AN ORDINANCE
"-" REPEALING THE EXISTING CHAPTER 1191,
CODIFIED ORDINANCES
OF THE DUBLIN PLANNING AND ZONING CODE
AND
PROPOSING A NEW CHAPTER 1191 - ARCHITECTURAL REVIEW
WHEREAS, the Dublin Architectural Review Board is in the process of applying for
Certified Local Government status; and
WHEREAS, this has led to a review of the existing ordinance; and
WHEREAS, the boundaries of the Historic District have been reexamined and
modified; and
WHEREAS, structures with historical importance located outside the Historic District
have also been included for regulation under this chapter; and
",-- WHEREAS, the Dublin Architectural Review Board after careful consideration has
r;: made revisions to the existing chapter; and

WHEREAS, the Dublin Architectural Review Board has reviewed this proposed
chapter and made a recommendation of approval on February 24, 1993; and
WHEREAS, the Old Dublin Association has reviewed this proposed chapter and
recommended approval; and
WHEREAS, the Dublin Planning and Zoning Commission has reviewed this
proposed chapter and made a favorable recommendation on April 8, 1993; and
WHEREAS, it is recognized that the regulation of the Old Dublin area is necessary
to promote the general health, safety and welfare of the residents of Dublin; and
WHEREAS, it is necessary from time to time to amend said code;
NOW THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, l::L of the elected members concurring:

1191.01 ARCHITECTURAL REVIEW DISTRICT BOUNDARIES.
(a) Architectural Review District
The Architectural Review District is defined and limited by the following
boundaries:
(1) East: North of Bridge Street - The west right-of-way of SR 257.
South of Bridge Street - The east high water line of the Scioto
River:
(2) North: Indian Run Stream Bed;
(3) West: The West boundary of the I.O.O.F. Cemtery located on
",..,. West Bridge Street, extended North to the Indian Run; the South
boundary of the I.O.O.F. Cemetery located on West Bridge Street
.... extended East to the rear alley to the West of South High Street;
the rear alley to the West of South High Street, extended
Southward to the intersection of the Cosgray Ditch;
(4) South: The Cosgray Ditch from the Scioto River, West to the
intersection of an imaginary Southward extension of the rear alley

"....... Any individual properties and/or structures within the City of Dublin but
outside the boundaries of the Architectural Review District as specified above. that are
..... located in the Ohio Historical Inventory shall be subject to Architectural Review and
herein established. When an Ohio Historical Inventory property is annexed into the City
of Dublin. it will be subject to Architectural Review and will be added to Appendix G.
A current list of these properties is included in Appendix G.
1191.02 DEFINITIONS.
W "Alteration" means any action to change. modify. reconstruct. remove or
demolish any exterior features of an existing structure or of the premises listed as
historic. For the purpose of this item. ordinary maintenance to correct any deterioration.
decay or damage to a structure or premises and to restore the structure as nearly as
practicable. is excluded from the definition of "alteration." provided such work does not
involve a change in type and/or color of building materials.
flU "Applicant" means any owner. owners. person. persons. association.
partnership or corporation who applies for an ARB Board Order in order to undertake
any change on property subiect to this chapter.
~ "Architectural character" means the architectural style. general design. and
general arrangement of the exterior of a building or other structure including the type of
the light fixtures. signs and other appurtenant fixtures. In the case of an outdoor
advertising sign. "exterior features" means the style. material. color. height. area. and
lighting. and location of the sign.
,... (d) "Board" means the Architectural Review Board (ARB) as created in
Section 1191.04.
..... till "Board Order" means the official document issued by the Architectural
Review Board approving and/or concurring in any application for a permit for the
construction . erection. alteration. removal. moving or demolition of property.
archaeological or historic site. significant feature. sIgn. or landscaping in the
Architectural Review District or individual sites subject to ARB review.
ill "Change" means any alteration. demolition. removal or construction
involving any property subject to the provisions of this chapter including signs.
landscaping. and tree removal. "Change" shall include any new construction. "Change"
shall not relate to ordinary maintenance or repair of any property. provided such work
involves no change in material. design. texture. color. or outer appearance.
!g} "Demolition" means the substantial deterioration or complete or substantial
removal or destruction of any historic structure or any structure which is located within
a historic district or site.
au "Director of Planning and/or designee" means the officer charged with the
administration and enforcement of the Zoning Ordinance of the buildings of Dublin.
ill "District" means the Architectural Review District. The boundaries which
are specified in this Chapter.
ill "Environmental change" means any construction. alteration. demolition or
removal of any property subject to the provisions of this Chapter.
,.... (k) "Exterior architectural characteristics within the Historic District" means
the predominant historic architectural styles within the Old Dublin Historic District. The

