NOW THEREFOR~ BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, /J of the elected members concurring: Section 1. That the following described real estate (see attached map marked Exhibit "A"), situated in the City of Dublin, State of Ohio, is hereby rezoned to PIP, Planned Industrial Park District and shall be subject to regulations and procedures contained in Ordinance No. 21-70 (Chapter Eleven of the Codified Ordinances), the City of Dublin Zoning Code and amendments thereto. S. Route 33/161 and Avery Road, respectfully submit this application to amend the Planned Industrial Park zoning approved by Dublin City Council on October 1, 1990 under Ordinance 84-90 (Amended). Background. The subject property containing 11.728 acres was originally in the General Industrial District. In 1989, a 1.7 acre parcel of the property was zoned PUD so that diverse uses including a gymnastics school and office/warehouse could be properly controlled by the City of Dublin. In 1990, the entire parcel of 11.128 acres was rezoned Planned Industrial Park. This accommodated a lot split and some use and sign approvals for the owners and also brought the larger area under specific control of the City of Dublin. Unfortunately, at the time of the PIP zoning, the applicant did not envision the loss of the gymnastics school as a tenant in one of the buildings and therefore, in the PIP zoning narrative, described the use of "Building A" as a gymnastics school. The applicant is now facing the need to obtain zoning compliance approvals for up to three users anticipated for the former gymnastics building. Although the applicant has identified one prospective user, Dublin Express Printing, the applicant would like to amend the PIP zoning text to include a wider range of uses that might occupy a building of this design in this location. 1 ~ ""-~""" -- >. . - .' --, ~~-,."~..~. ~ . . Development Plan. The attached drawings show the current development of the 11.728 acre tract, lot sizes within the tract, current and planned building locations and current landscaping of the tract. The uses of Building B, StorageStar, and proposed Building C are described in the Development Plan submitted on July 31, 1990. The changes requested in the July 31, ......P 1990 Development Plan have been made and the Applicant has consulted with the appropriate City staff as requested in that zoning approval. Water, sanitary sewer and surface drainage facilities are in existence and performing properly. These are indicated on the site plot plan attached. Traffic circulation occurs on a private concrete road as shown on the attached plans. The concrete batch plant has been in operation for more than two years. Concrete truck traffic has not interfered with traffic using the other facilities in the site and has not adversely affected the neighbors. Current plans call for commencement of construction of phase 2 of the StorageStar facility in 1992. It is expected that Building C will be constructed in 1992. This will complete the development of the Planned Industrial Park. The subject site is located in a general industrial area south of U. S. Route 33/161. Darby Sales, a retail establishment is located immediately north on Old Avery Road from Building B and directly east of StorageStar. To the south is Warner Construction and Geupel Construction. At some time in the future, the facilities will access the City of Dublin water and sewer lines which are nearby. The 11.728 acre site is owned by Anderson Concrete Corp. and Avery Road Investments, Inc. co-sponsors of this application. Since ownership is restricted to these two parties, there is sufficient control to satisfy Subdivision Regulations regarding control of facilities required for subdivision development. Support for the Request for Amendment of the Planned Industrial Park. Under the previous zoning action, approval was granted for office, showroom, warehouse and distribution uses for Building B and proposed Building C. _. This request is to permit uses for Buildings A, Band C to be the uses specifically described in the Restricted Industrial District. These uses are similar to those granted in previous pun and PIP zoning approvals for the same buildings and are consistent with other uses in the immediate area. The Applicant also is requesting that limited retail activity be an approved use for Buildings A, B, and C. Rezoning Application Z91-014 - Avery Road Industrial Park ~,'* Ms. Clarke presented the staff report and showed slides of the site, She said there ~ are several; buildings in place and another available building site and additional personal storage buildings will be added farther to the west. The site is currently zoned PIP, Planned Industrial Park. The proposal here is to broaden the uses permitted within the site. The largest change here is the elimination of the gymnastics training facility, It was the only use permitted within that building, and there were yery restricted uses permissible on the rest of the site in order to be compatible with a children's use, With the gymnastics center and the children gone, Mr, Weil would like to amend the text to permit all of the RI, Restricted Industrial uses on the site, which include the limited commercial facilities that are .." permissible under the PIP, Ms, Clarke said this is not a site which is served by the public sewer. Staff recommends