Form No. 30043 104 -14 Ordinance No. Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR PUBLIC HEALTH SERVICES WITH THE DISTRICT ADVISORY COUNCIL OF THE FRANKLIN COUNTY GENERAL HEALTH DISTRICT FOR 2015 WHEREAS, Chapter 3709 of the Ohio Revised Code states that a city constitutes a health district and must provide health services for residents within that district; and WHEREAS, the City contracts with the District Advisory Council of the Franklin County General Health District to provide health services as required by the Ohio Revised Code; and WHEREAS, the previous contract authorized under Ordinance 81 -13 expires on December 31, 2014. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. The City of Dublin desires to enter into a contract, attached hereto as an Exhibit, with the District Advisory Council of the Franklin County General Health District to provide health services to the residents of the City of Dublin. Section 2. The City Manager and Finance Director be, and hereby are, authorized and directed to execute said contract with the District Advisory Council of the Franklin County General Health District. Grigsby, City Manager VVQQ J_ DATE: October 9, 2014 RE: Ordinance No. 104 -14 — Franklin County Public Health 2015 Contract Summary Memo Ordinance 104 -14 authorizes the City Manager to enter into a contract with The District Advisory Council of the Franklin County General Health District for the provision of public health services and plumbing inspection services for 2015. Franklin County Public Health serves as the public health agency for the City, including the portions of the City in Delaware and Union Counties. On August 12, 2014, the Franklin County Board of Health approved a per capita rate for the public health services it provides to participating jurisdictions. Based on MORPC's estimated population for Dublin of 43,648 and the FCBH's 2014 per capita rate of $7.16, the City's cost for the 2015 contract is $312,624.44. This per capita cost reflects a 17.2% increase over the 2014 per capita rate. Last year, Franklin County Public Health notified the jurisdictions about the need for the increases and then met with the various jurisdictions between March and July 2014. The 17.2% increase represents a phase -in of increased charges for public health services. These increases are necessary to raise an additional annual investment of $957,500 to address core services and unfunded mandates. This 17.2% increase will generate $559,000 of the requested $957,500 investment. Another fee increase will be required in 2016 to generate the remaining $398,500. Based on input from the meetings held with jurisdictions, further review and discussion of funding formulas for contract cities will take place in 2015 in preparation for the 2016 budget. As Council is aware, the mosquito control and management program is handled under a separate, three -year (2014 -2016) contract between Vector Disease Control Inc. and Franklin County Public Health. VDCI invoices the City of Dublin for the work completed under the contract. FCPH is responsible for the contract administration and monitors VDCI's performance and compliance with the terms, conditions and specifications to the contract. The cost for the City of Dublin under the contract between FCPH and VDCI is $39,714.50 per year. Recommendation Staff recommends that Council approve Ordinance 104 -14 at the second reading /public hearing on October 27, 2014. After talking individually with many of you and hearing your concerns, the Board of Health opted to phase in this increase. The 17.2% increase will generate only $559,000 of the needed $957,500. Attached is a summary of information the Board considered in making this decision. As always, we consider each of our jurisdictions important partners, and work to balance the need for public health funding, with the increasing demands we know you are facing too. Based on the per capital rate of $7.16 approved by the Franklin County Board of Health on August 12, 2014, the annual cost of your 2015 contract will be $312,624.44. Your total cost is determined by multiplying your city's population figures by the per capita rate. Based on the MORPC population estimate, the population figure for your city is 43,648. An electronic survey was conducted in the fall of 2013 for feedback on our public health services and funding formula. FCPH met again with our jurisdictions in February 2014 to share survey results and introduce our investment proposal - the need to raise an additional annual investment of $957,500 starting in 2015. The proposal specified how the funds would be used for core public health services and foundational capabilities. At that time the Health Commissioner, Susan Tilgner, pledged to meet with each jurisdiction individually for their feedback. Between March and July 2014, meetings were held with 13 of 14 contract cities; 8 of 9 villages; and 13 of 17 townships. Here are the highlights of what was learned: • Services provided by FCPH: Overall jurisdictions are satisfied with the variety and quality of services provided by FCPH. Most importantly, we received constructive feedback about how to improve and become a more valuable community resource. There also seems to be good alignment in what FCPH considers a core public health service and what is considered critical and important, and least important, by the jurisdictions served. The case for an increased investment: FCPH is the 6th largest health district in Ohio, but falls among the lowest per capita expenditures for a local health district. The US median per capita expenditure in 2013 was $39, in Ohio it was $31, and for FCPH, it was $18.60. Our proposed increase of $957,500 would raise FCPH to only $20.60, still almost $11 below more than half of health districts in the state. We cannot expect to achieve and maintain public health accreditation without adequate funding for core public health services. • The ability to absorb the increase varies across jurisdictions: While no jurisdiction was thrilled about an increase, some of them shared that they can absorb the increase without undue hardship. Others discussed the possibility of having to cut services or lay off an employee to absorb the increase. The diversity in available resources among jurisdictions makes it difficult to come up with a funding solution that fits all. • The funding formula needs to be revisited: Some townships and villages who pay a comparatively higher "per capita rate" than the contract cities felt strongly that the funding formula should be reviewed. They expressed the need for a "level playing field" with all jurisdictions