AN ORDINANCE V ACA TING SURPLUS
WILCOX ROAD RIGHT-OF-WAY

WHEREAS, the City Engineer of the City of Dublin has expressed a desire to vacate
surplus Wilcox Road right-of-way; and
WHEREAS, Council further finds that there is good cause for such vacation of the
surplus right-of-way and that such vacation will not be detrimental to the general interest
of the City of Dublin.
NOW, THG~FORE, be it ordained by the Council of the City of Dublin, Slate of
Ohio, I- of the elected members concurring:
Section 1. That a portion of the Wilcox Road right-of-way, located
in the east-west portion south of Tuttle Road, is hereby vacated to the
adjoining tax parcels according to Ohio Revised Code Chapter 711,
provided however, that the City reselVes a permanent access and utility
easement therein for the purpose of installation, maintenance and
,... operation of various public utilities, publicly owned or otherwise. The
, portion of the Wilcox Road right-of-way to be vacated is more fully
......., described in the legal description included on the vacation plat attached
hereto.
Section 2. That the City Engineer be, and hereby is, directed to cause
said vacation plat to recorded at the Office of the Franklin County
Recorder.
Section 3. That the Clerk of Council be, and hereby is, directed to
notify the Auditor of Franklin County of the vacation, by forwarding a
copy of this Ordinance thereto.
Section 4. That this Ordinance shall take effect and be enforced from
the earliest period allowed by law.

Please find attached a copy of a right-of-way vacation plat and the necessary vacation ordinance for
City Council action.
With the City's realignment of Wilcox Road at Tuttle Road in 1992, a portion of the old alignment
of Wilcox Road was removed from service and serves no further to the City for roadway purposes.
Please note that the ordinance is worded such that a utility easement is still reselVed over the area
of right-of-way to be vacated to preserve easement for any private utilities which may remain within
the vacated right-of-way. According to Ohio Revised Code Chapter 711, vacated public right-of-
way will be split and combined with the adjoining tax parcels.
Please schedule this for City Council action at the earliest possible convenience. Once Council has
approved the vacation plat, we will proceed with recording.

As you requested, attached is an excerpted view of the pending Right-of-Way Vacation Plat for
Wilcox Road showing the City's corporate boundary. Please note that the corporate boundary,
indicated by a bold line, follows the southerly right-of-way line of Wilcox Road and does not
include the cUlVed portion as depicted by a hatching pattern. That portion of Wilcox Road right-
of-way is located within the corporate boundaries of the City of Columbus and shall require
formal vacation action by its City Council.
