Form No 0043 Ordinance No..........39.-0.1 Passed AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE UNION COUNTY BOARD OF COMMISSIONERS FOR SERVICES OF THE UNION COUNTY EMERGENCY MANAGEMENT AGENCY FOR THE PORTION OF THE CITY OF DUBLIN WHICH LIES WITHIN UNION COUNTY WHEREAS, Section 5502.271 of the Ohio Revised Code requires that any political subdivision that is not a part of a countywide agreement established under Section 5502.26 (Ohio Revised Code) shall have an Emergency Management Agency and shall appoint a Director of Emergency Management who shall develop an Emergency Operations Plan and pursue a professional development training program; and WHEREAS, the Union County Commissioners, by virtue of Resolution 877-96 have established an Emergency Management Agency known as the "Union County Emergency Management Agency" ; and WHEREAS, the Union County Emergency Management Agency has and will continue to fulfill the requirements of State and Federal laws and any such rules and regulations pertaining thereto regarding emergency management. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the City Manager is hereby authorized to execute a contract with the Union County Board of Commissioners for services of the Union County Emergency r,,,~,,, Management Agency for that portion of Dublin which lies within Union County. Section 2. That the terms of said agreement are attached hereto as Exhibit "A" . Section 3. That this Ordinance shall be effective upon the earliest date permitted by law. NOW BE IT RESOLVED THAT the City of Dublin does hereby desire to contract with the Union County Board of Commissioners, by virtue of Section 307.15 of the Ohio Revised Code, to obtain and receive the services of the Union County Emergency Management Agency in performing all the duties and requirements of Section 5502.271 ORC, to wit: The Union County Emergency Management Agency will develop an emergency operations plan which will encompass all political subdivisions of Union County; shall pursue a professional development training program; and coordinate the emergency management activities of all the political subdivisions that execute this contact. This agreement shall become effective upon signature of all parties hereto and shall continue in full force and effect and remain binding on the parties until the chief executive of any political subdivision requests termination thereof. The chief executive shall provide the other parties to the agreement with thirty (30) days written notice prior to termination of the agreement. It is the desire of the Board of County Commissioners of Union County to furnish the aforementioned services without cost to the City of Dublin, and do hereunto affix our signatures. Co m sinners City Manager CL''` ~ Council President Date: Q Z /2 ~o , 2001 Date: , 2001 ,u ~ RESOLUTION NO. 877-96 July 1, 1996 SUBJECT: AUTHORIZING THE FORMATION OF THE UNION COUNTY DISASTER SERVICES/EMERGENCY MANAGEMENT ORGANIZATION A motion was made by Gene Cameron to approve the following resolution: WHEREAS, there is an existing possibility of the occurrence of destruction from natural or man-made disasters or resulting from enemy attack, and it is necessary to ensure that emergency measures in this county will be adequate to deal with such disasters and generally to provide for the common defense, and to protect the public order, health, safety and general welfare, and to preserve the lives and property of the people of the county; and WHEREAS, the county and each local subdivision may need to call on county government, other local subdivisions within the county, and/or subdivision, local government, state and federal resources outside of the local community to mitigate, prepare for, respond to, or recover from said emergency disaster, enemy attach or unusual occurrence; and WHEREAS, the coordination of the emergency management activities within the area of Union County is paramount importance to all of the subdivisions required by law to establish an emergency management agency therein; and WHEREAS, the County of Union desires to affect said coordination by entering into an agreement in the manner provided by law Section 307.15 of the Ohio Revised Code, with the various municipal corporations and townships, hereinafter referred to as the political subdivisions; and WHEREAS, Ohio Revised Code, Section 5502.217 as amended, is the legal basis for the establishment of the Union County Emergency Management Agency with the power to coordinate and unify the emergency management activities of the participants thereof; and WHEREAS, it is further declared to be the purpose of this resolution and the policy of the County of Union that all emergency management functions of the county be coordinated to the maximum extent with comparable functions of the state of Ohio and the federal government, including various departments and agencies, and other states and localities, and of private agencies of every type, to the end that the