AN ORDINANCE AMENDING THE ANNUAL
APPROPRIATIONS ORDINANCE FOR THE
FISCAL YEAR ENDING DECEMBER 31, 1998

WHEREAS, Section 5705.40 of the Ohio Revised Code allows for supplemental
appropriations to be made to an appropriations measure provided sufficient resources are
available; and
WHEREAS, Ordinance No. 65-93 provides for cooperation with the State of Ohio on the
acquisition ofright-of--way on the State Route 161, Dale to Sawmill, project; and
WHEREAS, it is necessary to amend the annual appropriations measure to provide
funding for the right-of--way acquisition costs related to this project.
NOW, TH FORE, BE IT ORDAINED, by the Council of the City of Dublin, State
of Ohio, of the elected members concurring that:
Section 1. There be appropriation from the unappropriated balance in the General Fund
the amount $2,514,000 to account 01-02-15-2721 for the purpose of transferring funds to
the Transportation Improvement Fund.
Section 2. There be appropriated from the unappropriated balance in the Transportation
Improvement Fund the amount of $2,514,000 to account 49-03-14-2510 for the purpose
of acquiring right-of--way for the State Route 161, Dale to Sawmill project.
Section 3. The public hearing be waived to provide funding immediately to allow the
State of Ohio to begin the acquisition ofright-of--way as soon as possible.
Section 4. This Ordinance shall take effect and be in force in accordance with Section
4.04(a) of the Dublin City Charter.

As discussed at the July 1, 1998 CIP workshop, right-of--way (R-O-W) acquisition costs for the State Route
161, Dale to Sawmill project, have significantly increased based on the Ohio Department of
Transportation's revised estimates. The revised project cost for r-o-w is $3,644,000. $880,000 of the total
r-o-w costs will be paid for with federal funds with the remaining $2,764,000 being funded by the City.
$250,000 was previously appropriated for the acquisition of r-o-w and Ordinance No. 91-98 is requesting
the remaining $2,514,000 be appropriated.
We are still working out the details with the Ohio Department of Transportation on the transfer of funds
between the City and the State. The State will be requiring that we make a transfer of $1,000,000 to a
project account prior to them commencing acquisition. We are pursuing the issue of interest earnings on
this account similar to the arrangement established for the Post Road widening project. If you have any
