AN ORDINANCE VACATING A SANITARY SEWER EASEMENT
IN RESERVE A OF SHAMROCK n

WHEREAS, the City Engineer of the City of Dublin, Ohio, desires to vacate
"""cd a portion of a sanitary sewer easement located in ReselVe A of Shamrock II.
WHEREAS, Council finds that there is good cause for vacating the sanitary
sewer easement because the sanitary sewer has been rerouted and the said
portion of the sanitary sewer easement is no longer necessary and has been
abandoned.
WHEREAS, Council finds that vacating the sanitary sewer easement will not be
detrimental to the interests of the City of Dublin, Ohio.
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of
Dublin, State of Ohio, 7 elected members concurring:
Section 1. That the sanitary sewer easement located in ReselVe A of
Shamrock II, of record in Plat Book 57, Page 7, of the Recorder's Office,
Franklin County, Ohio, is hereby vacated, provided however, that the City of
Dublin, Ohio, reserves its rights pursuant to any and all other easements
located thereon or thereunder. The sanitary easement is more fully depicted
in Exhibit "A".

Section 2. That the City Engineer is hereby instructed to prepare a vacation
...,. plat of the vacated easement and cause said plat to be recorded at the office
of the Franklin County Recorder.
Section 3. That the Clerk of Council is directed to notify the Auditor of
Franklin County of the vacation, by forwarding a copy of this ordinance to the
Auditor of Franklin County.
Section 4. That this ordinance shall take effect and be enforced from the
earliest date allowed by law.

SUBJECT: Vacation of sanitary sewer easement
Please find attached a copy of a proposed Ordinance to vacate a public sanitary sewer easement.
The easement is located through the Safety Solutions property off of Shamrock Court. It is 25
feet wide, and no drainage swales or pedestrian ways are located or planned within the easement.
A public sanitary sewer was in service within this easement until last year when the City
constructed a new sanitary sewer along Shamrock Court as part of the Safety Solutions TIF
project. The old sewer has since been abandoned in place and grouted shut.
This vacation is "housecleaning" for the City's inventory of easements and is a last step in
finali7.lng the public improvements for the Safety Solutions TIF project.
Upon Council's approval of this easement vacation, we will proceed with the recording of the
Ordinance.

Situate in the State of Ohio, County of Franklin, and the City of Dublin, and being bounded and
described as follows:
Being an existing twenty-five (25) foot sanitary sewer easement to the City of Dublin, and being
located in Reserve A of Shamrock n, of record in Plat Book 57, Page 7, and being only that portion that
lies within a 6.658 acre tract as conveyed to Shamrock II Development Company, an Ohio General
Partnership by deed of record in Official Record 26238U.+, all of the above aforementioned references
to the Recorder's Office, Fran1din County, Ohio, and further described on the drawing attached hereto
as Exhibit" A-I".
