Form No. 30043 .- 86-98 Ordinance No.______.-_________ __-.-- Passed ---------------------------19 AN ORDINANCE VACATING A PORTION OF POST ROAD RIGHT-OF-WAY WHEREAS, OCLC has requested vacation of Post Road right-of--way east of Frantz Road and has paid full fees as required by the City; and WHEREAS, the City Engineer of the City of Dublin has determined that the vacation of this portion of Post Road right-of--way will have no adverse impact on the City's transportation system and Thoroughfare Plan; and WHEREAS, Council further finds that there is good cause for such vacation of the surplus right-of--way and that such vacation will not be detrimental to the general interest of the City of Dublin. NOW T~REFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That a portion of the Post Road right-of--way located west of Frantz Road is hereby vacated to the adjoining tax parcels according to Ohio Revised Code Chapter 711, provided, however, that the City reserves a permanent access and utility easement therein for the purpose of installation, maintenance and operation of various public utilities, publicly owned or otherwise. The portion of the Post Road right-of--way to be vacated is more fully described in the legal description included on the vacation plat attached hereto. Section 2. That the City Engineer be, and hereby is, directed to cause said vacation plat to be recorded at the Office of the Franklin County Recorder. Section 3. That the Clerk of Council be, and hereby is, directed to notify the Auditor of Franklin County of the vacation, by forwarding a copy of this Ordinance thereto. Section 4. That this Ordinance shall take effect and be in force from the earliest period allowed by law. The right-of--way requested for vacation by OCLC is along the north side of SR 161, east of the existing roadway of Post Road. The right-of--way to be vacated is bounded by property owned by OCLC. In March, we asked the City Department and Division managers to review and comment on the proposed right-of--way vacation. We received no comments which would prohibit us from proceeding with Council review and approval of this vacation plat. .~~ With Council's approval of this plat, the City will vacate and release the described section ofright-of--way to OCLC, the property owner abutting both sides of the existing right-of--way. There will remain a residual easement for utilities which may remain in use in this area of vacation. This petition to vacate is being filed pursuant to Ohio Revised Code Section 723.04 et seq. OCLC is the adjacent property owner along the entire northerly side of this section of Post Road. Since the sole use of this portion of Post Road is to service the 2 residences at the above addresses, we believe that it would be in the best interest of the City to vacate this portion that serves no useful municipal purpose. I look forward to our meeting on Thursday, March 12, 1998 at 1:30 p.m. to discuss this issue further. In addition, I understand that we will be asked to pay the City's reasonable expenses for legal fees, recording and transfer fees. 2) You wilt immediately begin efforts to acquire (by eminent domain) the parcel between our 2 parcels and the northeast corner of Route 161 and Frantz Road. The intention is to then deed the portion of the roadway being vacated (the southerly one-half, which will revert to the city as the owner of that front parcel) to OCLC, with an access easement reserved over the newly vacated road. ~ 3) You will furnish me a letter assuring OCLC that the curb cut for these two parcels will be made in the re-working of Frantz Road at the same location as it presently exists. 4) You will give us an update on the installation of the equipment being purchased ~`~ to block off the pedestrian traffic at both ends of the Shawan Falls footbridge.
