AN ORDINANCE AMENDING THE ANNUAL
APPROPRIATIONS FOR THE FISCAL YEAR
ENDING DECEMBER 31. 1993 FOR THE
G PURPOSE OF ACQUIRING REAL PROPERTY
WHEREAS. Ordinance No. 9-93 (Amended) authorizes the City Manager. on behalf of
the City, to enter into a lease and operations agreement and grant a mortgage in
connection with the Central Ohio Ice Rinks, Inc. ("COIR") authorizes the City's
participation in the project; and
WHEREAS. pursuant to Ordinance No. 132-92 passed by this Council on December
21, 1992, the City and COIR on December 22, 1992 entered into an Amended
Inducement Agreement to formalize the terms and conditions upon which the City and
COIR, are willing to consummate the transactions contemplated by the Inducement
Agreement, including the City's acquisition with non-tax revenues and leasing to COIR
of a parcel of real property of approximately seven and one-half (7-1/2) acres located
in the City at 7001 Dublin Park Drive (the Site), all for the purpose of creating and
preserving jobs and employment opportunities and improving the economic welfare of
the people of the City; and
WHEREAS. the City's General Fund has sufficient non-tax revenues, such as interest
income, fees collected for various licenses and permits and fines and costs collected
by the Mayor's Court, to purchase said real property; and
WHEREAS. the Ohio Revised Code requires, when necessary, amendments to the
"...., annual appropriation ordinance in order that appropriations are not over expended; and
L' WHEREAS. it is necessary to amend those appropriations to provide adequate spending
authority to acquire the seven and one-half (7-1/2) acres located at 7001 Dublin Park
Drive.
NOWt !HEREFORE. be it ordained, by the Council of the City of Dublin, State of Ohio,
V of its elected members concurring:
Section 1 . That there be appropriated from the unappropriated balance in the General
Fund the amount of $400,000 to account 01-01-19-2510 for the purpose of acquiring
real property.
Section 2.. That this Ordinance shall take effect and be in force on the earliest date
permitted by law.. <:>
