l.-J AND DECLARING AN EMERGENCY i
WHEREAS, it is the desire and objective of the City of Dublin to continue to identify
and remove excess storm water inflow and infiltration into the sanitary sewer system as
expeditiously as possible; and,
WHEREAS, it has been determined that flow monitoring within the sanitary sewerage
system has been a very effective tool in isolating problem areas within Dublin's sanitary
sewer collection system; and,
WHEREAS, it is the desire of Council to purchase additional flow monitors to continue
to closely monitor the flow characteristics of our collection system through its ongoing
and continuous flow monitoring program; and,
WHEREAS, the Ohio Environmental Protection Agency has issued Findings and Orders
dated July 22, 1991, which require the City of Dublin to increase the number of
moveable flow monitors within its sewerage system from 12 to 20 in an effort to better
identify inflow and infiltration problem areas and has ordered the City of Dublin to
identify and remove excess storm water from the sanitary sewer system; and,

r WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority
....... of a city to authorize, by two-thirds vote of its members elected thereto, the City
Manager, or other duly authorized contracting authority, to enter into a purchasing
contract without formal bidding and advertising, when a real and present emergency
arises in connection with the operation of any department, division, commission, bureau,
or board of the municipality; and,
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, ~ of the elected members concurring:
Section 1. That pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of
the Ohio Revised Code, the purchase of flow monitoring devises to monitor sewage flows
within the City's collection system without formal advertising and competitive bidding
in the amount of $60,000 is hereby authorized in the Capital Improvement Tax Fund.
Section 2. That there be appropriated from the unappropriated balance in the Capital
Improvements Tax Fund the sum of $60,000 to account 40-03-14-2560 for the purpose
of purchasing flow monitoring devices.
Section 3. That this Ordinance be, and hereby is, declared to be an emergency measure
r,., : necessary for the preservation of the public health, safety, and welfare and, therefore,
. : this Ordinance shall take effect and be in force immediately upon its passage.