most effective preparation and utilization can be made of the county's manpower, resources and facilities for dealing with any disaster or emergency that may occur; and WHEREAS, it is hereby found and declared to be necessary to create an emergency management agency to be known as the Union County Emergency Management Agency; to confer upon the Director of the Emergency Management Agency certain emergency powers provided herein; and to provide for the rendering of cooperation and mutual aid, if necessary, to surrounding and contiguous political subdivisions of the state and adjoining states. BE IT RESOLVED: that the organization to be known as the Union County Emergency Management Agency be formed to perform the services of coordinating the emergency management activities of the County of Union and the political subdivisions therein, entering into an agreement, in accordance with the provisions hereinafter set forth: and BE IT FURTHER RESOLVED: that the Union County Emergency Management Agency be authorized to render the service of coordinating the emergency management activities and to exercise for and on behalf of each party hereto as it may lawfully do, consistent with the state statutes and such regulations as have been or shall be promulgated by the Governor of Ohio, the provisions of this resolution as hereinafter set forth, and the power of the parties hereto authorized, in coordinating such emergency management activities with and within Union County; and BE IT FURTHER RESOLVED: the Board of Commissioners, Union County, Ohio, shall appoint Randy Riffle, Union County Risk Manager as director who shall serve at the pleasure of said Board and whose duties shall be such as are prescribed herein and shall not be inconsistent with the Ohio Revised Code and said director, and his staff shall not be compensated for services unless approved by action of the Board; and BE IT FURTHER RESOLVED: that the compensation of the director and staff, if any, shall be paid from the Union County Emergency Management Fund, or from other funds as approved; and i BE IT FURTHER RESOLVED: that the director shall have such additional authority, duties and responsibilities as are authorized by this resolution; and BE IT FURTHER RESOLVED: the director or emergency coordinator shall pursue professional development courses in emergency management; and BE IT FURTHER RESOLVED: that the Union County Emergency Management Agency shall prepare an Emergency Operations Plan (EOP) to be reviewed and approved, and a budget annually presented to the Board of County Commissioners. It may be necessary for adjustments to be made to the budget in the course of the year, if this is necessary, a meeting will be called by the director and the Board of Commissioners. The Board of Commissioners will provide funding for the Union County Emergency Management Agency. Funds received from whatever source or by whatever means, for emergency management by the Union County Emergency Management Agency, shall be paid to a special fund and shall be known as the Union County Emergency Management Fund; and -•-----t--..W--- . BE IT FURTHER RESOLVED: that the director shall have the general direction of the Union County Emergency Management Agency and shall be responsible for carrying out the provisions of this resolution; in performing duties pursuant to the resolution, the director is authorized to cooperate with other political subdivisions, with the State of Ohio, with other states and the federal government through appropriate channels, and with private agencies in all matters pertaining to emergency preparedness activities of the county, state and nation; and BE IT FURTHER RESOLVED: that the director shall have the authority, with consent of the Board of Commissioners, during times of "disasters" or "emergency", to enter into contracts and incur obligations necessary to alleviate the affects of such disaster or emergency, to protect the lives and safety of persons and to coordinate the emergency assistance to the victims of said disaster, and BE IT FURTHER RESOLVED: that each political subdivision electing not to participate under the Union County Emergency Management Agency will be required to establish a program for emergency management within that political subdivision consistent with the minimum requirements of Ohio Revised Code, Section 5502.217; and BE IT FURTHER RESOLVED: that this resolution is hereby declared to be an emergency measure and shall take effect and be enforced from and after passage by the Commissioners of Union County; and BE IT FURTHER RESOLVED: that the Clerk of the Board of Commissioners is hereby authorized and instructed to certify a copy of this resolution to the Union County Emergency Management Agency in line with this action; and BE IT FURTHER RESOLVED: that this resolution hereby revokes, replaces, and supersedes any prior resolution or agreement on the formation of Disaster Services, Civil Defense, or Emergency Management Agency.
