AN ORDINANCE TO AUTHORIZE THE ESTABLISHMENT OF THE PARK
DEVELOPMENT FUND, AND DECLARING AN EMERGENCY

... WHEREAS, Ordl.nance 22-81 and 58-86 establl.shed the development
fees and land dedications found in Section 1109.02 "Open Space
Requirements", and 1109.021 "Land Dedication for
Municipality's Portion of Recreational Facilities", of the
Codified Ordinances of Dublin, Ohio; and
WHEREAS, Section 1109.02(e), as amended, states all fees shall
be used solely for the acquisition of recreational facility
sites, open space and/or parkland. None of the fees collected
pursuant to this section may be used for any other purpose
including but not limited to development, maintenance and
operation of such publicly owned recreational sites and
facilities; and
WHEREAS, Section 1109.021 (e), as amended, states all fees
required to be paid by this section shall be paid to the
Municipality and held in a fund created hereby. Such fees
shall be used solely for the acquisition of recreational
facility sites, open space and/or parkland. None of the fees
collected pursuant to this section may be used for any other
purpose including but not limited to development,
construction, reconstruction, enlargement, improvement,
maintenance and operation of such publicly owned recreational
~ sites and facilities. The Municipality shall expend
. additional funds for park and recreational purposes from its
__ general fund or other funds; and
WHEREAS, Section 1109.021(i) is deleted in its entirety.
NOW, THEREFORE, BE IT ORDAINED by Council of the City of
Dublin, State of Ohio, ~ of the elected members concurring:
Section 1. That there be established the Park Development
Fund, a Capital Project Fund.
Section 2. That the fees collected under Section 1109.02 and
1109.021, as amended, be deposited with the Department of
Finance to the credit of the Park Development Fund.
Section 3. That this fund be used by the City for the
acquisition of recreational facility sites, open space and/or
parkland.
Section 4. That this Ordinance be, and the same hereby is,
declared to be an emergency measure for the preservation of
the public peace, health and safety, and therefore this
Ordinance shall take effect and be in force immediately upon
its passage.
