AN ORDINANCE AUTHORIZING
THE PURCHASE OF SERVICES
TO REPAIR EXISTING SANITARY
r SEWER LINES WITHOUT FORMAL
t ADVERTISING AND COMPETITIVE
""" BIDDING, AND DECLARING
AN EMERGENCY
WHEREAS, it is the desire and objective of the City of Dublin to identify and resolve the
I existing sanitary sewer infiltration/inflow problem as expeditiously as possible; and

I WHEREAS, the Director's Final Findings and Orders issued by the Ohio EPA on July 22,
I 1991, require that Dublin demonstrate the removal of three gallons of infiltration and inflow
II from the sewerage system for every one gallon of wastewater from a new source connected
il to the system; and

1\ WHEREAS, Dublin has until July 1, 1992, to demonstrate that sufficient sources of inflow
I, and infiltration have been eliminated or sufficient capacity is available so that no overflow will
1\1, occur from a 10 year, 24 hour storm, for the Director of the Ohio EPA to consider releasing
i Dublin from the requirement to construct a sewage detention basin to collect peak sewage
i flows; and
WHEREAS, inspection of existing sewer lines using sewer video inspection equipment
continues to locate broken pipe sections, sags in the pipe causing leaks, or illegal infiltration
,-.. in the system; and
'_ \ WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or
'1\ resolution adopted by a vote of at lease two-thirds of its members, to authorize, without
, advertising and competitive bidding, contracts or expenditures for any purpose where the
II statutory or common Jaw of Obio does not require competitive bidding; and,
1\ WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of
II a city to authorize, by a two-thirds vote of its members elected thereto, the City Manager, or
1'[ other duly authorized contracting authority, to enter into a purchasing contract without formal
I bidding and advertising, when a real and present emergency arises in connection with the
II operation of any department, division, commission, bureau, or board of the municipality; and,
I WHEREAS, Council believes that a real and present emergency exists within the City of
I Dublin;

I NOW, TIjEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
I Ohio,..5 of the elected members concurring;

II Section 1: That, pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of the
II Ohio Revised Code, the purchase of services to repair existing sanitary sewer lines, without
r- II formal advertising and competitive bidding, in the amount of $250,000 is hereby authorized
I Ii from the funds appropriated in the Sanitary Sewer Fund, account 61-06-14-2430, for sewer
'-- 'I rehabilitation.
Section 2: That this ordinance be, and hereby is, declared to be an emergency measure
, necessary for the preservation of the public health, safety, and welfare and, therefore, this
II Ordinance shall take effect and be in force immediately upon its passage.
