AN ORDINANCE AUTHORIZING THE
CITY MANAGER TO ENTER INTO A CONTRACT
ON BEHALF OF THE CITY OF DUBLIN, OHIO,
~ WITH DELAWARE COUNTY, OHIO AND THE CITY OF COLUMBUS, OHIO
WHEREBY SEWER SERVICE BOUNDARIES WILL BE ADJUSTED
. .......
WHEREAS, the city of Dublin, Delaware County and the city of
Columbus, after extensive discussions and negotiations have
reached an agreement for sanitary sewer service, attached as
Exhibit "A"; and
WHEREAS, Dublin city Council passed Resolution No. 13-91 on
August 19, 1991 (attached as Exhibit "B") directing the City
Manager to prepare an agreement to provide sewer services for
a portion of Dublin by the Delaware County Sewer System; and
WHEREAS, the execution of this contract will provide for the
long term sewer service needs for an area of Dublin
encompassing approximately 210 acres, located north of
Summitview Drive by the Delaware county Sewer System and will
also provide a sewer connection to the Village of Shawnee
Hills by the cities of Dublin and Columbus; and
WHEREAS, it is the intent of Dublin City Council to establish
a fund at a future date into which shall be deposited
contributions from the owners/developers of property
,.... identified in Exhibit "A" of the attached agreement for the
purpose of funding any disparity between the sewer revenues of
.. customers in this area and billings from Delaware county to
~ the City of Dublin for sewer service.
NOW, THEREFORE, BE IT ORDAINE~ by the Council of the City of
Dublin, State of Ohio, J of the elected members
concurring that:
section 1. The City Manager is hereby authorized and
directed to execute a 3-party Sewer Service Agreement among
Delaware County, the City of Columbus and the city of Dublin,
which is attached hereto and incorporated herein.
section 2. The form of said agreement shall be subject to
the final approval of the Law Director.
Section 3. This Ordinance shall take effect and be in
force on the earliest date permitted by law.

THIS AGREEMENT, made and entered into this day of

"County"), and the city of Columbus.
WIT N E SSE T H: .
WHEREAS, an area of the city of approximately two hundred
ten (210 ) acres developed and to be developed for residential use
(hereinafter called "Service Area No.1", situated generally north
of Summit View Road and shown on "Exhibit A" attached hereto and
hereby made a part hereof) is situated in Franklin County, Ohio,
and the City and the County have determined that sewage and
wastewater from Service Area No. 1 can be treated and discharged by
the County; and _.
WHEREAS, an area of the County known as the Village of
Shawnee Hills (hereinafter called "Service Area NO.2") is situated

the County have determined that sewage and wastewater from Service
Area No. 2 can be treated and discharged by the City; and
WHEREAS, the City and the County wish to set forth their
agreement concerning the collection, transportation, pumping,
treatment and discharge of sewage and wastewater from Service Area
No. 1 and Service Area No. 2 and the fees to be charged therefor;

WHEREAS, the City of Columbus has participated in the
instant negotiation, and has reviewed and approved the provisions
of this Agreement;
NOW, THEREFORE, in consideration of the foregoing and the
mutual covenants and agreements hereinafter set forth,~ the City,
the County and the city of Columbus do hereby agree as follows:
1. The City shall have the right and obligation, in
accordance with the provisions of this Agreement, to cause all
sewage and wastewater from Service Area No. 1 to be collected and
discharged into the sani~ary sewer system of the County for treat-
ment at and discharge from the sewage and wastewater treatment
facilities of the County.
On and after such time as of which the city and the
City of Columbus, Ohio (hereinafter called "Columbus" ) shall
complete the construction of the West Branch Interceptor and the
village of Shawnee Hills or the County shall have constructed, or
caused to be constructed, a sewage and wastewater collection system
within Service Area No. 2, the County shall have the right and
obligation, in accordance with the provisions of this Agreement, to
cause all sewage and wastewater from Service Area No. 2 to be
collected and discharged into the sanitary sewer system of the City
for treatment at and discharge from the sewage and wastewater
treatment facilities of Columbus, pursuant to the City's sewer
agreement with Columbus.
2. The construction of all sanitary sewers, pump
stations, service connections and other equipment and facilities
necessary to provide sanitary sewer service to either Service Area

No. 1 or Service Area No. 2 shall meet the specifications and
requirements in effect for the area in which such construction work
is to be done and shall conform also to all City and County
specifications and requirements. As part of such construction work,
the City shall install, or cause to be installed, one master meter
f~~ at the point at which the 'sewage and wastewater collection system

the County, and the County shall install, or cause to be installed,
one master meter at the point at which the sewage and wastewater

sanitary sewer system of the city. Such construction work shall be
done in accordance with detailed plans and specifications which
shall have been approved by the sanitary Engineer for the County
and the Engineer for the City. In addition to other requirements,
such plans and specifications shall include the following informa-
tion:
a. Data and calculations upon which any sewer line
is based shall be typewritten on 8 1/211 x 1111 - paper and
shall include the following:

(1) average domestic flow in each sewer;
(2) III flow in each sewer;
(3) peak flow in each sewer;
(4) the capacity of each sewer;
b. a 2' contour topographical map (on a scale of
1" = 200') to show the tributary area;
c. a proposed lot layout;

d. proposed sewer sizes, percentages of grade and
invert elevations; and
e. location and size of any sewage pump station
and force main.
Upon completion of any such construction work and not later than
!fI/II!'>- sixty (60) days thereafter, accurate records and mylar drawings
showing the work as actually constructed and the area of each and
every tributary lot and tract shall be filed by the party con-
structing the same with the Sanitary Engineer of the County and the
Engineer of the City. .
3. The city shall be responsible for the inspection of
all construction work within Service Area No. 1 performed in
accordance with the provisions of this Agreement, and plan review
and inspection fees therefor will be collected and retained by the
City. When the construction of the sanitary sewers, pump stations
and other equipment constituting the sewage and wastewater
collection system in Service Area No. 1 has been completed and
fI""'" accepted by the City, the city will become the owner thereof and

