AN ORDINANCE TO ACCEPT AN ANNEXATION OF
2.2+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY TO THE CITY OF DUBLIN
WHEREAS, on July 1, 1998 the Franklin County Commissioners approved the
annexation application filed by Harrison W. Smith, Jr., 37 W. Broad Street, Columbus,
Ohio 43215, Agent for Petitioners Patrick Grabill, Indian Ridge Associates, Inc., 5553
Windwood Drive, Dublin, Ohio 43017 and Timothy C. Hansley, City of Dublin, 5200
Emerald Parkway, Dublin, Ohio 43017; and
WHEREAS, Council is of the opinion that this territory should be annexed to the City of
Dublin.
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ~ of the elected members concurring:
Section 1. That the petition for the annexation of 2.2+/- acres (see attached legal
description, Exhibit "A") to the City of Dublin, Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in force from and after the earliest
date allowed by law.

TO THE CITY OF DUBLIN
Situate in the State of Ohio, County of Franklin, Township of Washington, being all of a
2.12 acre tract of land conveyed to Indian Ridge Associates, Ltd., by deed of record in Instrument
Number 199710270127913 and a portion of State Route 745, records of the Recorder's Office,
Franklin County, Ohio and being more particularly described as follows:
BEGINNING at a point in the southerly limited access right-of--way lil-re of Interstate 270
and the existing Cit;~ of Dublin Corporation line as established by ordinance number 13-65 at a
point in the north line of a 0.470 acre tract of land for right-of--way purposes conveyed to the City
of Dublin, Ohio by deed of record in Official Record 33377 B07;
Thence northerly, a distance of 61 feet, more or less, along the westerly right-of--way of
State Route 745 and an easterly line of the limited access right-of--way line of I-270 to a point;
Thence northeasterly, a distance of 521 feet, more or less, across State Route 745 and

said 2.12 acre tract;

Thence westerly, a distance of 641 feet, more or less, along the south line of said 2.12 acre

TO THE BOARD OF COUNTY COMMISSIONERS
OF FRANKLIN COUNTY, OHIO:
The undersigned, petitioners in the premises, and being a MAJORITY OF OWNERS OF
REAL ESTATE in the territory hereinafter described, consisting of 2.2± acres, more
or less, in the Township(s) of Washington which area is
contiguous and adjacent to the City of Dublin , do hereby pray
that said territory be annexed to the City of Dublin according to
the statutes of the State of Ohio.
A full and accurate description and a plat of said territory so prayed to be annexed are
attached hereto and made part hereof.
In support of said Petition, your petitioners state that there are within the territory so
prayed to be annexed 2 OWNER(S) OF REAL ESTATE.
Harrison W. Smith, Jr., is hereby appointed Agent for the undersigned Petitioner(s), as
required by Section 709.02 of the Revised Code of Ohio. Said agent is hereby authorized to
make any amendment and/or deletion which in his absolute and complete discretion is necessary
or proper under the circumstances then existing, and in particular to make such amendment in
order to correct any discrepancy or mistake noted by the Franklin County
Engineer in his examination of the Petition and Plat. Said amendment shall be made by the
presentation of an amended plat and description to the Board of County Commissioners on,
before, or after the date set for hearing on this Petition.

WHEREAS, the Board of County Commissioners of Franklin County, Ohio, are
presented the petition for annexation of certain adjacent territory to the City of Dublin, Ohio,
filed by Indian Ridge Associates, Inc., et al., signed by Patrick Grabil for Indian Ridge
Associates, Inc. and Tim Hansley, City Manager for The City of Dublin and appointing
Harrison W. Smith, Jr., as agent for the said territory being described as follows:
Situated in the State of Ohio, County of Franklin, Township of Washington, being all

WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County
Commissioners can ask the County Engineer for a report on the accuracy of the map or plat;
now, therefore, upon the motion of Commissioner Stokes seconded by
Commissioner Teater ;