There are a number of intermixes of the above, as well as a larger number of buildings
of such modest nature or so extensively remodeled so as to effectively lose all
architectural importance. It is with reference to the basic architectural character of the
key buildings noted above that the need for compatibility in the future construction in the
Historic District should be made. Compatibility does not infer imitation, but rather an
appropriate design in terms of scale, building materials and detail.
ill "Exterior architectural feature" means the architectural style and general
arrangement of the exterior of the structure including the type and texture of building
materials. all windows. doors. lights. signs. and other fixtures ap.purtenant thereto.
!ml "Historic site" means an archaeological or historic site.
!ill "Landmark" means any property or site which has special character.
archaeological. historical. aesthetic or architectural value as part of the heritage.
development or cultural characteristics of the city. state. or the United States designated
as a "landmark" pursuant to the provision of this chapter. and including all property
located in the City of Dublin listed on the National Register of Historic Places.
!Q} "Landscaping" means to modify a site by altering the plant cover or
contour of a site. Landscaping includes the removal of livine trees larger than six inches
in caliper and/or any change in topography on any site within the Review District or in
areas subject to ARB review. Landscaping includes the placement of trees and shrubs
",.. associated with any commercial and/or multi-family project. Landscaping does not
include the planting or arrangement of trees. shrubs. and flowers on single-family
....... properties.
UU "Member" means any member of the Architectural Review Board.
!g} "Owner" shall mean the legal owner of record. and the term shall include
the plural as well as the singular.
W. "Ordinary maintenance" means exterior work which does not involve any
change in material. texture or color. design. or arrangement. Ordinary maintenance also
includes any landscaping not subject to Board review. Examples include repainting a
house with the same color: residing a wood building with wood-siding and painting the
same color.
00 "Preserve" or "preservation" means the process. including maintenance.
treating an existing building to arrest or slow future deterioration. stabilizing the structure
and providing structural safety without changing or adversely affecting the character or
appearance of the structure.
ill "Sign" means any name. number. symbol. identification. description.
display or illustration which is affixed to. painted on. or represented directly or indirectly
upon a building. structure or other device and which directs attention to any obiect.
product. place. activity. person. institution. organization or business. This definition
includes back-lighted plastic panels or strip lighting affixed to any wall or roof where any
such panels or lighting serve to identify a business and attract attention rather than to
".... illuminate space for human activity. All signs located on land within or hereafter
.... annexed to the Municipality and visible from any public right of way or adjacent property
shall comply with this section unless specifically exempted in Section 1189.03. Every
building must display its assigned postal street number clearly.
(u) "Site" means any space or ground within the Historic District, including
ground occupied by buildings. Sites shall include parking areas, service areas,
undeveloped lands and ground adjacent to structures.
(v) "Structure" means a combination of materials to form a construction
including, but not limited to, buildings, outhouses, barns, monuments, wagons, walls or
any object or thing used or maintained above or below the ground, platforms, stagings,
observation towers, radio towers, sheds, fences and display signs. "Structure" shall be

construed as if followed by the words "or part thereof". The distinction between
"structure" and "building" should be noted: "Structure" is the broader term, while
"... "building" is a restricted form of "structure".
..... 1191.03 PURPOSE.
(a) The purpose of the Board shall be to promote the educational, cultural and
economic well being of the community through the preservation and maintenance of the
Review District and historic sites as landmarks and tangible reminders of early
architecture in Dublin; and to prevent the deterioration of the Review District and
historic sites.
(b) The purposes of the Board shall be accomplished through regulation of
construction, alteration, maintenance and demolition within the Review District and
individual sites subject to ARB review; to preserve their architectural features and
characteristics; to make recommendations as to land use within the Review District and
historic sites; to restore and maintain their basic character together with other uses
appropriate to the Review District or a historic site's unique nature; and any legislation
designed to promote these purposes.
1191.04 ARCHITECTURAL REVIEW BOARD.
(a) The Architectural Review Board consisting of five voting members is
hereby established. Membership of the Board shall consist of the following residents of
Dublin selected from the following categories:
(1) A member of the Dublin Historical Society designated by the

