AUTHORIZING THE CITY KARAGER TO ENTER INTO A CONTRACT GOVERlfING THE PROCUREMENT OF SAID SALT. ~,~-"-.... WHEREAS, after advertising and receiving bids for road salt; and WHEREAS, Council has determined that the bid submitted by Morton International, Inc. in the amount of $36. 78/ton is the lowest and best bid; NOW, THEREFORE BE IT ORDAINED by the Council of the City of DUblin, state of, Ohio, 7 of the elected members concurring: section 1. That the bid submitted by Morton International, Inc. in the amount of $36.78/ton for road salt is hereby accepted. section 2. That the City Manager is hereby authorized to enter into a contract with Morton International, Inc. , governing the procurement of said salt as specified within said bidder's bid proposal and the City's bid documents on file in the Division of Personnel & Purchasing. section 3. That this Ordinance be, and hereby is, ~ declared to be an emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, shall take effect and be in force immediately upon its passage. Harding, ........ Attached for your consideration please find Ordinance No. 107-94 accepting the lowest and best bid for road salt. Also attached for your review is the bid tabulation form. Bids were requested based upon an estimated quantity of 5,000 tons, which represents an increase of 1,000 tons over the 1993 estimate. As reflected in the attached bid tabulation, the City received a response from the following vendors: . Morton International, Inc. · Cargill, Inc. · North American Salt Company · AKZO Salt, Inc. As noted in the bid tabulation, the alternate bid submitted by Morton International, Inc. in the amount of $36.78/ton is the lowest bid. This alternate bid includes a 1-5 day guaranteed delivery time as opposed to the 48 hour delivery time specified within the bid documents. Staff has re-evaluated the need for the 48 hour delivery requirement and, in light of the Service Department's efforts to stock greater quantities of salt than in previous years, Staff believes the $5,000 savings associated with the lower bid price more than offsets the concern over a 48 hour delivery time. One other concern exists, however, with Morton' s bid. As noted in the bid tabulation, Morton's bid proposal did not contain a bid bond, which is required within the City's general bid conditions. As such, Morton's bid contains an irregularity. Staff has sought the advice of the Law Director's office on this issue and has been advised that the City has the right to waive such an ~,"''''' irregularity in Morton's bid, and that such action would be defensible. (The City's bid documents contain language which reserves the City's right to waive ""'- such irregularities in bid proposals and to accept the bid which, in the City's opinion, is in the best interest of the City.) Since acceptance of Morton's bid would be in the best interest of the City, Staff hereby recommends that the irregularity in Morton's bid be waived. (For reference purposes, it should be noted that Morton International has provided salt to the City since 1990 and has met the City's needs over that period of time.) In the final analysis, Staff believes that accepting Morton's alternate bid in the amount of $36.78/ton would be in the best interest of the City and, therefore, Staff recommends that said bid be accepted. Please note that Ordinance No. 107-94 has not been drafted as emergency legislation; however, Staff would ask that Council consider this Ordinance as emergency legislation at the second reading on December 5, 1994. Staff feels that emergency passage would be appropriate at that time given the uncertainty of the weather in December. Although supply levels are now high, a severe storm during early to mid-December could deplete these levels, thus leading to an inability to properly maintain roads within the City. Given these circumstances, Staff believes that adoption of Ordinance No. 107-94 as an emergency at the December 5, 1994 meeting would be justified. /tb ,....
