058-01 Ordinance RECORD OF ORDINANCES Dayton Legal Blank Co. Form No. 30043 58-01 Ordinance No Passed An Ordinance Amending The Annual Appropriations Ordinance For The Fiscal Year Ending December 31, 2001 WHEREAS, Section 5705.40 of the Ohio Revised Code allows for supplemental appropriations to be made to an appropriations measure provided sufficient resources are available; and WHEREAS, the Ohio Revised Code requires, when necessary, amendments to the annual appropriations measure to be made in order that appropriations are not over expended; and WHEREAS, it is necessary to amend the annual appropriations measure to provide funding authorization to utilize the fees collected for tree replacement. NOW, THEREFQRE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. There be appropriated from the unappropriated balance in the General Fund the amount of $80,750 to account 101-0620-740-2421 for the planting of trees on publicly owned property. Section 2. The public hearing be waived to provide immediate funding for the tree plantings. Section 3. This Ordinance shall take effect and be in force in accordance with Section 4.04(a) of the Dublin City Charter. Passed is : ~ day of t , 2001. ~~-C 1. Grigsby, Director of Finance '~`n~ This Ordinance appropriates the tree replacement fees received since 1999. As you are aware, the tree replacement fee is based on the caliper inches of trees removed as a result of development. This fee is paid into the City's General Fund and can only be used to plant trees on publicly owned property.
