Form No. 30043 45-95 Passed~m--~ ^~ ~~__~m~~~m~~m__m__n~n__~m~19~mm~ Ordinance NO'n__mnnn~m_m_~~ AN ORDINANCE AUTHORIZING THE CITY MANAGER TO SIGN A COOPERATIVE AGREEMENT BETWEEN THE CITY OF COLUMBUS AND THE CITY OF DUBLIN, OHIO FOR AN INTERSECTION IMPROVEMENT AT FRANTZ ROAD AND HAYDEN RUN ROAD -- WHEREAS, the City of Columbus is currently in the process of designing plans to widen the Frantz Road and Hayden Run Road intersection; and WHEREAS, the City of Columbus has designed its project to be compatible with the City of Dublin's needs; and WHEREAS, the City of Columbus, acting through the County of Franklin to purchase right-of-way and easements within the City limits of Dublin, as part of the Frantz Road and Hayden Run Road intersection project; and WHEREAS, it is in the best interest of both cities to construct projects in a cooperative manner; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 17 of the elected members concurring that: Section 1. The City Manager be and hereby is authorized to execute on behalf of the City ""',"[r~ of Dublin the Cooperative Agreement between the City of Columbus and the City of Dublin, attached hereto. k Section 2. That the City Manager or his designee be, and hereby is, authorized to cooperate, review and approve construction plans for the Frantz Road and Hayden Run intersection. Section 3. Hansley, City Manager ( Subject: Revised Draft of Cooperative Agreement with the City of Columbus Regarding the Intersection Improvements of Hayden Run and Frantz Roads, Date: September 28, 1995 Attached please find a revised agreement with the proposed changes marked. The majority of these changes have arisen from discussions between Council Member Stillwell and the affected property owners over the last several weeks, The net effect of the changes is to allay most of the fears and concerns that the residents have regarding this project. I have been in contact with Tom Merritt from the City of Columbus regarding this agreement. He cannot give me his full assurance that his staff or the Columbus City Council will agree to all of these changes. However, he generally feels that the proposal is fair and that we are very close. I hope to learn in more detail what areas may still require additional "fine tuning" between now and Monday ,- night. i Both Council Member Stillwell and I will be available to respond to your questions concerning this '...., agreement on Monday night. , _._--~-----~---_.__._--- , COOPERATIVE AGREEMENT BETWEEN THE CITY OF COLUMBUS AND THE CITY OF DUBLIN WHEREAS, the intersection of Frantz Road and Hayden Run Road has utility to the general public of the City of Dublin as well as to the citizens of Columbus, is an important connecting link between the state, county, and municipal highway systems for traffic, and the public interest demands the r improvement of this roadway; now, therefore, the City of Columbus through its Service Director and the City of Dublin through its City Manager do hereby mutually agree to cooperate in the planning, ...., design and construction and to share the cost and expenses of the proposed improvement as follows: WHEREAS, the City of Columbus is intending to pass an ordinance authorizing the Director of Public Service to enter into a cooperative agreement with the City of Dublin for the improvement of the intersection at Frantz Road and Hayden Run Road, and WHEREAS, the City of Dublin passed Ordinance No. 45-95 on October 2, authorizing its City Manager to enter into a cooperative agreement with the City of Columbus for the improvement of the intersection at Frantz Road and Hayden Run Road. The City of Dublin agrees to: . Declare the improvement for the Frantz Road and Hayden Run Road intersection, and construction thereof, a public necessity. . Review and approve final construction plans in conjunction with the City of Columbus and Franklin County, on the condition that said plans provide for the replacement of the existing electric utility poles with wood laminate poles which will be located between the retaining wall and the curb. It is also recognized by the parties that the actual location of the retaining wall may be modified in the field to provide for a more aesthetic appearance. It is further ......... recognized by the parties that any additional improvements to the Thornhill Lane cul-de-sac which are outside the scope of the project, will be by separate agreement between Dublin and the property owners. . Review and approve final right-of-way plans in conjunction with the City of Columbus and Franklin County. . Work in cooperation with the City of Columbus and Franklin County to provide for the purchase of the required right-of-way that lies within the incorporated limits of the City of Dublin. . Retain responsibility for the operation and maintenance of that portion of the completed improvement within its jurisdiction, such responsibility to include maintenance of landscaped areas. Dublin recognizes that any landscaping improvements that are outside the scope of the project, will be by separate agreement between Dublin and the property owners. . Compensate the City of Columbus for the additional construction costs associated with the aesthetic treatment of the retaining wall and wrought iron fence along the north side of Hayden Run Road between Frantz Road and the Scioto River. Dublin's share of these additional costs will be prorated to reflect the participation of the Ohio Public Works Commission. In the event that these Ohio Public Works Commission funds are allocated , l/fll"'^ Dublin's costs would be approximately forty percent (40%) of the total. ,., The City of Columbus agrees to: . Declare the improvement for the Frantz Road and Hayden Run Road intersection, and construction thereof, a public necessity. . Involve the general public (public meetings, hearings, etc.) in the entire project development process. . Direct and manage all consultant activities for detailed design. - . . .' , . Review and approve line, grade, and typical section plans and to conduct field and office checks in conjunction with the City of Dublin and Franklin County. . Approve final construction plans and final right-of-way plans in conjunction with the City of Dublin and Franklin County and to provide sufficient sets of said plans, following approval, so that Dublin may provide copies to the affected property owners, The parties recognize that the need for the retaining wall to run across all properties has been raised by one of the ("'" affected property owners, The parties agree to further review this issue before the plans are .~ finalized. l . Operate and maintain that portion of the completed improvement within its jurisdiction. . Coordinate all necessary utility relocation and adjustments. . Coordinate this project with the West Branch Interceptor Sewer Project which is currently proposed by the City of Columbus in this same general area. Columbus agrees, as part of this agreement, to provide Dublin with written assurances that they have reviewed the necessity for the emergency exit lane for the shaft and the necessity for the sidewalk proposed to be constructed west of the mound. . A ward and compensate the construction contract. . Provide construction inspection. . Upon completion of the improvement, the City of Columbus will bill the City of Dublin for approximately 40% of the total additional costs, prorated to reflect the Ohio Public Works Commission's participation of approximately 60 percent (60%) applied toward the additional cost for aesthetic treatment to the facing of the retaining wall and wrought iron fence along the back of the wall. ,- '- . Negotiate an agreement whereby Franklin County will contract and compensate a consultant for the preparation of detailed construction and right-of-ways plans. . Coordinate all landscape replacement within Dublin's portion of the project with the City of Dublin and the affected landowners, .