approval subject to the following condition: -, That any future commercial uses shall be subject to review and approval by staff regarding adequacy of the on-site systems and parking. Amorose said that he would like to see the ground do%ed and the mound cut properly and seeded and grassed since it is at the gateway to the community, and that turf grass be planted and the mound be mowed on a regular basis. Hrs. King suggested with regard to the U-lIaul trucks be screened properly and moved to the back of the property. Responding to'a question from Mayor Rozanski, Hr. Weil said that the Dublin City Staff had monitored the parking, traffic, etc. during competitive meets at the Universal Gymnasts facility several times and that there appeared to be no problems. Hr. W~il noted thae the primary purpose of this particular %oning activity is to allow them to split the lots; that all of the uses that are going on in the area at the present time are approved uses; that he is not happy with the mound and said he was ready to change the ground cover, but that he disagreed with Hr. (Approved 5-2). +5. Rezoning Application Z90-006 - Avery Road Investment Ms. Clarke presented the Staff Report and slides of the site. This application involves 11.728 acres located on the west side of Old Avery - Road south of u.s. 33/S .R. 161. The property has been developed with two office-warehouse buildings (zoned PUD, Planned Unit Development District), a self-storage facility (Storage Star) and a small sewage treatment facility - (zoned GI, General Industrial). The remainder of the site includes the Anderson Concrete Corporation's batch plant, zoned GI. Immediately north of the site is Darby Sales, a retail establishment. To the west is property located within Washington Township zoned LI, which is currently in the annexation process to Dublin, and south of the site are other construction uses zoned GI. The request is to rezone the property from GI and PUD to PIP, Planned Industrial Park District. An informal review of this application was heard by the Planning and Zoning Commission at the August 9, 1990 meeting. This ...... rezoning will provide for lot splits for the self-storage facility (Storage Star) and the sewage treatment facility. This is not currently possible - because the resulting parcels do not have 100 feet of frontage on a public road. Other changes on the site with the rezoning include the development of an office-warehouse facility on the sewage treatment facility site, the addition of a small U-Haul truck and trailer rental business, and the request to allow Universal Gymnasts to hold additional competitive meets. There is a 32-foot concrete drive which provides access from Old Avery Road to the Anderson Concrete site. ..... The applicant had met with Staff to address the deficiencies listed in the Staff Report, and Staff is satisfied that the application is complete. Mr. Geese asked Ms. Clarke if there was a need for additional comments since it appears that everything has been submitted. Ms. Clarke said no. There were no comments from the Commission. Mr. Geese asked Mr. Weil if he had any additional comments. Mr. Weil said he met earlier in the week with Steve Mack regarding some engineering concerns. Mr. Weil said the drainage plan for the undeveloped site will be submitted prior to developing that site. He also said that the rezoning should not affect the operation of the concrete batch plant either as it currently exists or as it may be expanded in the future. He also said that the parameters that currently exist under the General Industrial zoning be applied to any expansion or modification of the concrete batch plant under the new PIP plan. Mr. Campbell asked Mr. Banchefsky if this can be done in the future. Mr. Banchefsky said yes. Ms. Clarke suggested to .... The back part of the site, which is still available for development will not likely be needed for freeway improvements. The preliminary engineering for this area is in process. Mr. Leffler asked if the text for PIP was received. Conditional Use Application CU90-007 - Northwest Conduit Corporation Lisa Fierce presented the Staff Report and slides of the site. - The subject site is about 2 acres and is located on the west side of Liggett >~ Road, abutting u.S. Route 33. It contains a f 7700 square foot building which is currently vacant. To the north of the site is undeveloped property, and across Liggett Road, are the Remarks Food Marketers site and a single-family residence and farm. To the south is vacant property owned by the City of Dublin (about one acre) at the terminus of Liggett Road. Across U.S. Route 33 is the Nestle Nanolab currently under construction which fronts on Eiterman Road. The site and all surrounding property (except to the east) is zoned RI, Restricted Industrial District. The applicant is requesting a Conditional Use for general offices and machine repair shop for an underground construction contractor. This type of use is permitted within the LI, Limited Industrial District and is considered a service industry. All permitted uses within the LI district may be permitted conditionally in the RI district. The building will also be used by a company which distributes and installs solar film for cars, which is a permitted use. - The applicant will landscape along the west property line which will screen the site from U.S. Route 33.
