ORDINANCE AUTHORIZING THE CITY MANAGER TO CONTRACT WITH THE BUREAU OF WORKER'S COMPENSA TION UNDER AGREEMENT U-69. WHEREAS, the courts have ruled that Volunteers, while performing services for a municipality, are entitled to Worker's Compensation benefits; and WHEREAS, claims made by these individuals would be charged as any other injured employees; and WHEREAS, separate coverage can be obtained from the Bureau of Worker's Compensation so as to not have any bearing on the City's merit rated experience; so NOW, THEREFORE BE IT ORDAINED by the Council of the City of "... The City Manager is authorized to enter into contract with the Industrial Commission of Ohio, the Bureau of Worker's Compensation, for the provision of Worker's Compensation coverage for volunteers under agreement U-69. McDaniel, Management Assistant .- SUBJECT: Agreement U-69, Ohio Bureau of Worker's ~tion DATE: July 9, 1991 Attached you will find Ordinance 50-91 authorizing you to enter into a U-69 Agreement with Ohio Bureau of Worker's Compensation. You may recall two years ago when Council in fact passed a similar Ordinance for both a U-69 and U-133 Agreements respectively. These contracts extended Worker's Compensation coverage to time service workers made available via Mayor's Court (U-69) and for Auxiliary Police (U-133). The Division of Parks & Recreation is beginning to receive more and more volunteer services from the general public and various service organizations. These volunteers are providing general labor at no charge for such activities as park 'clean-up and other beautification projects. While these individuals would have been entitled to coverage in the past, we are now receiving the levels of volunteer hours that warrant contract placement. Specifically, Sarah Andres estimates nearly 350 planned volunteer man-hours donated this summer. Other future projects from various City Division or disastrous incidents will also warrant having this contract in place. ~'>"'d" '. The City's return of man-hours donated versus the rate for U-69 coverage is cost effective. As an example, $1,500 worth of labor (using minimum wage rates) would require only $50 in premium coverage. While the U-69 Agreement will be on file with the Ohio Bureau of Worker's compensation, the City will only incur costs for coverage after the work is completed, hence, only covering those who actually work. Further liability exposures regarding volunteers are covered by the City's general liability coverages. The actual contract will be executed by you, pending passage of this Ordinance. I will report all names and volunteer hours donated on a monthly basis as is now the practice with the current U-69 and U-133 Agreements.