...... (2) A property owner who maintains his/her personal residence with
the Historic District as herein defined.
(3) A commercial property owner who owns commercial property
within the Historic District.
(4) An individual who has architectural training or has had extensive
building or building inspection experience.
(5) A merchant who operates a commercial business within the
Historic District.
(6) A member of the Planning Staff shall be a non-voting member and
shall serve as secretary of the Board.
All members shall have a demonstrated interest. knowledge or expertise in historic
preservation. At least two of the five members should be preservation related
professionals to the extent such professionals are available in the community. This shall
include the professions of architecture. architectural history. history. archeology.
landscape architecture. planning or related disciplines.
(b) Terms of office shall be for three years. Each member shall hold office
from the date of his/her appointment until the end of the term for which he/she is
appointed. Any member appointed to fill a vacancy occurring prior to the expiration of
the term for which the predecessor was appointed shall hold office for the remainder of
the term. Any member shall continue in office subsequent to the expiration of his/her
",.,.. term until an appointed successor takes office; or until a period of sixty days has elapsed,
whichever occurs first. All members shall serve without compensation.
..... (c) All present members of the Architectural Review Board shall continue in
such capacity until their respective terms expire or they resign. All vacancies created
by the expiration of the terms of present members terms or by resignations shall be filled
within 60 days in accordance with the requirements of subsection (a) hereof. Except
that, in the event Council is unable to fill vacancies in accordance with the six categories
contained within subsection (a) hereof, Council may fill such vacancies as it may deem

1191.05 ORGANIZATION.
The Board shall at its January meeting elect a chairperson and a vice-chairperson.
",... 1191.06 DUTIES OF THE ARCHITECTURAL REVIEW BOARD.
The Review Board shall have the following duties:
...... .(a) The Board shall function to improve the quality of life in the city by
striving to further and achieve the spirit and pur,pose of this chapter:
@ The Board shall ensure the protection of property values in order to further
the city's goals of sound economic and community development:
W The Board may make recommendations to the Planning Commission and
City Council for additions or revisions to the Planning and Zoning Code or recommend
legislation that would best serve to develop. preserve. restore and beautify the city:
un The Board shall develop guidelines (in accordance with the Secretary of
the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic
Buildings) concerning the conservation of historic areas. buildings. and resources. In so
far as practicable. such guidelines shall suggest what alterations. demolitions.
environmental changes. and new construction may be appropriate for historic structures
or sites within preservation districts:
W The Board shall review and act upon all applications for an ARB Board
Order as required in section 1191. 11 of this chapter:
ill The Board shall conduct. cause to be conducted. or assist in a continuing
survey of all properties. sites. or areas of architectural. archaeological. historic and
aesthetic interest in the City.
!g} The Board members shall work for their continuing education with respect
to historic preservation. The Board shall work for the continuing education of the
"... citizens of the city with respect to the architectural and historic heritage of the City.
@ The Board shall act as a liaison on behalf of the City of Dublin to
...... individuals and organizations concerned with historic preservation.
ill The Board shall keep an inventory of all landmarks and preservation
districts. The inventory shall be updated periodically to reflect changes. alterations. and
demolitions. All inventory materials shall be recorded on Ohio Historic Inventory and/or
Ohio Archaeological Inventory forms and shall be available through duplicates to the
Ohio Historic Preservation Office. This inventory shall be made available to the public
upon request.
ill The Board shall review all proposed National Register nominations for
properties within its jurisdiction. When expertise not represented on the Board (e.g.
archaeologist) is necessary for review of a proposed nomination. the Board shall seek
such expert advice before rendering a decision. That expertise may be academic or
consulting in nature.
00 The Board shall provide a written annual report which shall address at a
minimum the Board's activities. cases. decisions. special projects and qualifications of
the members. The annual report shall be kept on file and available for public inspection.
1191.07 DESIGNATION OF LANDMARKS AND PRESERVATION
DISTRICTS.
.(a) In considering the designation of any area. place. site. building. structure.
[ work of art or similar object in the City of Dublin as a landmark or preservation district.
the Architectural Review Board shall anply the following criteria with respect to such
property:

