NOW, THEREFORE, BE IT ORDAINED by the Council of the city of
Dublin, state of Ohio, '7 of the elected members
concurring:
section 1. That the following described real estate (see
attached map marked Exhibit "A") situated in the City of
Dublin, state of Ohio, is hereby rezoned to PLR, Planned Low
Density Residential District, shall be subject to regulations
and procedures contained in Ordinance No. 21-70 (Chapter
Eleven of the Codified Ordinances) the City of Dublin zoning
Code and amendments thereto.

- The Planning and Zoning Commission took the following action at its regularly scheduled
meeting:
7. Rezoning Application Z9S-0171Preliminary Plat - Westbury IT
Location: 21 acres of land located on the south side of Brand Road, approximately
1,500 feet west of Avery Road, at the Franklin County/Union County line.
Existing Zoning: U-l, Rural District (Jerome Township Zoning District).
Request: PLR, Planned Low Density Residential District and approval of the
preliminary plat.
Proposed Use: An extension of a much larger neighborhood in Franklin County; this
site will contain 42 of the single-family lots.
Applicant: The Northwood Company, c/o David Haid, Suite 100, 941 Lane Avenue,
Columbus, Ohio 43221.
Staff Contact: Barbara M. Clarke, Planning Director.
MOTION: To approve this combined rezoning application and preliminary plat with the
following 15 conditions:
1) That the park land be clearly identified on the plan (renamed from "open space"). It
..... needs to be dedicated to the City by warranty deed with the recording of the fmal plat
with recording fees paid by the developer;
- 2) That a tree preservation plan be submitted, before completion of construction drawings,
outlining the areas of preservation and proposed lot lines, utilities, easements.
Adjustments may be required to preserve trees;
3) That 25-foot no-bl1ild zones be provided along the rear of lots which abut the southern
park area (Lots #285-287, and 290-291), to-foot no-build zone be provided along the
sideyards of Lots #284, 285, 94 and 95, and the no-build zone on Lot #115 be enlarged
from 10 to 20 feet;
4) That the bikepath along Tullymore Drive to Brand Road be concrete, an additional
bikepath easements be created between lots #51 and 52, and 76 and 77, and a bikepath
be installed along the entire Brand Road frontage to the east property line, with all paths
to be installed when the streets are constructed;
5) That a note be added to the plat providing that all houses (living space) shall be located
within a single county;
6) That a buffer plan be provided for the lots which abut Brand Road, including mounding
and landscaping, before the final plat is submitted;

Fencing - to permit fencing on an individual lot while providing a
consistent streetscape, the following shall apply:
1. A split rail fence, not to exceed 3-1/2 feet in
height with optional wire mesh, may be installed on a
single family lot, except in the no build zones. Said fence
shall be constructed in accordance with the specification attached
(See Exhibit D). No stockade or other solid fence shall be
permitted.
2. Notwithstanding the above, a lot owner may install a fence around
an in-ground swimming pool. Fence shall be i~ accordance with

Development Standards

The general character of this development will be predominantly two-story and 1-1/2
story homes of traditional to soft contemporary style featuring materials and finishes
-- such as brick, stone, wood, stucco and vinyl siding. Duplication of floor plans is
acceptable. Roof pitches should be a minimum of 6/12. Roofs will have a minimum of
6" overhand and 3" rakes.
The homes will be located on the lots taking into consideration its existing
topography and natural vegetation. There is to be emphasis on tree preservation,
natural lot drainage and existing adjacent homes. Where possible sideload garages are
encouraged.
The following minimum standards shall apply to each lot:
Minimum Lot Size - 10,400 s. f.
Minimum Frontage - 80 feet
Minimum Side Yards - 6 feet minimum
Total of Side Yards - 14 feet minimum
Maximum Height - 1-1/2 story home shall not exceed 26 feet above grade at front
elevation. Two-story home shall not exceed 35 feet above grade at
front elevation.

Alternate Drive Locations - shall vary with the intent to preserve trees. The
maximum width of the drive at the right of way will be 20 feet. (See
