AN ORDINANCE TO APPROPRIATE A FEE SIMPLE INTEREST
IN A 0.3875 ACRE +/- PARCEL OWNED BY DUBLIN
MARATHON SERVICE COMPANY, LOCATED ON THE WEST SIDE
OF HIGH STREET AND SOUTH SIDE OF BRIDGE STREET, IN
THE CITY OF DUBLIN, COUNTY OF FRANXLIN, STATE OF

WHEREAS, the city of Dublin has undertaken various studies and
....... plans over the years regarding the enhancement and strategic
re-development of the old Dublin Historic Area; and,
1fBEREAS, Dublin city council has adopted goals which
specifically established as a public policy, the enhancement,
protection and strategic re-development of this unique
historic area; and
WHEREAS, Dublin city council has previously enacted Resolution
Number 21-95, a copy of which is attached hereto as Exhibit
"A", wherein it found that the subject property as one of two
service stations located at the intersection of Bridge street
and High street within the city of Dublin, represents a use of
property inconsistent with the long term enhancement and
viability of the Old Dublin Historic Area and that said uses
can have a blighting effect on the long term viability of
surrounding areas; and,
1fBEREAS, council, in Resolution 21-95 determined that
acquisition of the subject property was amoung the highest
community development objectives of the city for the purpose
of enhancement of the historic area, community definition,
...... downtown re-development and to encourage additional private
investment throughout the entire Old Dublin Historic Area;
-... and,
1fBEREAS, said improvement will require the city of Dublin to
obtain a fee simple interest in and to the premises described
in the attached Exhibits "B" and "C", located in the city of
Dublin, Franklin County, Ohio.
NOW, THEREFORE, BE IT ORDAI~the council, of the city of
Dublin, state of Ohio, of the elected members
concurring that:
Section 1. A fee simple interest in and to the 0.3875 +/-
acre premises located in the city of Dublin, Franklin County,
state of ohio, and more fully described in the descriptions
attached hereto as Exhibits "B" and "C", is hereby
appropriated for the purpose of improving the Old Dublin
Historic Area, pursuant to Ohio Revised Code Chapter 163 and
the Constitution of the state of Ohio.
section 2. council finds that the appropriation is
necessary for the public purpose stated herein, and that the
city has been unable to agree with the owner of the property
as to appropriate compensation.
section 3. The city Law Director is directed to file a
,.... petition for appropriation in the Franklin County Common Pleas
Court, to have a jury impaneled to assess the compensation to
be paid for the real estate described above.
- section 4. This ordinance shall take effect and be in
force from and after the earliest period allowed by law.

i OF BRIDGE AND I1IGII STREETS WrrIIIN
_ TIlE OLD DUBLIN I1ISTOHIC AREA
_ I AND DECLARING SUCH ACTION A PUBLIC PURPOSE
WHEREAS, the City of Dublin has' uildertaken various studies and plans over the years
regarding the enhancement and strategic re-development of the Old Dublin Historic ArCc1;
and
WHEREAS, the Dublin City Council has adopted goals which specifically established
as public policy the enhancement, protection and strategic re-development of this unique,
historic area; and . .
WHEREAS, Dublin City Council has determined that the existing service stations
located on the northwest and southwest corners of Bridge Street and High Street
represent uses of property inconsistent with the long-term enhancement and viability of
the Old Dublin Historic Area and that said uses can have a blighting effect on the long-
term viability of the surrounding areas; and
WHEREAS, the acquisition of these properties has been determined by the Dublin City
COllncilto be among the highest CCllllll1unity development objectives of the City for the
purpose of historic area enhancement, community definition, downtown re-development
and to encourage additional private investment throughout the entire Old Dublin Historic
Area;
NOW, TIIr;EFORE, BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, of the elected members concurring:
- Section 1. That acquisition of the aforementioned service stations constitutes a legitimate
public purpose for the reasons set forth above; and

Section 2. That the City Manager is hereby authorized to take all steps necessary to
proceed with the acquisition of these two properties by tbe City of Dublin,
Section 3-L That this Resolution take effect and be in force from and after the earliest
period allowed by law.
