WHEREAS, pursuant to the Collective Bargaining Act (Chapter 4117 of the Ohio Revised Code), funding for the economic provisions contained within the attached Contract between the City of Dublin and the Fraternal Order of Police, Capital City Lodge #9 must be approved by Council within thirty (30) days of introduction to Council; and WHEREAS, the attached Contract regarding wages, hours, terms and conditions of employment is mutually acceptable to the City of Dublin and the Fraternal Order of Police Capital City Lodge #9; NOW THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, state of Ohio,-2- of the elected members concurring: Section 1. That the City Manager be, and hereby is, authorized to enter into the attached Contract with the Fraternal Order of Police Capital City Lodge #9 regarding wages, hours, terms, and conditions of employment. ...... Section 2. That, as referenced in Section 1.4 of the attached Contract, said Contract shall supersede and replace all applicable ........ state and local laws which it has the authority to supersede and replace. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public health, safety, and welfare in that the two parties have been abiding by an extension to the previous contract which expired December 31, 1995. I N T E R MEMO 0 F F I C E To: Members of Dublin City Council -- From: Timothy C, Hansley, City Manager / ~ Subject: Collective Bargaining Agreement Between the City of Dublin and i'ill"",. the Fraternal Order of Police Capital City Lodge #9 Date: Apri130, 1996 By: David L, Harding, Director of Personnel & Purchasing ~ Attached for your consideration, please find Ordinance No, 46-96 ratifying a new Collective Bargaining Agreement between the City of Dublin and the Fraternal Order of Police Capital City Lodge #9 regarding wages, hours, terms, and conditions of employment, Also attached for your reference is a copy of the contract document upon which tentative agreement has been reached by both parties, The attached contract is the culmination ofa bargaining process which began in September 1995 and which consumed many hours of work on the part of both parties, Although the negotiation process was not easy to complete and honest disagreements arose from time to time, the process was conducted in professional, business-like manner, As you are all well aware, "negotiation" involves "compromise"; neither party achieves all of their objectives, A successful process, however, does involve the willingness to jointly search for reasonable alternatives, In retrospect, both parties worked very hard to bring forth what we believe is a fair Contract, - Please note that pursuant to the Collective Bargaining Act (Chapter 4117 of the Ohio Revised Code), Council must approve the funding for the economic provisions contained within the -.. attached Contract within 30 days of introduction, Although Council action would be required no later than 30 days after introduction, Staff would recommend that Council adopt Ordinance No, 46-96 as an emergency measure at the second reading on May 20, 1996. Given that the negotiation process has taken seven months to complete and early ratification of the Contract would be in the best interest of the F.O.P" the City of Dublin, and the public health, safety, and welfare, Staff believes the emergency passage of Ordinance No, 46-96 on May 20, 1996 would be justified. Harding, Director of Personnel & Purchasing ~ INTRODUCTION As identified in my previous memo to Council dated April 30, 1996 regarding the above referenced subject, Staff hereby offers this report highlighting the noteworthy economic changes between the 1995 Contract and the Contract introduced to Council at the May 6, 1996 Council Meeting. HIGHLIGHTS Wat:es (Article 19) - . The annual wage rates depicted in Section 19,1 represent of a 4% increase in ~ 1996, a 4% increase in 1997, and a 4% increase in 1998. . The Longevity Pay schedule depicted in Section 19.5 reflects a $50.00 annual increase at the 7-10 years of service level; a $50.00 annual increase at the 11-14 years of service level; and a $50.00 annual increase at the 15-19 years of service level. It should also be noted that at the 4-6 years of service level and the 20 or more years of service level, there is no increase in payment amounts from the 1995 Contract. . The Shift Differential rates depicted in Section 19.6 represent a ,05/hour increase in 1996 and 1997, and a ,lO/hour in 1998 when compared to 1995 shift differential rate of .50/hour. - Page 2 Uniform/"Plain Clothes" Allowances (Article 22) . The $675.00 annual Uniform and "Plain Clothes" Allowances depicted in Sections 22.4 and 22.5 represent an increase of$50.00 above the $625.00 level in 1995. ~ Vacation Leave (Article 23) ~'4 The Vacation Leave accrual schedule depicted in Section 23.3 reflects an increase . of 8 hours annually at the 11-15 years of service level; an increase annually of 8 hours at the 16-20 years of service level; and an increase annually of 8 hours at the 21 or more years of service level. It should also be noted that at the 0-1 year of service level, the 2-4 years of service level, and the 5-10 years of service level, there are no increases in vacation accrual compared to the 1995 Contract. Insurance (Article 26) . The Medical Insurance general co-insurance provision in Section 26.1 has been increased from 80/20 to 90/10. (City's share is increased from 80% to 90%; employee's share is decreased from 20% to 10%.) . The Life Insurance amount depicted in Section 26.4 represents a $10,000.00 increase in coverage over the 1995 Contract level. Sick Leave (Article 27) . The maximum number of hours an employee can convert to cash upon layoff or - retirement in Section 27.3 has increased from 480 in the 1995 Contract to 540 in the new Contract. - Tuition Reimbursement (Article 30) . The $2,500.00 annual Tuition Reimbursement amount depicted in Section 30.2 represents a $400,00 annual increase over the 1995 Contract level. CONCLUSION When considering the modest increases in the above referenced areas together with the many areas which experienced no increase, Staff believes that the proposed new Contract as a whole is a fair contract to both parties, The above referenced increases place the City in a competitive (but not overly competitive) position with respect to the comparables within the Central Ohio area. Through the entire negotiation process, Staff charted wage and benefit data for these comparables in order to maintain a frame of reference, and in so doing, Staff feels confident that the increases that were negotiated are indeed fair and reasonable, - Page 3 Please note that as indicated in my previous memo to Council dated April 30, 1996, Staifis recommending that the new Contract be adopted by emergency legislation at the May 20, 1996 Council Meeting.
