RELATING TO THB BUZLDING CONSTRUCTION APPEALS BOARD,
AHD DECLARING AB EMERGENCY

1IBERDS, the Building Construction Appeals Board hears appeals
with respect to issues involving one-, two-, and three-family
residential units.
1IBEREAS , Council finds that a filing fee of $190.00 is a
reasonable cost of a hearing before the Building Construction
Appeals Board and that the filing fee should be
non-refundable.
1IBEREAS, the current members of the Building Construction
Appeals Board are serving terms of unspecified duration.
1IBERDS, Council finds that it is in the best interest of the
city of DUblin, Ohio to specify the terms of the members of
the Building Construction Appeals Board.
1IBERDS, Council finds that it is in the best interest of the
City of Dublin, Ohio to provide for overlapping terms for the
members of the Building Construction Appeals Board.
NOW, THEREPORB, be it ordained by the Council of the City of
I!fIiI!"I DUblin, state of Ohio, ~ members concurring:
Section 1. Section 160.05 of the Codified Ordinances of the
....... City of DUblin, Ohio shall be amended to read as follows:
(a) It is necessary to form a Building
Construction Appeals Board for the Dublin
Building Department to hear all appeals
not related to the "Ohio Basic Building
Code" (OBBC); namely, one, two and three
family residential dwellings within the
City limits. The Board shall also have
jurisdiction over licensing procedures in
situations where a determination is
required in issuing, detaining or
revoking a license.
(b) There is to be a non-refundable fee of
one hundred ninety dollars ($190.00) to
be filed at the time of the appeal.
(e) The Board shall be established by Council
and shall consist of a minimum of five
members. The members shall have
qualifying experience and/or training

such as persons trained in
.... mechanical/structural engineering
building, architecture, etc. All members
shall be residents of the City.

""..... (d) The terms of the members of the Board
shall be as follows:
-',:4 (1) The term of one member as
designated by Council shall
expire in 1995.
(2) The terms of two members as
designated by Council shall
expire in 1996.
(3) The terms of two members as
designated by Council shall
expire in 1997.
(4) Upon the expiration of the term
of a member, Council shall
either reappoint the member or
appoint a successor for a term
of three years. All subsequent
terms shall be for a period of
three years.
(e) Meetings of the Board shall be called by
the Chief Building Official of the city.

(f) The decision of the Board shall be
...... reached by a majority of the members of
the Board and shall be final.
section 3. Former section 160.05 is hereby repealed.
section 4. This Ordinance is declared to be an emergency
measure necessary for the health, safety and welfare of the
citizens of Dublin, and therefore shall take effect and be in
force immediately upon passage.
