AN ORDINANCE AMENDING CHAPTER 339, I
COHHERCIAL MOTOR VEHICLES, CODIFIED ORDINANCES I

l.... WHEREAS, the Council of the city of Dublin, state of Ohio,
finds that enforcement of the load limits for commercial
vehicles is necessary to protect pedestrians and motorists,
and to protect the streets of the City of Dublin, state of
Ohio, from undue wear and tear; and
WHEREAS, the enforcement of load limits for commercial motor
vehicles is essential for the health, safety and welfare of
the residents of the City of DUblin, state of Ohio.
NOW THEREFORE, be it ordaine~bY the Council of the City of
Dublin, state of Ohio, of the elected members
concurring,
section 1. That section 339.99 of the Codified Ordinances
of the City of Dublin, Ohio, be amended to read as follows:
WHOEVER VIOLATES THE WEIGHT PROVISIONS OF
SECTIONS 339.01 OR 339.02 SHALL BE FINED
$80.00 FOR THE FIRST 2,000 POUNDS, OR FRACTION
THEREOF, OF OVERLOAD; FOR OVERLOADS IN EXCESS
OF 2,000 POUNDS, BUT NOT IN EXCESS OF 5,000
,..... POUNDS, SUCH PERSON SHALL BE FINED $100.00,
AND IN ADDITION THERETO, $1.00 PER 100 POUNDS
~,.. OF OVERLOAD; FOR OVERLOADS IN EXCESS OF 5,000
POUNDS, BUT NOT IN EXCESS OF 10,000 POUNDS,
SUCH PERSON SHALL BE FINED $130.00 AND IN
ADDITION THERETO, $2.00 PER 100 POUNDS OF
OVERLOAD, OR IMPRISONED NOT MORE THAN 30 DAYS,
OR BOTH. FOR ALL OVERLOADS IN EXCESS OF
10,000 POUNDS, SUCH PERSON SHALL BE FINED
$160.00, AND IN ADDITION THERETO, $3.00 PER
I 100 POUNDS OF OVERLOAD, OR IMPRISONED NOT MORE
I THAN 30 DAYS, OR BOTH. WHOEVER VIOLATES THE
WEIGHT PROVISIONS OF VEHICLE AND LOAD RELATING
TO GROSS LOAD LIMITS SHALL BE FINED NOT LESS
THAN $100.00. NO PENALTY DESCRIBED IN THIS
SECTION SHALL BE IMPOSED ON ANY VEHICLE
COMBINATION IF THE OVERLOAD ON ANY AXLE DOES
NOT EXCEED 1,000 POUNDS, AND IF THE
IMMEDIATELY PRECEDING OR FOLLOWING AXLE,
EXCEPTING THE FRONT AXLE OF THE VEHICLE
II COMBINATION, IS UNDERLOADED BY THE SAME OR A
GREATER AMOUNT. FOR PURPOSES OF THIS SECTION,
TWO AXLES ON ONE VEHICLE LESS THAN 8 FEET
APART, SHALL BE CONSIDERED AS ONE AXLE.