1191.08 PROCEDURE FOR ESTABLISHING FUTURE PRESERVATION
DISTRICTS AND LANDMARKS
cO When a proposal to establish a preservation district or to designate an
individual property or site as a landmark for protection is received by or initiated by the
Review Board. the owner or owners shall be notified by the Review Board with
assistance from Planning Staff and the owner(s) written comments requested. In the
event the owner(s) refuses or declines to give his/her written consent to the proposed
designation. or in the case of proposed district designation. the Board shall schedule a
public hearing on the question of the proposed designation setting forth a date. time. and
".. place. and providing written notice to the owner(s) or any person having a legal or
... equitable interest in the proposed designation. The Board shall cause a legal notice to
be published in a newspaper of general circulation in the City setting forth the nature of
the hearing. the property involved and the date. time. and place of the scheduled public
hearing.
b) The Review Board shall consider the proposal in terms of the criteria provided
in Section 1191.07 above and make a recommendation to the Planning and Zoning
Commission.
c) The Planning and Zoning Commission shall review the proposal and the
recommendation of the Review Board in terms of the critical provisions in Section
1191.07 of the effect of the designated area on the surrounding areas and the projected
development of the community. and shall make a recommendation to the City Council
concerning the proposed designation.
d) The City Council shall give due consideration to the findings and
recommendations of the Review Board and the Planning and Zoning Commission in
making its determination with respect to the proposed designation of an area. property
or site as a landmark or preservation district.
e) After a decision by City Council. the Review Board shall notify any owner
or any person having a legal or equitable interest in said property of the decision by
Council. All affected City departments. boards. and commissions shall be notified.

,. 1191.09 BUILDING PERMITS, CERTIFICATES OF ZONING

..... COMPLIANCE.
(a) No Building Permit or Certificate of Zoning Compliance shall be issued by
either the Chief Building Official or the Planning Director and/or designee for any
construction. reconstruction. alteration or demolition of any structure now or hereafter
in the Architectural Review District or in areas subject to the Architectural Review
process. unless a Board Order has been issued by the Board.

1191.10 CERTIFICATE OF NON-APPLICABILITY.
Except in cases excluded by Section 1191.16, every person who applies for a building
,.... permit to construct any structure in the Architectural Review District. or area subject to
Architectural Review Board review. or to alter, change the exterior color of, or demolish
...... any structure now or hereafter in such Architectural Review District, or area subject to
Architectural Review Board review, shall file with the Secretary of the Board his/her
application for such building permit together with all plans and specifications for the
work involved. Within thirty days, the Board shall consider such applications, plans and
specifications and determine whether any exterior architectural feature is involved. If
the Board determines that no exterior architectural feature is involved, it shall cause its
Secretary to endorse on the building permit application, certification of such
determination and return the application, plans and specifications to the applicant.

