WHEREAS, the City of Dublin is a government member of the Mid- Ohio Regional Planning Commission (MORPC); and WHEREAS, on December 19, 1991, MORPC adopted a resolution in support of revisions to the Financial provisions of its Articles of Agreement; and WHEREAS, the revised Financial provisions provide more flexibility by replacing the fixed dues rate with the requirement that the Commission adopt a fee schedule each July for the upcoming year and establish a maximum fee schedule for the next five years; and WHEREAS, said amendments were developed by the Dues Task Force and approved by the Administrative Committee and the full MORPC board; and WHEREAS, in order for MORPC to implement the amendment to the Articles of Agreement, a majority of member governments must approve said amendment through legislative action; f~ NOW, THEREFORE BE IT OR~INED by the Council of the city of Dublin, state of Ohio, of the elected members concurring: \..... That revised Financial provisions of the Articles of Agreement, dated December 19, 1991, (a copy is attached hereto and incorporated herein by reference as Exhibit A) of the Mid-Ohio Regional Planning Commission (MORPC) be and are hereby adopted. Section 2. That the City Manager is hereby authorized and directed to execute the amendment to the Articles of Agreement on behalf of the City of Dublin. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and safety in this city, such emergency arising from the need to adopt said revised Financial provisions of the Articles of Agreement in order to facilitate the ratification process prior to June 30, 1992, therefore, this Ordinance shall take effect immediately upon passage. AMENDMENT TO MID-OHIO REGIONAL PLANNING COMMISSION ARTICLES OF AGREEMENT The city of Dublin and the Mid-Ohio Regional Planning Commission hereby agree to amend their Articles of Agreement, most recently amended and adopted in their entirety dated November 16, 1989, as follows: 1. Article IX Financial Provisions is hereby amended to read as follows: ~.. IX FINANCIAL PROVISIONS A. APPORTIONMENT OF COSTS The cost of maintaining the COM1\1ISSION for regional planning purposes shall be apportioned in the following manner. Each year the COMMISSION shall adopt a fee schedule in July to be used in assessing members for the upcoming calendar year. Every five years, beginning in December 1991, the COMMISSION shall establish a five-year fee schedule which it shall not exceed when adopting fees for each upcoming year. Each participating municipality, participating county and member township shall contribute annually according to the fee schedule adopted by the COMMISSION. When per-capita fees are used, each member township shall contribute based on the population in the unincorporated area of the township and the contribution of each participating county shall be based on the population of the unincorporated areas of the county or portion thereof participating in the COMMISSION. The contribution for the first year of membership shall be paid during the month following the execution of an agreement between the member and the COMMISSION, and shall amount to that part of the appropriate annual participation cost pro-rated on the basis of the balance of the time remaining in that calendar year. In addition, in every calendar year commencing in 1981, each participating municipality shall contribute not more than 7 cents per capita of its population; every participating township shall contribute not more than 7 cents per capita of the population in the unincorporated area of the township; and each county shall contribute not more than 7 cents per capita of the population in the unincorporated area of the county or portion thereof participating in the COMMISSION. The funds so contributed shall be set aside in a separate fund to amortize lease payments on the building or buildings housing the COMMISSION'S offices and shall be used for no other purpose. In the event that the COMMISSION decides that further capital improvements are needed after this lease is paid out, the 7 cents will continue to be committed to such purpose. If they are not needed, then these contributions shall cease. Amendment to Anicles of Agreement Page 2 When per-capita fees are used in assessing annual member fees, all current year population figures for municipalities, townships and counties shall be based on the latest Federal Census when available, or an estimate thereof made by the COMMISSION. 2. All other Articles of Agreement between the city of Dublin and the Mid-Ohio Regional Planning Commission remain unchanged. Falco Dear Tim: Secretary At its December meeting the MORPC board adopted Resolution No. 28-91, "Revising the William H. Anderson Financial Provisions of the Articles of Agreement." This revision makes the financial Chairman Administrative Committee provisions more flexible by replacing the fixed dues rate with a requirement that the To Be Appointed Commission adopt a fee schedule each July for the upcoming year, and it establishes Chairman maximum fees for the next five years. The maximum fees are set forth in Section 3 of Franklin County Planning Area Subcommittee the resolution and range from $.305 per capita in 1993 to $.357 per capita in 1997. Loehnert Implementation of this resolution requires ratification by a majority of member Chairman Local Government governments via action of their municipal councils or boards of commissioners. Our Committee Michael Greene objective is to achieve ratification in the April 1 through June 30, 1992, time frame. Chairman Therefore, we request that the city of Dublin adopt and execute the revised financial Transportation Advisory Committee provisions of the Articles of Agreement of the Mid-Ohio Regional Planning Commission.
