AN ORDINANCE TO ACCEPT A QUOTE
FOR THE LIGGETT ROAD BRIDGE REPLACEMENT
WITHOUT FORMAL ADVERTISING AND COMPETITIVE BIDDING
AND DECLARING AN EMERGENCY
,.- WHEREAS, the City Engineer has determined that the Liggett Road Bridge is
in need of replacement; and
~ WHEREAS, the City has further determined that the Liggett Road Bridge is
in such poor repair and condition that it presently presents a threat to
the safety and welfare of Dublin residents; and
WHEREAS, the City Engineer has further determined that any delay in
repairing and/or replacing said bridge will cause a further and more
imminent danger to the safety and welfare of Dublin residents; and
WHEREAS, Northwest Conduit Corporation has recognized almost exclusive
benefit to them of this project and has agreed to donate labor for this
project up to $7,000.00; and
WHEREAS, the estimated cost of the bridge replacement is $42, 019 and
Northwest Conduit's estimate, not including donated labor, is $31,645; and
WHEREAS, the normal bidding process could cause the City to spend an
additional $5,000 to $10,000 for preparing additional engineering contract
documents.
WHEREAS, it is in the best interest of the City to accept Northwest
Conduit's quote as soon as possible so that construction can take place
nthis year; and
WHEREAS, Section 8.02 of Dublin's Charter and Section 735.051 of the Ohio
Revised Code enables the legislative authority of a City to authorize, by
two-thirds vote of its members elected thereto, the City Manager, or other
authorized contracting authority, to enter into a purchasing contract
.,-- without formal bidding and advertising, when a real and present emergency
arises in connection with the operation of any department, division,
commission, bureau, or board of the municipality.

NOW THEREFO~E BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio of the elected members concurring:
I Section 1. That pursuant to Section 735.051 of the Ohio Revised
Code, the quote from Northwest Conduit Corporation for
the Liggett Road Bridge Replacement, in the amount of
$31,645 be, and hereby is accepted.
Section 2. That there be appropriated from the unappropriated
balance in the Capital Improvement Tax Fund the sum of
$35,000 to account 40-03-14-2550 for the Liggett Road
Bridge Replacement.
Section 3. That the City Manager is hereby authorized and directed
to execute a contract with Northwest Conduit Corporation
for completion of said project pursuant to the bid
specifications and documents on file in the office of
the City Engineer.
Section 4. That this Ordinance be, and the same hereby is, declared
to be an emergency measure for the preservation of the
public peace, health or welfare of the residents of this
City, and therefore this Ordinance shall take effect and
be in force immediately upon its passage.

MEMORANDUM
TO: Terry Foegler, Director of Development

SUBJECT: Liggett Road Bridge Replacement

Recently, plans were completed by civil Engineering Associates for
the Liggett Road Bridge replacement. Even though the bridge only
serves two properties, the bridge is in dire need of replacement.
Currently, steel plates have been placed on tope of the deck to
provide access to Northwest Conduit Corporation.
Northwest Conduit has recognized almost exclusive benefit to them
of this project and has offered to donate labor costs up to $7,000.
The project was designed in a manner to take benefit of this offer.
Contract plans and documents for additional engineering work for up
to $5,000 - $10,000 and, additional time of up to three (3) months
would be needed, should we go through the normal bidding process.
It is my recommendation that we accept Northwest Conduit's proposal
and waive-off the bidding requirement so that the work could be
completed this season.
Attached, please find a copy of a proposed draft ordinance for
approval by City council, the quote from Northwest Conduit and the
Engineer's cost estimate.