1191.11 BOARD ORDER REOUIRED.
(a) No person shall construct, modify, alter or change any site in the Review
District or area subject to Architectural Review, including landscaping thereon, until such
person shall have filed with the Secretary of the Board an application for an ARB Board
Order in such form and with such plans, specifications and other material as the Board
may prescribe and a Board Order shall have been issued as hereinafter provided in this
Section.
au An ARB Board Order shall be valid for a period not to exceed one year
from the date of final approval by the Architectural Review Board.
",. 1191.12 PROCEDURE FOR BOARD ORDER.
...... (a) The application for a Board Order shall be made on such forms as
prescribed by the Planning Division. along with such plans. drawings. specifications and
other materials as may be needed by the Board to make a determination.
au Applications for a Board Order shall be filed with the Secretary to the
Board at least fifteen (15) days prior to the meeting of the Architectural Review Board.
The Board will hold a regular monthly meeting unless there is no business to come
before the Board. Special meetings of the Architectural Review Board may be called at
any time by the Chair. At least forty-eight (48) hours written notice of the time and
place shall be given. by the Secretary or by the Chair. to each member of the Board.
W The Board shall determine whether the proposed change will be
appropriate to the preservation of the historic. architectural or environmental. character
of the Architectural Review District. or of the historic property pursuant to the criteria
specified in Sections 1191.12. 1191.16. and 1191.17.
@ In conducting its inquiry and review. the Board may request from the
ap.plicant such additional information. sketches and data as it shall reasonably require.
The Board may conduct a public hearing on the proposed action and/or solicit input from
experts. specialists. or consultants to the City. The Board may recommend to the
ap.plicant changes in the plans that it considers desirable and may accept a voluntary
amendment to the application to include or reflect such changes. The Board shall keep
a record of its proceedings and shall append to the application copies of information.

W When its review is concluded. the Board will determine by a vote of its
..... members. whether the application for an ARB Board Order shall be ap'proved. If
approved by a simple maiority the Board shall return the application and anpended
material to the Secretary with the instruction that the Board Order be issued. If denied.
the Board shall return the application and appended material. with the reasons for denial.
to the applicant with a notice that the Board Order shall not be issued.
ill If the proposed action involves one of the following. a two-step ap'plication
process is required:
ill New construction of 3 .500 square feet or more of gross floor area.

increase the total gross floor area of the structure to 3.500 square
feet or more.
,-. ill Moving. removing. or replacing the major exterior architectural
... elements of a building or structure having 3.500 square feet or
more. In such cases. a pre-application shall be submitted at least
fifteen (15) days prior to the meeting of the Architectural Review
Board. explaining the basic concept of the proposed environmental
change. After apj>roval. or ap"proval with modification. of the pre-
application. the applicant may follow the procedure for obtaining
a Board Order as specified in 1191. 11 (a) through (0 above.
1191.13 DOCUMENTARY EVIDENCE FOR BOARD
(a) For any application relating to property in an area covered by Chapter 1191.
the applicant bears the burden of demonstrating economic hardship or unusual and
compelling circumstances. The applicant is encouraged to seek assistance from the Staff
of the Planning Division in meeting this burden. It is the intention of this section that
the level of documentation required of an applicant may vary as is apj>ropriate to each
case.
(b) For any application relating to property in an area covered by Chapter 1191.
the applicant bears the burden of providing documentary evidence to show any substantial
economic hardship or unusual and compelling circumstances either with the original
application at the time of filing or separately thereafter. It is advisable for the applicant
to provide as much documentation as possible. Applicants are encouraged to meet with

... following as a standard for determining the documentation necessary.
ill In addition to the materials required by Sections 1191.12 and
1191.14. an applicant who desires to present a case for substantial
economic hardship shall provide the following information to the
extent it is available or appropriate:
A. The amount paid for and date of purchase of the property
if purchased within two (2) years prior to the ap"plication:
copies of the two most recent appraisals of the property:
real estate tax bills or receipts for the two (2) years
immediately preceding the application: any listings of the
property for sale or rent: any written offers to purchase or
rent the property: any consideration of the applicant for
adapting the property to a new use: and a detailed cost
comparison of the work proposed by ap,plicant and any
alternative consistent with architectural standards and
guidelines for the property.
B. For all income-producing property: annual gross income
from and itemized operating expenses for the property for
the past two (2) years: and evidence that the owner or
applicant has made a reasonable effort to obtain an

