AN ORDINANCE AUTHORIZING THE EXCHANGE OF LAND
WITH EDWARDS GOLF COMMUNITIES, LLC FOR THE
DEVELOPMENT OF THE BALLENTRAE GOLF COURSE,
AND DECLARING AN EMERGENCY.
WHEREAS, a goal of Dublin City Council is to continue to work with developers for
the development of the City; and
WHEREAS, the City of Dublin ("City") and Edwards Golf Communities, LLC
("Edwards") desire to exchange certain tracts of real property for the development of the
Ballentrae Golf Course and the residential development adjacent thereto; and
WHEREAS, Edwards owns a 0.609 acre tract of real property, more or less, a 0.323 acre
tract of real property, more or less, and a 0.856 acre tract of real property, more or less,
which tracts are legally described in the attached Exhibits "A", "B" and "C", respectively,
("Edwards Property") and are located south of Shier-Rings Road in the City of Dublin,
County of Franklin, State of Ohio; and
WHEREAS, the City owns a 0.352 acre tract of real property, more or less, a 0.006 acre
tract of real property, more or less, a 0.255 acre tract of real property, a 0.093 acre tract
of real property, more or less, and a 0.256 acre tract of real property, more or less, which
tracts are legally described in the attached Exhibits "D", "E", "F", "G" and "H",
respectively, ("City Property") and are located south and north of Shier-Rings Road in
the City of Dublin, County of Franklin, State of Ohio; and
WHEREAS, the City in recognition of the development of the Ballentrae Golf Course
and residential development adjacent thereto, finds that it is in the best interest of the
City to exchange the City Property for the Edwards Property; and
WHEREAS, the City owns a 0.611 acre tract of real property, more or less, a 0.580 acre
tract of real property, more or less, a 0.645 acre tract of real property, more or less, a
0.226 acre tract of real property, more or less, a 1.339 acre tract of real property, more
or less, and a 0.682 acre tract of real property, more or less, which tracts are legally
described in the attached Exhibits "I", "J", "K", "L", "M" and "N" respectively ("City
Property II") and located adjacent to Woerner Temple Road in the City of Dublin,
County of Franklin, State of Ohio. The City Property II consists of those portions of the
formerly vacated Woerner-Temple Road that are needed for the residential development
adjacent to the golf course; and
WHEREAS, the City in recognition of the development of the Ballentrae Golf Course
and the residential development adjacent thereto, finds that it is in the best interest of
the City to transfer City Property II to Edwards; and
WHEREAS, the City and Edwards will execute the necessary conveyance
documents to complete the above real estate transfer; and
WHEREAS, the City and Edwards agree that no money shall exchange hands for the
exchange of land described above; and
NOW, THEREFORE, BE IT RESOLVED by Council of the City of Dublin, State
of Ohio, _ of the members concurring that:
Section 1. The City Manager is hereby authorized to execute the conveyance
documents necessary to complete the exchange of land with Edwards Golf Communities,
LLC for the development of the Ballentrae Golf Course and the residential development
adjacent thereto.
Section 2. The land being relinquished by the City is not needed for a public
purpose.

Section 3. Pursuant to Charter Section 8.04(c), the City waives any competitive
bidding required by O.R. Chapter 721, since it is not in the best interest of the City.
Section 4. This Ordinance is hereby declared to be an emergency necessary for the
immediate preservation of public health, safety and welfare. The reason for such
necessity is that the construction of the infrastructure and golf course community is
currently underway and the exchange of land is needed to finalize the plat. Therefore,
this Ordinance shall go into immediate effect.
