AN ORDINANCE TO ACCEPT AN ANNEXATION OF
1.08+/- ACRES IN WASHINGTON TOWNSHIP,
FRANKLIN COUNTY TO THE CITY OF DUBLIN
(Bonnallie M. Roberts, 7595 Bellaire Avenue)
WHEREAS, the proposed annexation has been approved by the
Franklin County Commissioners, and Council is of the opinion
that this territory should be annexed.
NOW, THEREFORE BE IT OR AINED by the Council of the City of
Dublin, State of Ohio, ~ of the elected members concurring:
Section 1. That the petition for the annexation of 1.08+/-
acres (see attached legal description) to the City of Dublin,
Ohio is hereby accepted.
Section 2. That this Ordinance shall take effect and be in
force from and after the earliest period allowed by law.

WASHINGTON TOWNSHIP TO THE CITY OF DUBLIN, OHIO

FIXED FOR WEDNESDAY, DECEMBER 4, 1996 AT 10:00 A.M.

WHEREAS, the Board of County Commissioners of Franklin County, Ohio, are presented the
petition for annexation of certain adjacent territory to the City of Dublin, Ohio, filed by Bonnallie M.
Roberts, signed by Bonnallie M. Roberts and appointing Barbara A. Roberts, as agent for the said territory
being described as follows:
Situated in tl7e State of Ohio, County of Franklin, Virginia Military Lands, Washington Township,
and being all of Lvt Number 7 of Dublin Estates Subdivision, as said lot is numbered and delineated upon
the recorded plat thereof, of record in Plat Book 27, Page 49A, Recorder's Office, Franklin County, Ohio,
and known as 7595 Bellaire Avenue, Dublin, Ohio 43017, and being more particularly described as
follows:
Beginning at a point at the northwest corner of the said Lot Number 7, and the southwest corner
of Lot Number 6, also being a corner in the existing City of Dublin Corporation Line as established by
Ordinance Number 60-93 and shown of record in O.R. 24364 A05;
Thence easterly, a distance of 342.69 feet, more or less, along the north property line of said Lot
Number 7, to the northeast comer of Lot Number 7;
Thence southerly, a distance of 149.50 feet, more or less, along and with the right-of-way of
Bellaire Avenue, to a point being at the southeastern comer of said lot;
thence westerly, a distance of 306.44 feet, more or less, to a point. at the southwesterly corner of
said Lot Number 7 and the easterly property line of Lot Number 4 of said Subdivision;
thence northerly, a distance of 1.40 feet, more or less, to the point of beginning, containing 1.08
acres, more or less.
WHEREAS, together with a map of said territory accompanying said petition filed with the Board
of County Commissioners, Franklin County, Oleo, on October 2, 1996, be and the same are hereby filed
with the Franklin County Zoning Office;
WHEREAS, the Ohio Revised Code in Section 709.031 stipulates that the County Commissioners
can ask the County Engineer for a report on the accuracy of the map or plat; now, therefore, upon the
motion of Commissioner Shoemaker ,seconded by Commissioner Teater ;
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That a hearing upon said petition shall be held in the County Commissioners'
Hearing Room, 26th Floor of the Franklin County Courthouse at 10:00 A.M. on
December 4, 1996; and
Section 2. That the Zoning Director to the Board of County Commissioners be and
hereby is directed to notify the agent of the petitioners of the time and place of said
hearing; and
Section 3. That the map or plat of Bonnallie M. Roberts is hereby referred to the County
Engineer of Franklin County, Ohio, for the checking of its accuracy of description.

A RESOLUTION TO SET FORTH A STATEMENT
OF SERVICES TO BE PROVIDED TO THE AREA
IN A PROPOSED ANNEXATION OF 1.08+/- ACRES
FROM WASHINGTON TOWNSHIP, FRANKLIN COUNTY
TO THE CITY OF DUBLIN, OHIO AS REQUIRED
BY SECTION 709.031 OF THE OHIO REVISED CODE

WHEREAS, a petition for the annexation of 1.+/- acres from
Washington Township was duly filed by Barbara A. Roberts on
behalf of Bonnallie M. Roberts, 7595 Bellaire Avenue, Dublin,
Ohio; and
WHEREAS, a public hearing has been scheduled by the Franklin
County Commissioners at 10:00 a.m. on Wednesday, December 4,
1996; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires
that, prior to said hearing, the Municipal Authority shall
adopt a statement indicating what services, if any, the
Municipal Corporation will provide to the territory proposed
for annexation;
WHEREAS, Dublin City Council adopted an interim annexation
policy on June 20, 1994 to provide policy directive regarding
proposed annexations to the City of Dublin.
NOW, THEREFORE, BE IT RESOLVED by Council of the City of
Dublin, State of Ohio, ~ of the elected members
concurring:
Section 1. The City of Dublin will provide the following
municipal services for the 1.08+/- acres in Washington
Township, Franklin County if the subject property is annexed
to the City of Dublin, Ohio:
Police. The City provides Police and Communications
service on a full twenty-four hour basis and also has
mutual aid agreements with other municipalities. The
annexation area lies approximately two miles east of
Dublin's Police Division Headquarters. Dublin operates
with a minimum of three cruisers on duty. A response
time of approximately five minutes for an emergency
situation should be expected for this area.
Fire. Fire protection is currently provided by well-
staffed departments in Washington and Perry Townships.
They, too, have mutual aid agreements with other
municipalities. This annexation would not change fire
department jurisdictional boundaries, and therefore
response times for fire and emergency medical services
will not be affected. The Washington Township Fire
Station is approximately one and one-half miles from the
annexation area and normal response times should be
approximately three minutes.
Sanitation. Residential refuse collection services are
contracted by the City and are currently provided at no
additional charge.
Street Maintenance. The City has a Street Maintenance
Department which provides excellent service in the area
of street and road maintenance. This department also
provides curbside leaf pick-up at no additional charge.

