Form No, 30043 112-96 Passedm.m... .__.umumu__m__um.__... ..19m._.u Ordinance No ..mmu.m.u..m.u AN ORDINANCE AMENDING ORDINANCE 52-96 TO REVISE THE FEE FOR A GARAGE SALE PERMIT IN APPENDIX A OF THE SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF DUBLIN SERVICES AND DECLARING AN EMERGENCY, - WHEREAS, the City of Dublin, Ohio has adopted Ordinance 52-96 on August 5, .... 1996, which established its policy as to the recovery of costs and more particularly the percentage of full costs to be recovered vom users of the City services and established a schedule of fees and charges for City services which complied with the policy set forth in that Ordinance; and, WHEREAS, the fee for a garage sale permit was listed in the Schedule of Fees and Service Charges as $5.00 (five dollars); WHEREAS, the $5.00 (five dollar) fee included $2.00 (two dollars) for processing and $3.00 (three dollars) for 3 (three) City provided signs at their actual cost, the intent of which is to comply with the City's adopted Sign Code; and WHEREAS, after consideration by the City and input from the Community, it is necessary to amend the schedule of fees and charges for City services; and NOW, THERE7RE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, members of the elected officials concurring: ",... Section 1. Appendix A of Ordinance 52-96 is hereby amended to read as follows: ...... APPENDIX A - SCHEDULE QF FEES AND SERVICE CHARGES Percentage of Full Costs Regulation. Section 2. That the fee schedule identified in Section 1 be effective pursuant to the policies and procedures identified in Ordinance 52-96. Section 3. EFFECTIVE DATE That this Ordinance is declared to be an emergency measure necessary to ensure the health, safety and welfare of the residents of the City of Dublin, and for the further reason that the amended fee be in effect by January 1, 1997 to correspond with the effective date of the schedule offees and charges for City services adopted by Ordinance 52-96. Hansley, City Manager - Subject: Ordinance 112-96 Regarding a Change in the Fee For a Garage Sale Permit Date: December 9, 1996 Initiated By: Marsha Grigsby, Director of Finance Melody Kennedy, Financial Analyst Ordinance 52-96, adopted by City Council on August 5, 1996 set forth the schedule of fees and service charges for City of Dublin services and the percentage of cost recovery desired from each City service. Ordinance 112-96 proposes a change in the fee for a garage sale permit. During the Cost Study Workshops this past summer, the fee for a garage sale permit was discussed at some length. Currently, the fee for a garage sale permit is $2, with a cost recovery of about 18%. The Department of Finance recommended there be no change in the fee for 1997. The Division of Planning made a case that, currently, garage sale signs do not conform with the City's Sign Code. In order to comply, it was recommended that a permit be $5, and would include three (3) City provided (temporary) signs (each sign has an actual materials cost of roughly $1.) The $5 fee was adopted as part of Ordinance 52-96. In order to promote community awareness of the change in the garage sale permit fee (effective January 1, 1997), we have made public notice in a newspaper article in the Dublin News (September - 4, 1996) and an article in the November/December issue of Inside Dublin. To-date, we have had a positive response from City residents with regard to the City having garage sale signs available for ...... purchase. However, the City's Code Enforcement Officer has received some input from community homeowners' associations requesting group rates due to the fact that they will not be needing three signs with each permit. Currently, there is no provision in Ordinance 52-96 to deviate from the adopted fee of$5, which includes the three signs. After consideration, the Code Enforcement Officer also feels it would be more beneficial, from a code enforcement standpoint, to limit the amount of garage sale signs displayed when possible. To respond to this, we are recommending a change in the schedule offees for a garage sale permit from $5 to $2 for each permit, plus $1 for each sign to a maximum of three (3) signs per permit (as stipulated in the City's Sign Code.) By doing this, each permit holder has the option of purchasing the amount of signs they feel they will be using.