The County or its designee shall be responsible for the
inspection of all construction work within service Area No. 2
performed in accordance with the provisions of this Agreement, and
plan review and inspection fees therefor will be collected and
retained by the county or its designee. The sanitary sewers, pump
stations and other equipment constituting the sewage and wastewater
collection system in service Area No. 2, as well as any line

sewer system within Service Area No. 1 and shall adopt and make
applicable and enforce within Service Area No. 1 the -laws and
regulations of the Coun~y relating to sewage and wastewater dis-
charge, and shall also enforce within Service Area No. 1 all other
applicable laws and regulations relating to sewage and wastewater
discharge. The City also hereby empowers the officers and employees
of the County to enforce such laws and regulations within Service
Area No. 1. If, as a result of an accident or otherwise, any
discharge into the County sanitary sewer system from Service Area
No. 1 in violation of any such law or regulation occurs, the City

5. In order to control the extent to which service Area

No. 1 shall utilize the County's sewage and wastewater treatment
facilities, the City shall ensure that no residential development
within Service Area No. 1 shall exceed a gross density of one and
one-fourth (1.25) residential units per acre or a maximum total
number of 300 dwelling units; however the City may expand the
diversion area as required to meet the maximum number. capacity
fees for service connections to the sanitary sewer system within
Service Area No. 1 shall be paid to the County. Such capacity fees

shall be equal to the County's then current capacity fees for its
Regional 1A District plus the surcharge then in effect as set forth
below:

The city shall pay to the County usage fees based upon the actual
usage in service Area No. 1 as recorded by a master meter and at
the County's current residential rate (based upon an assumed
discharge of 290 gallons per day per residential unit) plus a fifty
percent (50%) surcharge. The County agrees to bill the actual
users for usage fees on behalf of the city, including such
additional user surcharges which the City may impose, based upon an
agreement to be completed at a later date.
In order to control the extent to which Service Area No.
2 shall utilize the sewer systems of the city and Columbus and the
sewage and wastewater treatment facilities of Columbus, the County
agrees that the city shall not be obligated to accept into its
sanitary sewer system sewage and wastewater from more than the
equivalent of three hundred (300) residential units (based upon an
occupancy of 2.9 persons per residential unit and one hundred (100)

gallons per person per day of wastewater discharge) . Capacity fees
for service connections to the sanitary sewer system within Service
Area No. 2 shall be paid to the city and Columbus. Such capacity
fees shall be equal to the then current capacity fees of the City
and Columbus. The County shall pay to the city, not less frequently
,. than quarterly, usage fees based upon the actual usage in Service
~ Area No. 2 as recorded by a master meter and at the County's
current residential rate (based upon an assumed discharge of 290

connection permit has been issued) plus a fifty percent (50%)

surcharge. The City shall distribute such usage fees between the
City and Columbus in proportion to the then current City and
Columbus sanitary sewer user charges applicable for the City of
Dublin. The County or its designee shall be responsible for
billing and collecting usage fees to and from the actual users.
6. The mechanism for the issuance of sewer service
connection permits for Service Area No. 1 and No. 2 shall be
mutually agreed to by the parties via separate agreement.
7. The parties hereto shall review the terms of this

Agreement on or about each anniversary of the date hereof and shall
make such amendments hereof as shall be necessary in order to
accommodate any changes in technical requirements indicated by
conditions existing at the time of the review.
8. This Agreement constitutes the entire agreement of
the parties hereto regarding the subject matter hereof, shall
become effective as of the date hereof and shall remain in effect
until terminated by agreement of the parties. However, this

Agreement shall become void unless approved by Columbus in the
manner hereinafter set forth. No amendment or modification of any
provision hereof shall be effective unless set forth in writing and
executed by the parties hereto.
9. Columbus, by its execution of this Agreement, hereby
,-... approves the same and agrees that the same shall constitute an
,- addendum to its Sewer Agreements with the City and the County. In
the event any of the provisions contained herein conflict with the
City or County Sewer Agreements with Columbus, the terms-and pro-
visions of this Agreemen~ shall control.

ment to be executed as of the day and year first above written.

A RESOLUTION RATIFYING THE CITY MANAGER IS
,""'" RELEASE OF CERTAIN TERRITORY TO DELAWARE
COUNTY FOR THE PURPOSE OF PROVIDING SANITARY
~ SEWER SERVICE

WHEREAS, the City of Dublin has been requested by the property
owner of a tract which lies generally north of Summitview Road and
west of Sawmill Road to release this acreage to Delaware County for
the purpose of providing sanitary sewer service; and,
I WHEREAS, it has been determined that this tract lies within the
City of Dublin, and in both Franklin and Delaware Counties; and,
WHEREAS, the staff of the City of Columbus and the staff of the
City of Dublin have reviewed this request and have determined that
this proposal is the most cost effective method of providing
service to this area; and,
WHEREAS, it is the desire of Delaware County and the Dublin City
Administration to develop a written policy for this proposed
service area release.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Dublin,
County of Franklin, State of Ohio;

. Section 1. That the City Manager's proposed release of certain
territory to Delaware County for the purpose of providing sanitary
~ sewer service is ratified.
Section 2. The City Manager is authorized to enter into policy
negotiations and/or to exercise a written agreement in this regard
under terms and conditions which are favorable to the City of
Dublin.
Section 3. That this resolution shall take effect and be in force
at the earliest period allowed by law.
