AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR PROCUREMENT OF SAID ....... EQUIPMENT, AND DECLARING AN EMERGENCY. WHEREAS, after conducting formal advertising and competitive bidding procedures for recycling containers; and, WHEREAS, Council has determined that bids submitted by the Tulip Corporation for said equipment constitute the lowest and best bid, in the total amount of$55,000.00; WHEREAS, in the interest of preserving the public health, safety, and welfare, Council desires that these components be purchased and distributed to the citizens of Dublin in an expeditious manner; and, WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or resolution adopted by a vote of at least two-thirds of its members, to authorize, without advertising and competitive bidding, contracts or expenditures for any purpose where the statutory or common law of Ohio does not require competitive bidding; and, WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of a City to authorize, by a two-thirds vote of its members elected thereto, the City Manager, ,...... or other duly authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with ........ the operation of any department, division, commission, bureau, or board of the municipality; and, NOW, (;EREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring: Section 1. That the bid submitted by the Tulip Corporation for said supplies, in the amount of$55,000.00, is hereby accepted. Section 2. That the City Manager is hereby authorized to enter into a contract with the Tulip Corporation for the procurement of said supplies as specified above and within said bidder's bid proposal on file in the Division of Personnel and Purchasing. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public health, safety, or welfare in that the implementation of the City- wide recycling program, as scheduled, requires immediate ordering of the items specified in the Tulip Corporation bid. Harding, Director of Personnel and Purchasing ~ Attached for your consideration please find Ordinance No. 34-96 accepting the lowest and best bid for recycling containers for the City of Dublin Department of Service. Also attached for your review is a copy of the bid tabulation. This bid project involves the purchase of recycling containers, with lids, for the City-wide recycling program. Prior to seeking formal bids for this project, the Department of Service compared and tested recycling containers and developed detailed specifications based on functionality in connection with the operation of the recycling program. As a result of this early research by the Department of Service, a detailed specification for a 14 gallon container was developed. The Department of Service, as reflected in the bid documents, allowed for the consideration and proposal of alternate containers which deviate from the detailed specification. As reflected in the attached bid tabulation, the City received bid proposals from the following vendors: * Busch Systems International * Rehrig Pacific Company * Tulip Corporation Busch and Rehrig Pacific proposed alternate containers. The Department of Service, during their evaluation, found that the alternate containers, proposed by Busch Systems and Rehrig Pacific Company, do not meet the - detailed specification for recycling containers, as identified in the bid documents. Specifically, the Busch container lacks handles, cross stacking capability, hooks, recessed drainage of at least 16 ounces, an extra .." capacity lid, the ability to accept up to three lock-in dividers and a reinforced bottom of 150 mils (minimum) to 1 protect from cement wear. The Rehrig Pacific container lacks two of the four handles and an extra capacity lid, as required by the detailed specifications. Further, the lid proposed by Rehrig Pacific is ergonomically troubling in comparison to the specified container. The Tulip Corporation proposed a recycling container meeting all requirements of the bid document. Award conditions in the bid documents require that a single award be made on the basis of the lowest and best bid submitted. In the:final analysis, Staff believes that the bid submitted by the Tulip Corporation is the lowest and best bid and, therefore, recommends that said bid be accepted. Please note that Ordinance No. 34-96 has been drafted as emergency legislation. Given that the Department of Service has concerns regarding the time frame for delivety of the recycling containers in respect to the time frame for the implementation of the City-wide recycling program, Staff asks Council to consider passing this legislation as an emergency measure at the initial reading on March 18, 1996.