Dear Mr. Smith:
Enclosed is a copy of the resolution adopted on May 12, 1998, by the Board of County
Commissioners, setting the time and place of public Hearing for the annexation petition which
you, as agent, filed with this office on May 1, 1997.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent,
are responsible for the following:
(1) Notification of the date of filing of your petition with the Board of County Commissioners
to be delivered to the Clerk of the municipality to which annexation is proposed and the
Clerk of each township which is included in the annexation. (A map, description and a copy
of the petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution may satisfy the
statutory requirements).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7) days
after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before May 19, 1998. (The enclosed resolution may satisfy the
statutory requirements).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real estate
at the time of the filing of the petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed,
by ordinance or resolution, adopts a statement indicating what services, if any, the
municipal corporation will provide to the territory proposed for annexation, upon
annexation. (The resolution or ordinance should include response times for fire, EMT and
police units as well as information concerning water and sewer hook-ups and other pertinent
data).
(6) The Agent or Representative of the petitioners needs to be present at the hearing to present
the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than June
17, 1998.

_ ~' -~, ~ V4'HEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to the hearing of
the annexation petition, the Municipal Authority shall adopt a statement indicating what
services, if any, the Municipal Corporation will provide to the temtory proposed for
annexation.
NO~V, TH EFORE, BE IT RESOLVED, by the Council of the City of Dublin, State of
Ohio, of the members concumng that:
'""" Section 1 The City of Dublin will provide the following municipal services for the 2.2+/-
acres in Washington Township, Franklin County upon the annexation of the area to the City
" of Dublin, Ohio:
Police. The City provides Police and Communications service on a full twenty-four
hour basis and also has mutual aid agreements with other municipalities. The
annexation area lies approximately two miles northeast of Dublin Police Division
headquarters. Dublin operates with a minimum of four cruisers on duty. A response
time of approximately five minutes for an emergency situation should be expected for
this area.
Firs. Fire and emergency medical services protection is currently provided by a well-
staffed department in Washington township. Washington township also has mutual aid
agreements with other jurisdictions. This annexation would not change fire department
jurisdictional boundaries, and therefore response times for fire and emergency medical
services will. not be affected. The Washington township fire station is located
approximately one and one-half mile from the annexation area and normal response
times should be approximately five minutes.
Street Maintenar~. The City -has a Streets and Utilities Division which provides
excellent service in the area of street and road maintenance.
Section 2 The City has SEWER and WATER service area contracts with the City of
'""" Columbus, and the subject property is within the service areas. Conditioned on the ability of
the City of Columbus to provide WATER, and to provide sufficient SEWERAGE disposal
""" capacity, the City of Dublin will have the ability to service the area.
i n This resolution shall be in force and effect immediately upon its passage as provided
under Section 4.04 (a) of the Revised Charter. c.,

RESOLUTION TO APPROVE THE PETITION OF
INDIAN RIDGE ASSOCIATES, INC., ET AL. OF
2.2+_ ACRES IN WASHINGTON TOWNSHIP TO
THE CITY OF DUBLIN, OHIO -CASE #ANX-26-98
WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the
15` day July, 1998 to hear the petition of Indian Ridge Associates, Inc., et al., filed May 1,
1998, and having in open hearing heard all persons desiring to be heard for or against the
granting of the petition, and having considered all the facts with reference thereto, being fully
advised, and
WHEREAS, the Commissioners make the following findings based upon the exhibits
and testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code Section 709.02
including, without limitation: A. A full description and accurate map or plat of the
territory to be annexed; B. A statement of the total number of owners of real estate in
the territory to be annexed; C. The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the City of Dublin,
Ohio.
3. Notice of the petition and the hearing has been published as required by law, and all
notices of filing the petition and the hearings thereon have been given and delivered as
required by law.
4. The persons whose names are subscribed on the petition are owners of real estate in the
territory sought to be annexed, and as of the time the petition was filed, the number of
valid signatures on the petition constituted a majority of the owners of real estate in the
territory proposed to be annexed.
S. The map or plat and the description of the territory contained in the petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised Code Section
709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if the annexation
petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Tester seconded by
Commissioner stokes
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN
COUNTY, OHIO:
That the prayer of the Petition be APPROVED, and the territory sought to be annexed
by the petition filed herein shall be annexed to the City of Dublin, Ohio, in accordance
with the law; that the orders and proceedings of this board relating to the Petition, and
map and description attached thereto, and all papers on file relating to this matter be
delivered forthwith to the Clerk of Council, City of Dublin, Ohio.
