made by Tom McCarthy and seconded by Don Fraser to adopt the
following:
WHEREAS, a petition for annexation was filed on December 12, 2000, praying for
annexation to the City of Dublin, Jerome Township, Union County, Ohio; and
WHEREAS, said petition represents real estate situated in Jerome Township, Union
County, Ohio, being a total of 29.56 acres, more or less, which is contiguous and adjacent to the
City of Dublin. There are 2 owners of real estate in the territory so prayed to be annexed.
THEREFORE, BE IT RESOLVED, that said petition for annexation be and is hereby
received pursuant to Section 709.02 of the Ohio Revised Code, and shall be advertised by
publication as required by law, and that public hearing on said petition shall be held in the office
of the Board of Union County Commissioners at 1:30 p.m. on Monday, March 12, 2001.

A RESOLUTION TO SET FORTH A STATEMENT OF SERVICES
TO BE PROVIDED TO THE AREA IN A PROPOSED ANNEXATION OF
29.56+/- ACRES FROM JEROME TOWNSHIP, UNION COUNTY TO
THE CITY OF DUBLIN, OHIO AS REQUIRED BY SECTION 709.031 OF
THE OHIO REVISED CODE
WHEREAS, a petition for the annexation of 29.56+/- acres from Jerome Township was
duly filed on December 12, 2000 by Harrison W. Smith, Jr., 37 W. Broad Street, Suite
725, Columbus, Ohio 43215, Agent for Petitioners Richard S. and Elaine E. Valentin,
6707 Paul Road, Westerville, OH 43082; and
WHEREAS, a public hearing has been scheduled before the Union County
Commissioners on Monday, March 12, 2001 at 1:30 p.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation lies within Dublin's exclusive water and
sewer service extension area, as provided under the agreements with the City of Columbus;
and
WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio,~of the members concurring that:
ection 1. The City of Dublin will provide the following municipal services for the
29.56+/- acres in Jerome Township, Union County upon the annexation of the area to the
City of Dublin, Ohio:
lice. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other municipalities. The
annexation area lies approximately 2 miles northwest of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A
response time of approximately three minutes for an emergency situation should be
expected for this area.
ire. Fire and emergency medical services protection is currently provided by
well-staffed deparunents in Jerome and Washington townships. They, too, have
mutual aid agreements with other municipalities. This annexation would not
change fire department jurisdictional boundaries, and therefore response times for
fire and emergency medical services will not be affected. The Jerome Township
Fire Station is located approximately 3-1/2 miles from the annexation area, and
normal response time would be approximately eight minutes. However, due to an
existing automatic response agreement, the area is also served by the Washington
Township Fire Station 93 which is located approximately 1-1/2 miles to the east,
and normal response time would be approximately three minutes.
Sanitation. Residential refuse collection services are contracted by the City and are
currently provided at no additional charge.

Street Maintenance. The City has a Streets and Utilities Division which provides
excellent service in the area of street and road maintenance.

Section 2. The City has SEWER and WATER service area contracts with the City of
Columbus, and the subject property is within the service areas. Conditioned on the ability
of the City of Columbus to provide WATER, and to provide sufficient SEWERAGE
disposal capacity, the City of Dublin will have the ability to service the area.
Section 3. This resolution shall be in force and effect immediately upon its passage as
provided under Section 4.04(a) of the Revised Charter.

As requested at the January 2, 2001 City Council meeting, the Columbus and Franklin County
Metropolitan Part District (the District) was contacted with regard to the requested annexation. Larry
Peck, Deputy Director, stated the District was aware of the requested annexation. He stated the
rr District was not interested in acquiring this site for the future metro park; however, they have talked

WI~REAS, a petition for the annexation of 29.55+/- acres from Jerome Township was
duly filed on December 12, 2000 by Harrison W. Smith, Jr., 37 W. Broad Street, Suite
725, Columbus, Ohio 43215, Agent for Petitioners Richard S. and Elaine E. Valentin,
6707 Paul Road, Westerville, OH 43082; and
WHEREAS, a public hearing has been scheduled before thr Union County
Commissioners on Monday, March 12, 2001 at 1:30 p.m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation li~ within Dublin's ex:lusive water and
sewer service extension area, as provided under the agreements with the t2ity of Columbus;

