AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO ENTER INTO A CONTRACT FOR THE HOUSING OF PRISONERS
WITH THE DELAWARE COUNTY BOARD OF COMMISSIONERS

WHEREAS, the Board of County Commissioners, I
~ Delaware County,
Ohio, has proposed the attached contract be entered into by
the Delaware County Board of Commissioners and the City of
Dublin for boarding of prisoners.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
DUblin, state of Ohio, ~ of the elected members concurring:
section 1. That the City of Dublin enter into a contract
with the Delaware County Board of Commissioners to house
offenders at a per diem rate of $56.00.
Section 2. That the contract hereto attached as Exhibit "A"
is hereby accepted.
Section 3. That the City Manager be, and hereby is
authorized to enter into a contract with the Delaware County
Board of Commissioners for the purpose of boarding prisoners
at the rate of $56.00 per day.
Section 4. That this ordinance shall take effect and be
enforced from and after the earliest period allowed by law.

A CONTRACT PROVIDING FOR THE
DETENTION OF CITY PRISONERS
This agreement is made by and belween the Cily of , ("Count.y")
, Ohio and the Delaware County Commissioners
("Commissioners"). Delaware. Ohio. according to Section 341.12 through
1 341,15 of the Ohio Revised Code.
Whereas. it is necessary at times to confine City Prisoners. that is persons
confined pursuant to and under the provisions of the Ohio Reviscd Code.
Therefore, the COlllmissioners agree to permit confinement and safekeeping
of all prisoners confined, pursuant to the orders of Delaware Counly
Common Pleas and / or Municipal Court of Delaware. Ohio. or prisoners
arrested and confined, awaiting trial or serving a sentence for alleged or
proven violations of the City Ordinances, Delaware, Ohio, in the Delaware
County Jail ("County Jail") and upon the following terms and conditions. to
wit:
The City shall pay the per diem in effect at Ul.e time of incarceration for
each day or fractional part of a single calender day, to be determined from
midnight to midnight for each prisoner confined for violations of City and or
Village Ordinances. whether as a pre-trial. or who. after sentenced. are
confined to the Counly Jail to serve a sentence in terms of days. or until fine
and costs are paid: provided, further. that County prisoners so sentenced in
the Counly Jail for a fractional part of one day and for a fractional part of the
following day. shall be considered as having been confined for a two (2) day
period, each fractional part of a day being considered as a full day.
The Cily shall pay upon the presentation of bill: per diem for each day or
fractional part of a single calender day per prisoner to be determined from
midnight to midnight. The sum includes 'necessary supplies plus the cost of
meals for inmates incarcerated \vithin Ule County Jail.
The City shall be responsible for and hold the Counly harnlless from all
medical or dental attention supplied by Ule County Jail to any County
prisoner during incarceration at Ul.e County Jail. and will be separately billed
to the County on and above the daily per diem, confinement costs,
In Ule event the Counly Jail is overcrowded and prisoners must be housed in
oUler Counties. Ule City shall pay the rate charged per day for prisoner
confinement of the facilily where the prisoner is being housed. and tilC
County shall provide transportation for County Prisoncrs to tile other
Counties.

The Sheriff of Delaware County and those employed by said person shall
keep said prisoners until ordered discharged by the proper court authorities
of Delaware County, Jail personnel shall keep a Jail register upon which win
be entered the names of the prisoner or prisoners confined together. with
the name of the arresting officer, date of arrest, disposition of case and the
date of release for prisoners of the County Jail.
~ In the event the City should accept and receive prisoners of the Sheriff. this
agreement shall be reciprocal
This agreement shall be effective from the first day of July 1.1992 for a
period of one (1) year, and shall be extended from year to year unless..
terminated, It may be terminated by either party by providing sixty (60)
days prior written notice to the other party, ,-
This agreement may be amended provided such amendment shall be in
writing and signed by both parties,
