AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO ACCEPI' A PROPOSAL FOR THE INSTALLATION
OF A 30-INCH STORM SEWER AND AN 8-INCH SANITARY SEWER,
LOCATED JUST SOUTH OF THE DUBLIN

PROPOSED ALTER GROUP/CELLULAR ONE
..... OFFICE DEVELOPMENT, AMENDING THE ANNUAL
APPROPRIATIONS AND WAIVING FORMAL
BIDDING AND ADVERTISING REQUIREMENTS
AND DECLARING AN EMERGENCY
WHEREAS, the installation of a new 8-inch size sanitary sewer located along the eastern
property of Willow Grive and southern property line of the Alter Group/Cellular One
development site, and the storm sewer pipe located south of Dublin Coffman High School,
along the western portion of the Alter Group/Cellular One development site, is to be
replaced with a larger size pipe to meet the drainage and depth needs of the proposed
Dublin/Coffman Connector; and
WHEREAS, the City of Dublin entered into an agreement with the Dublin Board of
Education, which provides that the subject storm sewer will become a publicly-owned
facility; and
WHEREAS, the City of Dublin has entered into an Economical Development Agreement
with the Alter Group/Cellular One, which requires that the City meet various time frames
with regards to publicly-installed infrastructure associated with their development; and

WHEREAS, a commitment was made by the City and the Alter Group to the residents of
- Willow Grove as a part of the recent rezoning of the subject property, that a mound and
landscaping buffer between Willow Grove and the proposed Cellular One development would
be installed very early in the development process to help mitigate and screen this project
from the adjacent residential development; and
WHEREAS, there is not sufficient time to bid and award this project in the normal manner
and to also comply with these obligations and commitments; and
WHEREAS, the City Engineer has estimated the cost of the installation of the 30-inch size
763 feet of storm sewer to be $75,000, and the installation of an 8-inch size sanitary sewer
903 feet in length to be $65,000,
NOW THEREFORE BE IT ORDAINED, by the Council of the City of Dublin, State of
Ohio, 7 of the elective members concurring,
Section 1. That the City Manager be and hereby is authorized to enter into a contract for
construction of a 30-inch storm and 8" sanitary sewer.
Section 2. That there be advanced from the Capital Improvement Tax Fund the amount
"""h\'~ of $140,000 to the McKitrick TIF Fund for the purpose of entering into a construction
contract for storm sewer improvements, This advance will be reimbursed from the proceeds
.......".. of a future debt issue which will subsequently be retired from service payments in lieu of
taxes,
Section 3. That there be appropriated from the unappropriated balance in the McKitrick
TIF Fund the amount of $140,000 to account 52-03-14-2551 for storm sewer improvements
or the Dublin/Coffman Connector construction project,

Section 4. That this Ordinance be and hereby is declared to be an emergency in order
for the City to comply with various contractual commitments made to the Dublin Board of
- Education and the Alter Group/Cellular One entities, and to fulf1l1 zoning commitments
relating to the buffering of the Willow Grove development. The construction of this pipe
- is necessary for the City to facilitate the construction of the Alter Group/Cellular One facility
which has been previously identified as an important public purpose by several related
ordinances acted upon by Dublin City Council. Therefore, formal bidding and advertising
, requirements are hereby waived pursuant to Section 735.05.01 of the Ohio Revised Code.
This Ordinance shall take effect and be in force immediately upon its passage,