WHEREAS, the proposed annexation is in conformance with the annexation strategy
contained in the Dublin Community Plan, adopted by Council otl November 17, 1997.
NOW, THEREFORE, $E IT RESOLVED by the Council of the City of Dublin, State
of Ohio,~of the members concurring that:
Section 1 • The City of Dublin will provide the following municipal services for the
29.56+/- acres in Jerome Township, Union County upon the annexation. of the area to the
City of Dublin, Ohio:
Police. The -City provides Police and Communications service on a full twenty-
four hour basis and also. has mutual aid agreements with other m~micipalities. The

WIINRF.AS, a petition for the annexation of 29.Sn+/- acres from Jerome Township was
duly filed on December 12, 2000 by Harrison W, Smith, Jr., 37 W. B:;oad Street, Suite

WI~REAS, a public hearing has been scheduled before thr Union County
Commissioners on Monday, March 12, 2001 at 1:30 p,m.; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing
of the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the territory proposed for
annexation; and
WHEREAS, the area proposed for annexation tins within Dublin's ex:lusive water and
sewer service extension area, as provided under the agreements with the City of Columbus;

contained in the Dublin Community Plan, adopted by Council on November 17, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Cit;~ of Dublin, State
of Ohio,~of the members concurring that:
Section 1. The City of Dublin will provide the following municipal services for the
29.56+/- acres in Jerome Township, Union County upon the annexatior. of the area to the
City of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-
four hour basis and also has mutual aid agreements with other m~micipalities. The

A motion was made by Jim Mitchell and seconded by Tom McCarthy to approve the
following resolution:
DECISION
The present annexation proceeding before us today was brought about by the application
of the owners of real estate adjacent to a municipal corporation. As such, it is governed by the
procedures. set forth in Ohio Revised Code, Sections 709.02 - .12. This kind of annexation is
initiated by the filing of a petition with the board of county commissioners of the county in which
the territory is located. The petition must be signed by a majority of landowners in the territory
adjacent to the municipal corporation. In addition the petition must contain a full legal
description and accurate map or plat of the territory to be annexed, a statement of the number of
real estate owners in the territory, and the name of the person or persons acting as agent for the
petitioners. The board of county commissioners conducts a public hearing on the petition,
accepting evidence and hearing testimony in support of and against the proposed annexation.
The state mandates that the board of county commissioners s/:all enter an order
upon its journal allowing the annexation if it finds that: (1) the petition contains all matter
required in section 709.02 of the Revised Code; (2) notice has been published as required by
section 709.031 of the Revised Code; (3) the persons whose names are subscribed to the petition
are owners of real estate located in the territory in the petition, and as of the time the petition was
filed with the board of county commissioners the number of valid signatures on the petition
constituted a majority of the owners of real estate in the territory proposed to be annexed; (4) the
municipal corporation to which the territory is proposed to be annexed has compiled with division
(B) of section 709.031 of the Revised Code; (5) the territory included in the annexation. petition is
not unreasonably large; (6) the map or plat is accurate; and (7) the general good of the territory
sought to be annexed will be served if the annexation petition is granted. The legislative
authority of the municipal corporation (city council) then must accept the application for
annexation by resolution or ordinance. The annexation takes effect and the territory becomes part
of the municipality thirty days after passage of the resolution or ordinance.

Findings of Fact
There is no question and there was no dispute that the evidence established by a
preponderance that:
(1) the petition contains all matter required in section 709.02 of the Revised Code.
(2) Notice was published as required by section 709.031 of the Revised Code.
(3) The persons whose names are subscribed to the petition were, at the time of the filing
of the petition, the owners of real estate located in the territory in the petition, and as
of the time the petition was filed with the Board of County Commissioners, the
number of valid signatures on the petition constituted all of the owners of real estate
in the territory proposed to be annexed.
(4) The municipal corporation to which the territory is proposed to be annexed has
complied with division (B) of section 709.031 of the Revised Code; and
(5) The map or plat is accurate;
(6) The territory included in the annexation petition is not unreasonably large;
(7) The general good of the territory sought to be annexed will be served if the
annexation petition is granted.
Having concluded that there is a preponderance of reliable, probative and substantial
evidence to support the seven criteria, which must be found in order to grant an annexation
petition, we cast our vote for the annexation.
