AN ORDINANCE AUTHORIZING THE CITY LAW DIRECTOR
AND MANAGER TO SETTLE FRANKLIN COUNTY COMMON
PLEAS COURT CASE NO. 90CVH06-4444 AND I

r- APPROPRIATING FUNDS RELATIVE THERETO IN ORDER TO I
COMPLETE ACQUISITION OF PROPERTY FOR THE BLAZER
'-' MEMORIAL PARKWAY EXTENSION, AND DECLARING AN
EMERGENCY.
WHEREAS, Council has previously passed Resolution 31-89 and
Ordinance No. 35-90, appropriating fee simple interest in
a six acre parcel of property located at 5235 Rings Road,
for the extension of Blazer Memorial Parkway; and
WHEREAS, pursuant thereto, the City initiated appropriation
litigation in the Franklin County Common Pleas Court in
Case No. 90CVH06-4444; and
WHEREAS, the Law Director has negotiated a settlement with
the property owners which he has recommended to Council so
as to avoid the risk of litigation; and
WHEREAS, Council has approved the recommended settlement;
and
WHEREAS, it is necessary to amend the annual appropriation
ordinance for the purpose of appropriating funds to settle
the aforementioned litigation and complete the
aforementioned appropriation.

NOW, THEREFORE, BE IT ORDAINED by the Council of the city
"-' of Dublin, state of Ohio, j1 of the elected members
concurring that:
section 1. In order to avoid the risk of litigation, the
Law Director is hereby authorized to settle the case of the
city of Dublin. an Ohio Municipal Corporation vs. Walter A.
Ramev. et al.. Franklin County Common Pleas Court Case No.
90CVH06-4444 pursuant to the Settlement Entry attached
hereto.
section 2. An additional appropriation of $455,000.00 is
hereby made to the New Street Construction and Engineerinq
Account No. 40-03-14-2551, in order to effectuate the terms
and provisions of the aforementioned Entry of Settlement.
section 3. Due to the fact that time is of the essence as
to finalizing this litigation, between the parties, and due
to the fact that the Court has imposed settlement deadlines
on the parties, this Ordinance is hereby declared to be an
emergency measure necessary for the preservation of the
public peace, health and safety and therefore, this
Ordinance shall take effect and be enforced immediately
r- upon its passage.