C. For showing substantial reduction in the value of the

differential in initial and annual costs between ap.plicant's

B. For showing that no other reasonable means exist for
saving the property: copy of condemnation or housing
order based on deteriorated condition of property: a
structural analysis by a licensed architect. engineer or
contractor experienced in alterations to historic properties
as to the structural soundness of the property or
architectural feature accompanied by the individual's or
firm's qualifications for making such analysis:
documentation that property has been offered for sale.
C. For showing that the property cannot be reasonably
maintained in the manner desired by the Board: a report
by a licensed architect. engineer or contractor experienced
in alterations to historic properties that the unusual design.
materials. texture or details prohibit the reasonable
r- maintenance of the property or exterior architectural feature

the individual's or firm's qualifications for making such a

D. In addition to materials in (1) and (2). for showing that a
non-profit organization cannot financially or physically
achieve its purpose: a copy of its charter and bylaws or
mission statement: an explanation of how the applicant's
proposed construction. alteration or demolition is essential
to the charitable purposes of the organization and how the
Board's recommendation conflicts therewith: an estimated
differential in costs between applicant's proposal and
consistency with the architectural standards and guidelines
for the property (actual bids are preferred) : and
documentation of the organization's tax-exempt status.
1191.14 CRITERIA TO DETERMINE SUBSTANTIAL ECONOMIC
HARDSHIP.
The following criteria shall be used for all applicant's to determine the existence of a
substantial economic hardship:

Additionally. for the nonprofit-organization applicant. it is infeasible to financially or
physically achieve its charitable pur:poses while conforming to the pertinent architectural
standards and guidelines.
1191.16 CRITERIA FOR EVALUATION OF APPLICATION FOR ARB
BOARD ORDER
In considering the appropriateness of any proposed environmental change. including
landscaping or exterior signage. the Architectural Review Board shall consider the
following:
!al Every reasonable effort shall be made to provide a compatible use for a
property which requires minimal alteration of the building. structure or site and its
environment. or to use a property for its originally intended pur:pose.
Cll The distinguishing original qualities or character of a period building.
structure. site and/or its environment shall not be destroyed. The removal or alteration
of any historic material or distinctive architectural or environmental features should be
r- avoided when possible.
..... ~ All buildings. structures and sites shall be recognized as products of their
own time. Alterations that have no historical basis and which seek to create an earlier
appearance inconsistent or inappropriate to the original integrity of the building shall be
discouraged.
@ Whereas changes which may have taken place in the course of time are
evidence of the history and development of a building. structure or site and its
environment. if these changes are deemed to have acquired significance. then this
significance shall be recognized and respected.
till Distinctive stylistic features or examples of skilled craftsmanship which
characterize a building. structure or site shall be treated with sensitivity.
ill Significant architectural features which have deteriorated shall be repaired
rather than replaced. wherever possible. In the event replacement is necessary. the new
material should match the material being replaced in composition. design. color. texture
and other visual qualities whenever possible. Repair or replacement of architectural
features should be based on accurate duplication of the feature. and if possible.
substantiated by historic. physical or pictorial evidence rather than on conjectural designs
or the availability of different architectural elements from other buildings or structures.
{g} The surface cleaning of structures shall be undertaken with methods
designed to minimize damage to historic building materials. Sandblasting and other
cleaning methods that will damage the historic building materials should be avoided.

in such a manner that if such additions or alterations were to be removed in the future.

priority over other designs.

