AN ORDINANCE TO AMEND CERTAIN
SECTIONS OF THE CODIFIED ORDINANCES
OF THE CITY OF DUBLIN PERTAINING

OPERATION OF A MOTOR VEHICLE
........ IN A CONSTRUCTION ZONE
WHEREAS, Chapter 45 of the Ohio Revised Code relating to
operation of a motor vehicle has been amended to provide for
enhanced penalties for violating motor vehicle laws within a
designated construction zone; and
WHEREAS, the improper or illegal operation of a motor vehicle
within a construction zone constitutes an immediate and direct
threat to the health, safety and welfare of the citizens of
Dublin and citizens utilizing roadways within the city of
Dublin; and
WHEREAS, it is Council's desire to amend section 333.99 of the
Codified Ordinances of the City of Dublin to conform with the
amendments to Ohio Revised Code Chapter 45; and
NOW, THEREFORE, BE IT ORD~INED by the Council of the City of
DUblin, State of Ohio, members concurring:
section 1. That existing section 333.99 shall be amended to

(C) Upon a finding that such person operated a
-- motor vehicle in a construction zone where a
sign was then posted in accordance with
section 4511.98 of the Ohio Revised Code, in
addition to all other penal ties provided by
law, there shall be imposed a fine of two
times and usual amount imposed for the
violation. There shall not be imposed a fine
of two times the usual amount imposed for the
violation upon an offender who alleges, in an
affidavit filed with the court prior to a
sentencing, that he is indigent and is unable
to pay the fine imposed pursuant to this
section, provided the court determines the
offender is an indigent person and is unable
to pay the fine.
Section 2. That this ordinance shall take effect and be in
force from and after the earliest period permitted by law.