paying on a property valuation formula. If cities were charged on a property valuation instead of per capita, some cities would see more of an increase while a few others would actually decrease. To be fully resolved, this issue should have further review and discussion. Contact: Susan A. AND FRANKLIN COUNTY PUBLIC HEALTH This contract is made and entered into by and between the City of Dublin, Ohio, a municipal corporation constituting a city health district, and the District Advisory Council of the Franklin County General Health District pursuant to Ohio Revised Code section 3709.08, and Franklin County Public Health pursuant to Ohio Revised Code Section 3709.281. WITNESSETH SECTION 1. The District Advisory Council of the Franklin County General Health District shall, for the consideration hereinafter stated, furnish to the City of Dublin, Ohio, and inhabitants thereof, all such public health services as are furnished by said Council to all villages and townships and the inhabitants thereof, of Franklin County, Ohio. Said services shall include the minimum standards and optimal achievable standards for boards of health and local health departments pursuant to Ohio Revised Code Section 3701.342. Also, the Franklin County General Health District shall provide other services, including the enforcement of the following Franklin County Public Health Regulations: (703) Plumbing (709) Rabies Control Regulation (710) Housing Maintenance and Occupancy (712) Rat Control (715) Dead Animals (716) Weeds (717) Manure (718) Nuisance (719) Approval of Building Plans (720) Household Sewage Treatment Systems (800) Comprehensive Solid Waste Regulations (803) Waste Haulers 2 The City of Dublin, Ohio, shall adopt, according to law, the current version of the above - described regulations of Franklin County Public Health. Such services shall be rendered, if appropriate and necessary, when requested by the citizens of Dublin, Ohio, officials of city government, school authorities or medical personnel practicing in or around the City of Dublin, Ohio or when required by state statute. The City Attorney of Dublin, Ohio shall be responsible for any litigation involving enforcement of Health Regulations within the corporate limits of said political subdivision. This Agreement and any claims arising in any way out of this Agreement shall be governed by the laws of the State of Ohio. Any litigation arising out of or relating in any way to this Agreement or the performance hereunder shall be brought only in an Ohio court of competent jurisdiction in Franklin County, Ohio, and the City of Dublin hereby irrevocably consents to such jurisdiction. SECTION 2. Said public health services shall be furnished beginning January 1, 2015 and ending December 31, 2015 provided, however, that either party to this agreement shall have the right to cancel the same upon four (4) months written notice and the parties hereto may, by mutual written agreement, modify the terms of this agreement. SECTION 3. Franklin County Public Health will provide ongoing communication with the Mayor /City Manager and his or her designees through a webinar or conference call at least quarterly. This communication will provide information on timely public health topics, upcoming events and featured services. Reports and other information about direct services that are being provided to the citizens of Dublin will be provided upon request. SECTION 4. The City of Dublin, Ohio shall pay to the Franklin County General Health District for said public health services furnished to the City of Dublin, Ohio and the inhabitants thereof, such sum or sums of money based on a per capita rate as would be charged against municipal corporations composing the Franklin County General Health District at a per capita rate of $7.16. SECTION 5. Said sum or sums of money shall be paid by the said City of Dublin, Ohio to said Franklin County General Health District upon receipt of semi - annual invoices by the Franklin County Board of Health on the first day of January, and June, 2015. The sum for 2015 shall not exceed $312,624.44, notwithstanding any fee established pursuant to the sections set forth below. SECTION 6 . In any instance where the Franklin County General Health District expends funds to abate a nuisance pursuant to Section 1, above, within the City of Dublin, Ohio, the Franklin County General Health District may invoice the City of Dublin, Ohio for the costs of such nuisance abatement. Further, the City of 3 Dublin, Ohio, shall pay, in addition to those sums set forth in Section 5, above, to the Franklin County General Health District the cost to abate the nuisance. The Franklin County General Health District agrees to certify such nuisance abatement costs to the Franklin County Auditor to be recorded as a lien upon the property and shall reimburse all funds recovered under such a lien to the City of Dublin, Ohio. PLUMBING INSPECTION SERVICES: SECTION 7 . Franklin County Public Health shall, for the consideration hereinafter stated, furnish to the City of Dublin, Ohio, all plumbing inspections as are furnished to all inhabitants within the general health district of Franklin County. Inspectors are to be state certified by the Ohio Department of Commerce. SECTION S . The City of Dublin, Ohio, through its Building Department, shall issue permits and collect fees for such plumbing inspections. The fee to be charged shall be the most current fee charged by the Franklin County General Health District. The City of Dublin, Ohio, shall forward sixty (60) percent of all plumbing inspection fees collected by them to the Franklin County General Health District after said Health District has submitted monthly statements of the amount due. The City of Dublin, Ohio shall pay said amount, within thirty (30) days after receipt of said statement. SECTION 9. This contract is approved by a majority of the members of the legislative authority of the City of Dublin, pursuant to the provisions of Ordinance dated SECTION 10. The City of Dublin, Ohio has determined that the District Advisory Council of the Franklin County General Health District is organized and equipped to adequately provide the service that is the subject of this contract. Pursuant to Ohio Revised Code section 3709.08, the Franklin County General Health District shall have all the powers and perform all the duties required of a board of health of the city health district within the jurisdiction of the City of Dublin. 4 IN WITNESS WHEREOF, the parties to this agreement have hereunto set their hands and seals and have executed this agreement the day and year written below.