-- .w It shall be recognized that each individual precinct within the Architectural
Review District or individual sites subject to Board review has its own specific
environmental and historic character. The design of new structures. or alteration of
existing structures shall be responsible to the character of the specific precinct.
.au Existing Structures and Premises. Reconstruction or rehabilitation within
the Architectural Review District shall conform to the distinguishing. original exterior
qualities or character of the structure. its site. and its environment.
W New Construction. The design of new structures and of additions to
existing structures. including new site improvements. shall take into account the
architectural style. general design. arrangement. texture. material and color of other
structures and premises within the individual precinct.
@ Materials.
ill All new structures and all reconstruction or remodeling of existing
structures within the Architectural Review District shall utilize
natural traditional exterior materials such as brick. stone. masonry
and wood.
ill The use of contemporary materials. such as aluminum. other
metals. fiberglass and plastics for exterior surfaces on
architecturally significant structures shall be prohibited unless the
..... use of such materials would contribute to preservation or
enhancement of existing traditional materials and the overall
..... integrity and longevity of a structure.
W Color. Traditional colors and combinations of those colors that are both
identified with the origin or the era in which the structure or property was originally
built. and approved by the Architectural Review Board. shall be used for exteriors for
all new structures to be built. and reconstruction. remodeling and exterior maintenance
of existing structures within the Architectural Review District. Fluorescent or
luminescent colors are prohibited.
ill Landscaping. The landscape design of the site should be consistent with
the overall architectural and historic character of the structures on the site. Non-plant
material shall be of a type associated with the origin or era in which the structure was
originally built. Significant features of the original landscape. e.g. stone walls. shall be
preserved.
1191.18 SIGNS.
W Signs shall conform to the materials and color requirements of Section
1191. 17(d) and (e). and shall be of such a style or design that reflects the era during
which the structure was originally built. Signage shall convey its message in a simple.
direct manner. and shall not advertise ancillary services or rates. The size. shape and
.... location of the sign shall respond to the architectural proportion of the building and shall
not be permitted to cover or otherwise hide or obscure existing windows. doorway
-- openings or significant architectural features. Internal illumination of signs is prohibited.
Special consideration shall be given to signs which have appropriate historical references
to either the building to which it is attached or the nature of the business it represents.
1191.19 FAILURE TO MAINTAIN
No person. being the owner of a structure within the Architectural Review
District or a structure listed on the Ohio Historic Inventory. shall by willful neglect. fail
to provide sufficient and reasonable care. maintenance and upkeep appropriate to ensure
such building's perpetuation and to prevent its destruction by deterioration. This

provision shall be in addition to all other applicable code provisions. By resolution the
Architectural Review Board shall present evidence of a violation hereof to the Planning
Director or designee who shall initiate appropriate action thereon.
"... 1191.20 DEMOLITION.
..... .uu In cases where an applicant applies for a Board Order to demolish a
structure within the Architectural Review District. the Architectural Review Board may
grant the demolition and issue a Board Order when at least two of the following
conditions prevail:
ill The structure contains no features of architectural and historic
significance to the character of the individual precinct within which
it is located.
ill There exists no reasonable economic use for the structure as it
exists or as it might be restored. and that there exists no feasible
and prudent alternative to demolition.
ill Deterioration has progressed to the point where it is not
economically feasible to restore the structure.
.au If the Board disapproves an application for an ARB Board Order involving
a demolition or removal of an historically and architecturally significant structure within
the District. the Board shall have the power to impose a waiting period not to exceed one
year. During such period. the Architectural Review Board and the applicant shall make
every reasonable effort to find a demolition alternative for that structure. During the
waiting period the owner of such structure shall maintain and preserve the structure to
prevent further deterioration. If the Board and the aRplicant do not agree on a means of
preserving the structure within the specified waiting period. the disapproval shall become
,.. the final Board Order subject to appeal under the provisions of Section 1191.22.
Q). If the subject property is sold or transferred during the year waiting
....... period. the new owner shall re-apply for the Board Order to demolish the structure.
1191.21 ORDINARY MAINTENANCE.
Nothing in this chapter shall be construed to prevent any ordinary maintenance
or repair of an exterior architectural feature or site now or hereafter located within the
Architectural Review District which involves no change in material, design, arrangement,
texture or color; nor shall anything in this chapter be construed to prevent the
construction, reconstruction, alteration, modification, or demolition of any feature which
the Building Inspector shall certify, pursuant to appropriate provisions of the Codified
Ordinances or State law regarding public safety, as being an unsafe or dangerous
condition. (Ord. 20-85. Passed 5-13-85.)
1191.22 APPEALS.
(a) Any applicant aggrieved by a decision of the Board may appeal the
decision to the Board of Zoning Appeals. Such appeal shall be taken by the filing of a
written statement setting forth the grounds for the appeal with the Chairman of the Board
of Zoning Appeals within twenty days of the decision of the Board. The Board of
Zoning Appeals shall affirm the decision of the Board unless it finds that the decision is
contrary to law. In the event that the Board of Zoning Appeals does not affirm the
",... decision of the Board, it may reverse, remand or modify such decision of the Board and
shall state the reasons therefor in the minutes of its meeting and shall forward a copy of
-.... such minutes to the Board.
(b) Any party to the decision of the Board of Zoning Appeals may appeal the
decision of the Board of Zoning Appeals. Such appeal shall be taken by the filing of a
written statement setting forth the grounds for the appeal with the Clerk of Council
within thirty days of the decision of the Board of Zoning Appeals. Council shall affirm
the decision of the Board of Zoning Appeals unless it finds that the decision is contrary
to law. In the event that Council does not affirm the decision of the Board of Zoning
Appeals, it may reverse, remand, or modify such decision and shall state the reasons

