AN ORDINANCE TO ACCEPT AN ANNEXATION OF
7.356+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY TO THE CITY OF DUBLIN
"- WHEREAS, said annexation has been approved by the Franklin
county Commissioners, and council is of the opinion that said
territory should be annexed.
NOW, THEREFORE BE IT ORDAINED by the Council of the City of
Dublin, state of Ohio, ~ of the elected members concurring: I

section 1. That the petition for the annexation of 7.356+/-
acres (see attached legal description) to the city of Dublin,
Ohio is hereby accepted.
section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

also being part of Llewellyn Estates, a subdivision of record in
Plat Book 32, Page 43, Recorder's Office, Franklin County, Ohio,
and being more particularly described as follows:

line of the city of Dublin as established by Ordinance No. 49-80

petition for annexation of certain adjacent territory to the City of Dublin, Ohio, filed by Jeffrey W.
Edwards, et al., signed by Jeffrey W. Edwards, Lisa A. Edwards and Robert S. Crane, III, and appointing
Christopher T. Cline, as agent for the said territory being described as follows:

WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County Commissioners
can ask the County Engineer for a report on the accuracy of the map or plat; now, therefore, upon the
motion of Commissioner Shoemaker , seconded by Commissioner Teater ,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County Courthouse at 10:00 A.M. on
December 1, 1993; and
Section 2. That the Zoning Director to the Board of County Commissioners be and
hereby is directed to notify the agent of the petitioners of the time and place of said
hearing; and
Section 3. That the map or plat of Jeffrey W. Edwards, et al. is hereby referred to the
County Engineer of Franklin County, Ohio, for the checking of its accuracy of
description.

Enclosed is a copy of the resolution adopted on October 12, 1993, by the Board of County
Commissioners, setting the time and place of public hearing for the annexation petition which you, as
agent, filed with this office on September 30, 1993.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent, are
responsible for the following:
(1) Notification of the date of filing of your petition with the Board of County Commissioners
to be delivered to the Clerk of the municipality to which annexation is proposed and the
Clerk of each township which is included in the annexation. (A map, description and a
copy of the petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution will satisfy the
statutory requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7)
days after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before October 19, 1993. (The enclosed resolution will satisfy
the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real
estate at the time of the filing of the petition and the number of owners signing the
petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed,
by ordinance or resolution, adopts a statement indicating what services, if any, the
municipal corporation will provide to the territory proposed for annexation, upon
annexation. (The resolution or ordinance should include response times for fire, EMT and
police units as well as infonnation concerning water and sewer hook-ups and other
pertinent data).
'\1Ql.t$l'" (6) The Agent or Representative of the petitioners needs to be present at the hearing to
present the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than November 17,
1993.

Christopher T. Cline, being duly cautioned and sworn, states as follows:
1. He is the attorney and agent for petitioners in the annexation of 7.356 acres, more or
less, from Washington Township to the City of Dublin, Ohio, Jeffrey W. Edwards, et al.'
petitioners; Annexation 47-93, Franklin County, Ohio.
2. There were four property owners within the territory sought to be annexed at the time of
the filing of the petition for annexation.
3. Three of the four owners signed the annexation petition.
4. Notice of the filing of the annexation was served upon the clerks of Washington
Township and of the City of Dublin on the 4th day of October, 1993. Copies of the notice
which includes a receipt from each clerk is contained in the file.
5. A copy of Resolution #967-93 of the Franklin County Commissioners was served on
the Clerk of Washington Township on October 15, 1993 and on the Clerk of the City of
Dublin, Ohio on October 19, 1993. Receipts from both clerks are contained in the file.
6. Publication as required by the statute is being made by the Daily Reporter and separate
proof of publication will be made by the newspaper.

A RESOLUTION TO SET FORTH A STATEMENT
OF SERVICES TO BE PROVIDED TO THE AREA
IN A PROPOSED ANNEXATION OF 7.356+/- ACRES
FROM WASHINGTON TOWNSHIP, FRANKLIN COUNTY
I TO THE CITY OF DUBLIN, OHIO AS REQUIRED
BY SECTION 709.031 OF THE OHIO REVISED CODE,
AND DECLARING AN EMERGENCY
WHEREAS, a petition for the annexation of 7.356+/- acres from
Washington Township was duly filed by Christopher T. Cline, 37
W. Bridge street, DUblin, Ohio, agent for petitioners Robert
s. Crane III and Jeffery W. & Lisa A. Edwards; and
WHEREAS, a public hearing will be required before the Franklin
County commissioners; and
WHEREAS, section 709.031 of the Ohio Revised Code requires
that, prior to said hearing, the Municipal Authority shall
adopt a statement indicating what services, if any, the
Municipal Corporation will provide to the territory proposed
for annexation.
NOW, THEREFORE, BE IT RESOL:0D by Council of the City of
DUblin, State of Ohio, of the elected members

=:: section 1. The City of Dublin will provide the following
:__ municipal services for the 7.356+/- acres in Washington
_ Township, Franklin County upon the annexation of said area to
~' the City of Dublin, Ohio:
Police. The City provides Police and Communications

serV1ce on a full twenty-four hour bas1s and also has
mutual aid agreements with other municipalities. The
\ - annexation area lies approximately two miles southeast of
Dublin's Police Division Headquarters. Dublin operates
with a minimum of three cruisers on duty. A response
time of approximately five minutes for an emergency
situation should be expected for this area.
Fire. Fire protection is currently provided by a well-
staffed departments in Washington and Perry Townships.
They, too, have mutual aid agreements with other
municipalities. This annexation would not change fire
department jurisdictional. boundaries, and therefore
response times for fire and emergency medical services
will not be affected. The Washington Township Fire
station is approximately two miles from the annexation
area and normal response times should be approximately
three minutes.
sanitation. Residential refuse collection services are
contracted by the city and are currently provided at no
~_ additional charge.
Street Maintenance. The City has a Street Maintenance
Department which provides excellent service in the area
of street and road maintenance. This department also
provides curbside leaf pick-up at no additional charge.
section 2. The City has SEWER and WATER service area
contracts with the City of Columbus, and the subject property
is within said service areas, and conditioned on the ability
of the city of Columbus to provide WATER, and to provide

ability to service the area.
section 3. That this Resolution is declared to be an
emergency measure for the preservation of the public peace,
health or welfare of the residents of this city, and therefore
this resolution shall take effect and be in force immediately
upon its passage.

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the 1st day of
December, 1993 to hear the petition of Jeffrey W. Edwards, et al., filed September 30, 1993, and having.
in open hearing heard all of persons desiring to be heard for or against the granting of the petition, and :
having considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings, based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code
Section 709.02 including, without limitation: A. A full description and
accurate map or plat of the territory to be annexed; B. A statement of the
total number of owners of real estate in the territory to be annexed; C.
The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the City
of Dublin, Ohio.
3. Notice of the petition and the hearing has been published as required by
law, and all notices of filing the petiton and the hearings thereon have
been given and delivered as required by law.
4. The persons whose names are subscribed on the petition are owners of
I real estate in the territory sought to be annexed, and as of the time the
I petition was filed, the number of valid signatures on the petition
constituted a majority of the owners of real estate in the territory
, proposed to be annexed.

Ii 5. The map or plat and the description of the territory contained in the

petition are accurate.
I 6. The City of Dublin has complied with Division (B) of Ohio Revised
I Code Section 709.031.

7. The territory sought to be annexed is not unreasonably large.

the annexation petition is granted and the annexation is allowed.
