Form No. 30043 Ordinance No.__-- 29-97__ Passed_ --------19 -- AN ORDINANCE TO APPROPRIATE A COMBINED 0.655 ACRE TEMPORARY CONSTRUCTION EASEMENT, A COMBINED 1.53 ACRE FEE SIlVIPLE INTEREST, A COMBINED 0.516 PERMANENT UTILITY EASEMENT, AND A 0.024 STORM DRAIN EASEMENT IN PROPERTY OWNED BY THE ESTATE OF FRANK F THOMAS, MARIAN THOMAS, DOROTHY THOMAS AND BANCOHIO NATIONAL BANK NKA NATIONAL CITY BANK, LOCATED ON THE NORTH AND SOUTH SIDES OF PROPOSED EMERALD PARKWAY AND THE NORTH AND SOUTH SIDES OF PERIl~~TER DRIVE, IN THE CITY OF DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO, TO AMEND THE ANNUAL APPROPRIATIONS BUDGET AND DECLARING AN EMERGENCY. WHEREAS, the City of Dublin is preparing to improve and widen Coffman Road; and, WHEREAS, said improvement will require the City of Dublin to obtain a temporary construction easement and a fee simple interest in and to the premises described in the attached Exhibits "A", "B", "C", "D", "E", "F", "G", "H", "I", "7", "K", "L" and "M", located in the City of Dublin, Franklin County, Ohio. NOW, TH~FORE, BE IT ORDAINED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. A temporary construction easement and a fee simple interest in and to the premises located in the City of Dublin, Franklin County, State of Ohio, and more fully described in the legal descriptions attached hereto as Exhibits "A", "B", "C", "D", 'B", "F", "G", "H", "I", "7", "K", "L" and "M" are hereby appropriated for the public purpose of improving and widening Coffman Road, pursuant to Ohio Revised Code Chapter 163 and the Constitution of the State of Ohio. Section 2. Council hereby faces the value of the interests appropriated at Two Hundred and Sixty-Six Thousand and 00/100 Cents ($266,000.00), which sum shall be deposited with the Franklin County Common Pleas Court for the use and benefit of the owners of the property appropriated. Upon such deposit, the City of Dublin shall take possession of and enter upon the property pursuant to law. Section 3. Council finds that the appropriation is necessary for the stated purpose, that the City has been unable to agree with the owner of the property as to appropriate compensation, and that the City intends to obtain immediate possession of the property. Section 4. The City Law Director is directed to file a petition for appropriation in the Franklin County Common Pleas Court, to have a jury impaneled to assess the compensation to be paid for the real estate herein described above. Section 5. That there be advanced from the General Fund the amount of $266,000.00 to the Perimeter Center TIF Fund for the purpose of right of way acquisition. This advance will be subsequently reimbursed from service payments in lieu of taxes that will be received as identified in the Perimeter Center Tax Increment Financing Agreement. Section 5. That there be appropriated from the unappropriated balance in the Perimeter Center TIF Fund the amount of $266,000.00 to account 56-03-14-2510 for right of way acquisition. This ordinance is hereby declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare. The reason for such necessity is that the prompt improvement and widening of Coffman Road is necessary to improve traffic circulation and relieve traffic congestion for the citizens of Dublin.
