AN ORDINANCE IMPLEMENTING INTERIM RETAIL DEVELOPMENT
CONTROLS AS TO REGIONAL RETAIL CENTERS IN THE CITY OF
DUBLIN, OHIO AND DECLARING AN EMERGENCY
WHEREAS, the Council and citizens of the City of Dublin, Ohio have raised through
community planning process numerous issues and concerns related to the development of
regional retail centers within the City, including, but not limited to, the compatibility of
any proposed retail development with the surrounding azea, the impact of regional scale
retail uses, preservation of existing azchitecture, open space, traffic and access issues;
WI~REAS, the Community Plan defines Regional Centers as including highly specialized
stores and services. They aze also noted for the increased number and variety of stores and
services they contain. Most of their customers are not from the surrounding neighborhood
but from outside the area;
WHEREAS, it is Council's desire to address its concerns to the maximum extent possible,
while at the same time respecting property owners' retail development rights;
WHEREAS, the City must continue to evaluate its retail needs, available azeas for retail
development, and impact of additional retail development on the City; and
WHEREAS, in order for Council to properly evaluate and address all of these concerns
and interests, Council finds it necessary to impose a development, rezoning and building
permit moratorium for a specific period for the purposes set forth herein.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Dublin, State
of Ohio, ~ of the elected members concurring that:
Seeti~n 1 _ No development, rezoning applications or building permits shall be formally
acted upon or issued by the Planning Commission or Council for a period of 90 days from
the effective date of this ordinance or until the aforementioned issues have been addressed
and resolved by Council with the assistance of staff and consultants as may be necessary.
Serti~n 2_ Further, due to the nature and complexity of the issues raised by Council,
Council may, by resolution, extend the 90 day development, rezoning and building permit
prohibition an additional 90 days if additional time is needed to resolve these issues.
Ser_.tinn ~_ This ordinance shall not apply to any development or building permit
applications previously submitted to the City for approval.
Sertinn 4_ This ordinance is hereby declared to be an emergency measure necessary
to preserve the health, safety and welfaze of the citizens of the City of Dublin, by
preserving the status quo while evaluating the issues related to additional retail
development, including available retail space and the effects of additional retail
development.
Section 5_ This ordinance shall take effect and be in force immediately upon its
passage.
