AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT MODIFYING THE WATER
SERVICES CONTRACT WITH THE CITY OF COLUMBUS
AND DECLARING AN EMERGENCY.

WHEREAS, the City of Dublin entered into a contract with the City of
..... Columbus for water services on March 5, 1974 pursuant to Ordinance No.
7-74; and
WHEREAS, Section 7 of the contract requires the City of Columbus to
collect any surcharge enacted by the City of Dublin and to remit those
collections every three months; and
WHEREAS, the City of Columbus, Division of Water desires to modify ~
Section 7 to provide for monthly, rather than quarterly, remittance of
surcharge collections;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
II State of Ohio ~ of the elected members concurring;
Section 1. That the City of Dublin approves the proposed modification
allowing the City of Columbus, Division of Water to remit surcharge
collections on a monthly basis,
Section 2. That a copy of the Modification of Contract is hereto
attached as Exhibit A,
Section 3, That the City Manager be, and hereby is, authorized to
execute said Modification of Contract with the City of Columbus.
Section 4. That this Ordinance be, and the same hereby is, declared to
be an emergency measure, and therefore shall take effect and be in
force immediately upon its passage.

RE: WATER SERVICES CONTRACT
Dear Mayor Rozanski:

Enclosed is a fully executed copy of the modification of the
water services contract between the City of Columbus and the city
of Dublin which provides for the City of Columbus to refund
surcharge collections on a monthly' basis.
Monthly payments were instituted earlier thip year; however,
distribution of the executed documents was delaye~ until all
modifications were completed. The last one was just finalized a
few days ago.

matter.

This Modification of Contract made and entered into by and
between the City of Columbus, Ohio, a municipal corporation, duly
authorized by Ordinance No. 2720-91, passed December 16, 1991, and
the city of Dublin, Ohio, a municipal co~poration, duly authorized

WHEREAS, the Contract for water service between the city of
Columbus, Ohio and the city of Dublin, Ohio was entered into on the
5th/day of March, 1974, pursuant to Ordinance No. 1438-72 passed
and approved by the City of Columbus, Ohio and Ordinance No. 7-74
passed and approved by the City of Dublin, Ohio; and
WHEREAS, it is necessary to modify section 7 to provide for
monthly, rather than quarterly, remi ttance of surcharge
collections; and ·
Now, therefore, it is mutually agreed that section 7 of the
service contract be modified to read as follows:
section 7. The city of Dublin shall
install or authorize the City of Columbus to
install or have installed under the
~, supervision of the city of Columbus all taps
> to the water main distribution system of the
city of Dublin. If the tap is installed by
the city of Columbus the charges shall be the
then current applicable charge set forth in
section 1105.08, Columbus City Codes, 1959, as
amended, or as may be amended or reenacted in
the future. Meter fees and repair charges
shall be the applicable city of Columbus fee
or charge. All meters shall be procured
through the Division of Water of the City of
Columbus. Prior to distribution or sale of
water to consumers within the city of DUblin,
each consumer shall sign for the City of
Columbus a standard consumer contract and
shall agree to comply with all applicable
ordinances, provisions of the Columbus City
Codes and the Regulations and Rules of its
Director of Public utilities and Aviation, as
such ordinances, provisions of the Columbus
city Codes, 1959, and the Rules and

Regulations of the Director of Public
utilities and Aviation may be amended,
reenacted and established or reestablished in
the future.
The city of Columbus shall at its own
expense read meters and render bills to
consumers. The city of Columbus agrees that
upon presentation by the city of Dublin of a

Dear Mayor Rozanski:
Section 7 of the Agreement between the City of Columbus, Ohio and
the Ci ty of Dublin for the City of Columbus to provide water
service currently requires that surcharge collections be refunded
to you every three months.
The Division of vlater desires to refund the surcharge collections
on a monthly basis, which will not only provide better service
for your City, but will allow the Division of Water to make the
refunds part of our monthly routine.
If you approve of this change, please have necessary legislation
prepared authorizing the modification, and sign and return all
three copies of the enclosed contract modification to Craig W.
Charleston in the envelope provided. Mr. Charleston can be
reached at 645-8046 if you have any questions.
Once we receive the completed modification from the City of
Dublin, necessary approvals will be obtained and a fully executed
copy of the modification will be forwarded to you along with
notification of the date the monthly payments are to commence.