1191.23 SEVERABILITY.
The provisions of this chapter shall be deemed to be severable, and, if any of its
,... provisions shall be held unconstitutional by any court of competent jurisdiction, the
decision of any such court shall not impair any of the remaining provisions. (Ord. 20-

1191.24 PENALTIES.
Whoever constructs, reconstructs, alters, modifies or demolishes any exterior
architectural feature, site, sign now or hereafter in the Historic District in violation of
this chapter shall be deemed to be guilty of a minor misdemeanor as set forth in Section
501.99. Each day that any person or entity continues to violate any of the provisions of
this chapter shall constitute a separate and complete offense. (Ord.20-85. Passed 5-13-
85.)
Section 3. That this Ordinance shall take effect and be in force from and after the
earliest period allowed by law.

Existing Boundaries
Ordinance 20-85, which established the current District boundaries, was approved by City
Council on May 13, 1985. A public hearing was held on May 6, 1985. There were no
registered opponents.
Proposed Boundaries
On August 25, 1993, the Architectural Review Board voted to amend Ordinance 25-93. The
Board voted unanimously to maintain the existing boundaries of the Historic District, adding
only the east bank of the Scioto River, and adding the Ohio Historical Inventory Properties.
Section 1191.01(a) of the Ordinance has been revised to reflect this change in the boundaries.
Additional properties on Franklin Street are not included.

circle, twenty feet wide, directly faces the Southwest corner of the

carried out by H.C. Shetrone, CUrator of Archaeology of the Ohio I
Historical Society, in 1922, with certain positive results (S'netrone i
1925) . Excavation of the circular enclosure at the eastern end of
the group, '-Thien rer..ained cO:7?lete and v!el1-r..arked in 1922, yielciec
no trace of an interior mO~ld, burials or other features. The naj or
mou.'1d Hi thin the rectangular enclosure, by then recuced to an oval
rewnant 20 by 28 feet at the base and 34 inches high, and stripped
of r.1uch of its outer coverir~ of li:::estone slabs, ~as co~letely
excavated by Shetrone. He reported that a level but little-used
floor thinly coverec by charred material, but devoid of features
and postmolds of a "pre-existing structure, had initially been covered
with a lo~ mound of clean cl~yey l~rn, 15 inches in maxi~~~ depth.

.. grave near the center. of the mound hud yielded a ~rine-shell bOr:1 arc
eight bladelets of Flint Ridge flint, diagnestic Hopel:ell traits; a
_!..'~ second, stone-covered cre~tion with no associated artifacts, lay four
feet Southeast of the mound's center. One of the disturbed inh~~ations,
just South of center beneath the nou.'id, 'Ias acco==?anied b'j' a pair of
oiiiiIiii< copper ears;pools, and the other, NorthHest of center, by a plain Hope-
well platfor.m pipe and a slate gorget. Shetrone's excavations revealed
the remains of a fifth, unreported disturbed burial, consisting of a
flexed inh~~tion placed atop limestone slabs just North of center of
the mound.
Excavations carried out in 1961 by a joint Chio Eistorical Society-
Ohio State University field schoel under the direction of Dr. Ra}TIond
S.Baby revised certain earlier conclusions, established the surface
and subsurface contours of the rectangular ba~-and-ditch, and soug;,t
new cla~ses of eata. It was deter.mined that a second mound reported
by Thomas to lie Hi thin the rectuTgular enclosure probably never
existed and tho.t the "clean loam" prir:1Ciry core of the other I:lound l:as
actually mixed earth containing midden residues. Trenching outside
the enclcsures failed to yield "village" or r.~cden deposits, which
suggc:sts that the ir:t:1eCit:4te vicinity of the earth.......orks was not oc-
cupied year-round or over a long period of time. Lxamination of the
