Form No. 30043 Ordinance No.___________1Q3-9_$__ Passed_ ______________________________________19 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT FOR THE LOCATION OF A WIRELESS TELECOMMUNICATIONS STRUCTURE WHEREAS, SprintCom, Inc. desires to locate a telecommunications alternative tower structure with facilities in Scioto Park in order to "build-out" a PCS network; and WHEREAS, the Telecommunications Act of 1996 requires the reasonable accommodation of such structures; and WHEREAS, the City of Dublin desires to employ innovative techniques to accommodate such structures in accordance with Chapter 99 of the Codified Ordinances of the City of Dublin; and WHEREAS, the City of Dublin and SprintCom, Inc. have worked jointly to locate a site and design an unique support structure which is mutually beneficial to both parties. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~ of the elected members concurring that: Section 1. The City Manager is hereby authorized to enter into a lease agreement with SprintCom, Inc. for the purpose of the placement of a telecommunication alternative tower structure with facilities at Scioto Park. Section 2. This Ordinance shall take effect and be in force from and after the earliest date permitted by law. McDaniel, Director of Service Date: September 3, 1998 Re: Ordinance 103-98, Wireless Telecommunications Tower at Scioto Park Staff recommends Council pass Ordinance 103-98 authorizing the City Manager to enter into a lease agreement with SprintCom for the location of a wireless telecommunications structure at Scioto Park. Over a year ago SprintCom approached the City of Dublin regarding the installation of a wireless telecommunications tower in the vicinity of Scioto Park. Staff, with the assistance of Jan Murphy of Nexus Telecommunications, worked pro-actively with SprintCom to assess various possible locations in this vicinity. SprintCom has proven the need to be in the area and has submitted an application in accordance with Chapter 99 of the Codified Ordinances of the City of Dublin and complies with the requirements therein. Staff has given its administrative approval for the tower also in accordance with Chapter 99. Because the proposed tower would be in a City-owned park and scenic river corridor SprintCom desires to use an alternative tower structure in the form of an artificial tree as encouraged by Chapter 99. After much research and seeing two artificial trees in Fox Chapel, PA, staff supports this approach. Likewise, adjoining property owners and the East Dublin Civic Association have also endorsed this as the best option. This alternative tower structure will also accommodate both SprintCom and an additional antenna for a future provider. The following are attached for your review: 1. Ordinance 103-98 2. Site survey Prior to the second reading/public hearing, you will receive a digitized picture of the artificial tree transposed onto a picture of the site so you can more fully visualize this structure in the park. Because of its length, I am not including a copy of the lease agreement with this report. It is essentially the same as that passed by Council for the tower at Avery Park. In our diligence to build-out the system, we actively work with communities, such as Dublin, during the site selection process. In Dublin, we have utilized the assistance of your Telecommunications Consultant, Janice Murphy. Our search parameters have placed us within a predominantly residential area bounded by Riverside Drive and the Scioto River. The Scioto Park represents and comprises the largest contiguous land mass within this area. With the assistance of Jan Murphy, we have utilized the last nine (9) months-[o-a year developing a proposal to utilize the many natural screening capabilities of the park while still maintaining the concerns for the aesthetic quality of the park. This presented a difficult, but unique challenge. As a result, we are a proposing an application that is mutually beneficial. We are proposing to install a two (2) carrier communications facility designed by Larson Utility CamouflageT" in order to blend with the existing park attributes. A color rendering is included for your perusal. Please note that these are only renderings. Each application is custom designed. We will be ordering a facility with tree canopy extending below the existing natural tree canopy. This design will be in the form of a deciduous tree, complete with simulated bark. The structure height will be 100'. Based upon helium balloon tests, this will place the simulated tree canopy slightly above the existing tree canopy (color photos of the balloon test are included as part of this package; superimposed digital images of the proposed tree structure will be provided prior to the September 21, 1998 City Council meeting). The Scioto Park follows the natural elevations descending towards the Scioto River. As a result, the park has three (3) significant shelves, or plateaus. The first being street-level with Riverside Drive; the second shelf being a level with amphitheater and sanitary facilities; the third or lower shelf being shelters and play facilities alongside the river. The proposed site is at the north- end of the park located on the second shelf. This area is highly forested and provides natural base screening from the road, parking area and theater. At the base of the structure, will be our equipment cabinet. This cabinet does not require a building. The overall dimensions of the cabinet measure approximately six feet (6') in length, five feet (5') in height, and two and one-half feet (2'/i') in width. The equipment, and structure will be protected by a chain-link fence. The fence will then be shrouded by Colorado Green Spruce (landscape plan to be submitted and approved by the City of Dublin). Access to the site will be provided by a hard surfaced facility extending from the existing parking area to the site. In order to prevent trespassing, wooden bollards with chain will be utilized at the point of entrance (see attached surveys for site and site access depiction). Based on the information, provided herein, I hope you will perceive our efforts both, to provide PCS coverage, to the City of Dublin, and maintain the aesthetic integrity of your community, favorable.
