That in consideration of an annual payment from Washington TownShip, the City of Dublin agrees to provide communication service twenty-four (24) hours per day and seven (7) days per week to the Fire Department of the Township of Washington, Franklin County, Ohio. Section 2. That terms of said agreement are attached hereto as Exhibit "A". Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare and for further reason that the present agreement providing for these critical services expires on May 31, 1995, and therefore, this Ordinance shall take effect and be in force immediately upon its passage. = Passed this S-Ih day of r ' 1995. D,JbI~, ~'hH\ EXHIBIT A AGREEMENT .- This agreement made and entered into by and between the Board of Township Trustees - of Washington Township, Franklin County, Ohio, Delaware County, Ohio, and Union County, Ohio, a Board of Township Trustees as defined in Chapter 505 of the Ohio Revised Code, sometimes hereinafter referred to as "Washington", and the City of Dublin, Ohio, a municipal corporation, sometimes hereinafter referred to as "Dublin": 1. In consideration of an initial annual payment by Washington to Dublin of $105,000, a payment of $110,000 for the second annual period and a payment of $115,000 for the third annual period, Dublin agrees to provide communication services twenty-four (24) hours per day and seven (7) days per week to the Fire Department of the Township of Washington, Ohio. 2. It is mutually agreed by the parties as follows: - (a) Dublin shall, at its cost, continue to maintain a fire phone in the Dublin ...... Police Division during the period of this contract. (b) Dublin shall answer such phone and shall communicate the message or request to the Washington Township Fire Department in accordance with generally acceptable procedures for dispatching and in accordance with such procedures as shall from time to time be prescribed by the Washington Township Fire Chief. (c) Dublin shall answer the Washington Township Fire radio and shall comm- unicate messages and requests in accordance with generally acceptable dispatching procedures and in accordance with such procedures as shall from time to time be prescribed by the Washington Township Fire Chief. ........ (d) Dublin shall monitor the fire alarms and shall communicate the alarms to the Washington Township Fire Department in accordance with generally acceptable procedures for dispatching and in accordance with such procedures as shall from time to time be prescribed by the Washington Township Fire Chief. ........"" (e) Dublin shall keep a log of all communications referred to in Paragraphs ........ (b), (c), and (d) above. Such log and all other papers and information relating to the operation of the Washington Township Fire Department shall be maintained by Dublin and transferred to the Washington Town- ship Fire Department in accordance with procedures prescribed by the Washington Township Fire Department. The Dublin dispatchers shall not release or divulge any information relating to Washington Township Fire operations to persons other than officials of Washington Township Fire Department except as necessitated by generally acceptable dispatching procedures. (t) Dispatching shall be performed only by qualified individuals hired by Dublin for that purpose. A review panel consisting of Washington's Fire Chief and Dublin's Police Chief shall establish and periodically review the selection process, criteria, experience, and performance requirements for qualified dispatchers. (g) Dublin shall perform all of its obligations under this contract in accor- dance with procedures set forth by the Washington Township Fire Chief and shall in no way interfere with the operation of the Washington - Township Fire Department. -.. (h) Dublin shall schedule a minimum of two (2) dispatchers at all times. Both parties recognize that Dublin is under no obligation to assign either dispatcher to exclusively perform fire dispatch duties. Dublin will continue its policy of handling radio calls in priority order without regard to whether the call is related to police, fire or emergency medical activity. (i) The parties recognize and agree that by previous agreement, title to the 9- 1-1 emergency dispatch equipment has transferred from Washington to Dublin. - (j) All existing fire alarms shall continue to terminate at Dublin's Police Division during the period of this contract. Washington's Fire Chief and Dublin's Police Chief shall be responsible for maintaining guidelines for any new businesses to be added to the alarm panel, and shall jointly review all such applicants to determine if the guidelines for installation are - met. - (k) Washington shall assume all responsibility for their mobile radio equip- ment and shall pay any expenses required to render it compatible to the Dublin dispatch center. Both parties recognize that the proposed high band mutual aid frequency by the City of Columbus is excluded from the scope of this agreement and shall be resolved as a separate issue. (1) All maintenance expenses for the central dispatch computer and radio equipment shall be the responsibility of Dublin. (m) All maintenance expenses for Washington's computer and fire dispatch equipment shall be the responsibility of Washington. This agreement shall become effective June 1, 1995, and shall remain in force for a period of three (3) years. One-half of the annual payment outlined in Paragraph 1. is due on June 1, 1995, with the remaining one-half annual payment due upon full implementation and staffing as outlined in Paragraph 2 (h) of this agreement. The remaining annual payments are ,..... due on June 1, 1996 and June 1, 1997. It is the intention of both parties to negotiate a ...... replacement agreement during the final year of this agreement period to cover an additional three-year period. However, both parties recognize that if the conditions covered by this agreement undergo any substantial change, then either party may request the commencement of negotiations which could lead to the execution of a new agreement prior to May 31, 1997.