Section 2. The City has SEWER and WATER service area
contracts with the City of Columbus, and the subject property
is within said service areas, and conditioned on the ability
of the City of Columbus to provide WATER, and to provide
sufficient SEWERAGE disposal capacity, the City will have the
ability to service the area.. Water and sewer lines are
accessible to the subject property.
section 3. The proposed annexation appears to be consistent
with the City's adopted interim annexation policy.
section 4. This Resolution shall take effect immediately upon
passage as provided under Section 4.04. (a) of the Revised
Charter.

OF BONNALLIE M. ROBERTS OF 1.08+
ACRES IN WASHINGTON TOWNSHIP TO
THE CITY OF DUBLIN, OHIO

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeded on the 4th day
December, 1996 to hear the petition of Bonnallie M. Roberts, filed October 2, 1996, and having in open
hearing heard all of persons desiring to be heard for or against the granting of the petition, and having
considered all the facts with reference thereto, being fully advised, and
WHEREAS, the Commissioners make the following findings, based upon the exhibits and
testimony presented at the hearing of this matter:
1. The Petition contains all of the matters required by Ohio Revised Code
Section 709.02 including, without limitation: A. A full description and
accurate map or plat of the territory to be annexed; B. A statement of the
total number of owners of real estate in the territory to be annexed; C.
The name of the person to act as agent for the petitioner.
2. The territory sought to be annexed is adjacent and contiguous to the Ciry
of Dublin, Ohio.
3. Notice of the petition and the hearing has been published as required by
law, and all notices of filing the petition and the hearings thereon have
been given and delivered as required by law.
4. The persons whose names are subscribed on the petition are owners of
real estate in the territory sought to be annexed, and as of the time the
petition was filed, the number of valid signatures on the petition
constituted a majority of the owners of real estate in the territory
proposed to be annexed.
5. The map or plat and the description of the territory contained in the
petition are accurate.
6. The City of Dublin has complied with Division (B) of Ohio Revised
Code Section 709.031.
7. The territory sought to be annexed is not unreasonably large.
8. The general good of the territory sought to be annexed will be served if
the annexation petition is granted and the annexation is allowed.
Therefore, upon the motion of Commissioner Teater ,seconded by Commissioner
Shoemaker
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
That the prayer of the Petition be GRANTED, and the territory sought to be annexed by
the petition filed herein be annexed to the City of Dublin, Ohio, in accordance with the
law; that the orders and proceedings of this board relating to the Petition, and map and
descriprion attached thereto, and all papers on file relating to this matter be delivered
forthwith to the Clerk of Council, Ciry of Dublin, Ohio.

Dear Ms. Roberts:
Enclosed is a copy of the resolution adopted on October 15, 1996, by the Board of County
Commissioners, setting the time and place of public hearing for the annexation petition which you, as
agent, filed with this office on October 2, 1996.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you, as agent, are
responsible for the following:
(1) Notification of the date of filing of your petition with the Board of County Commissioners
to be delivered to the Clerk of the municipality to which annexation is proposed and the
Clerk of each township which is included in the annexation. (A map, description and a
copy of the petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four consecutive weeks in a
newspaper of general circulation in the County. (The enclosed resolution will satisfy the
statutory requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the notice within seven (7)
days after the Franklin County Commissioners set the date for the public hearing on the
annexation petition, is on or before October 22, 1996. (The enclosed resolution will satisfy
the statutory requirements and should be used to serve the clerks).

(4) Preparation of an affidavit stating the name of the agent, the number of owners of real
estate at the time of the filing of the petition and the number of owners s boning the
petition.
(5) Ensuring that the legislative body of the municipality to which the annexation is proposed,
by ordinance or resolution, adopts a statement indicating what services, if any, the
municipal corporation will provide to the territory proposed for annexation, upon
annexation. (The resolution or ordinance should include response times for fire, EMT and
police units as well as information concerning water and sewer hook-ups and other
pertinent data).
(6) The Agent or Representative of the petitioners needs to be present at the hearing to
present the petition to the Board of County Commissioners.
Proof of compliance with the above is required to be submitted to this office no later than November 20,
1996.
