AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT A
PROPOSAL TO ENCLOSE THE DRAINAGE DITCH, TO INSTALL CURB AND
GUTTER AND A SIDEWALK OR BIKEWAY ON THE NORTH SIDE OF TUTTLE
CROSSING BOULEVARD FROM FRANTZ ROAD ON THE EAST TO THE
.~ TUTTLE CROSSING INTERCHANGE ON THE WEST, WAIVING FORMAL
BIDDING AND ADVERTISING REQUIREMENTS AND DECLARING AN
...... EMERGENCY.
WHEREAS, The Taubman Company (the Developer) is currently completing site work for the
construction of The Mall at Tuttle Crossing which is located within the City of Columbus, and
WHEREAS, the Developer was required to make infrastructure improvements in the area,
including the widening of Tuttle Crossing Boulevard on the south side from Frantz Road on the
east to the Tuttle Crossing interchange on the west, which is also in the City of Columbus, and
WHEREAS, the north side of Tuttle Crossing Boulevard, which is located in the City of
Dublin, was not constructed with an enclosed drainage ditch, curb and gutter, and sidewalk or
bikeway, and
WHEREAS, enclosing the drainage ditch and constructing a sidewalk or bikeway on the north
side of Tuttle Crossing Boulevard will provide for safer pedestrian traffic, and
WHEREAS, construction coordination and cost savings can be realized by initiating the
improvements on the north side of Tuttle Crossing Boulevard while the required infrastructure
improvements are being installed by the Developer on the south side of Tuttle Crossing
Boulevard, and
1""''''- WHEREAS, the Developer has completed an engineering design estimate for the improvements
on the north side of Tuttle Crossing Boulevard and the City Engineer has reviewed and agrees
....."'.. with the engineering design estimate, and
WHEREAS, based upon the City Engineer's agreement with the design estimate, the City has
previously appropriated $80,000 , and
WHEREAS, Section 8.02 (b) of the Dublin Charter and Section 735.051 of the Ohio Revised
Code enables City Council as the legislative authority, by a two-thirds vote of its members
elected thereto, to enter into a contract without formal bidding and advertising.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, 7 of the elected members concurring:
Section 1. That pursuant to Section 8.02 (b) of the Dublin Charter and Section 735.051 of the
Ohio Revised Code, the formal bidding and advertising requirement for the improvements to
Tuttle Crossing Boulevard be waived.
Section 2. That the City Manager be and hereby is authorized to enter into a contract for
improvements on the north side of Tuttle Crossing including enclosure of the ditch, installing
curb and gutter and installing a sidewalk or bikeway.
",.... Section 3. That the Director of Finance is hereby authorized to make payment to the Developer
for the costs of the improvement described above upon approval of the City Engineer.
...... Section 4. That this Ordinance be and hereby is declared to be an emergency in order to provide
for safer pedestrian traffic on Tuttle Crossing Boulevard and to be able to meet the availability
and time schedule of the Developer, and therefore shall take effect and be in force immediately
upon its passage..
