Form No. 2806-A Ordinance No .----60-8-1---------- P assed_____u________________________________n__ ____19 ____. __ AN ORDINANCE TO AMEND SECTION 1313 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF DUBLIN, OHIO, REGARDING EMERGENCY FLOOD CONTROL WHEREAS, it is necessary to minimize public and private losses due to flood conditions; and WHEREAS, revisions to the Code are required to meet the requirements of Section 60.3(d) of the National Flood Insurance Program's Flood Plan Management regulations; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 6 of the elected members concurring that the follow- ing revisions be made to the Dublin Codified Ordinances: Section 1. 1313.02 Definitions Delete the following paragraphs: (f) "Existing mobile home park or mobile home subdivision" (g) "Expansion to an existing mobile home park or mobile home subdivision" (m) "Habitable floor" (n) "Mobile home" (p) "New mobi Ie home park or mobile home subdivision" Add the following: (k) "Lowest floor" means the lowest floor of the lowest enclo- sed area (including basement). An unfinished or flood resistant enclosure, usable solely for parking of vehicles, building access or storage, in an area other than a base- ment area, is not considered a building's lowest floor. (1) "Manufactured home" means a structure, transportable in one or more sections, which is buil t on a permanent chassis and is designed for use with or without a permanent foundation when connected to the required utilities. It includes park trailers, travel trailers, and other similar vehicles placed on a site for greater than 180 consecutive days. (m) "Maunfactured home park or subdivision" means a parcel (or contiguous parcels) of land divided into two or more manufactured home lots for rent or sale. This definition sha 11 exclude any manufactured home park as defined in Section 3733.01 of the Ohio Revised Code, over which the Public Health Council has exclusive rule making power. Revise the following: (f) "Federal Emergency Management Agency" (FEMA) means the - agency with the overall responsibility for administering th p National Flood Insurance Program. (g) "Flood" or "flooding" means a general and temporary condition of partial or complete inundation of normally dry land areas from: (1) The overflow of inland or tidal waters; and/or (2) The unusual and rapid accumulation or runoff of surfac e waters from any source. (h) "Flood Insurance Rate Map" (FIRM) means an official map on - which the Federal Emergency Management Agency has delineate -1 both the areas of special flood hazards and the risk premium zones applicable to the community. . ~ RECORD OF ORDINANCES 427 National Graphics Corp., Cols., O. ~ Form No. 2806-A Ordinance N 0 ._______n?_~~I3?u__m Passedu________nn_____ ________n____mn_ _________19_____ -- Page Two (i) "Flood Insurance Study" means the official report in which the Federal Emergency Management Agency has provided flood profiles, as we 11 as the Flood Boundary and Floodway Map, and the water surface elevation of the base flood. (j) "Floodway" means the channel of a river or other water- course and the adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one-half foot. (n) "New construction" means structures for which the "Start of construction" commenced on or after the effective date of this chapter. (0) "Start of construction" means the date the building permit issued, provided the actual start of construction, repair, reconstruction, placement, or other improvement was within 180 days of the permit date. The actual start means either the first placement of permanent construction of a structure on a site, such as the pouring of slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation; or - the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and fill i ng ; nor does it include the installation of streets and/or walkways; nor does it include excavation for a basement, footings, piers, or foundations or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such .as garages or sheds not occupied as dwelling units or not part of the main structure. (E) "Structure" means a walled and roofed building, manufactured home, or gas or liquid storage tank that is principally above ground. (~) "Substantial improvement" means any repair, reconstruction or improvement of a structure, the cost of which equals or exceeds fifty percent (50';0 of the market value of the structure either before the improvement or repair is started, or if the structure has been damaged and is being restored, before the damage occurred. For the purposes of this definition "substantial improvement" is considered to occur when the first alteration of any wall, ceiling, floor or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure. The term does not, however, include either any project for improvement of a structure to comply with existing State or local health, sanitary, or safety code specifications which are solely necessary to assure safe living conditions, or any alteration of a structure listed on the National Register of Historic Places or a State Inventory of Historic Places. (r) "Variance" is a grant of relief to a person from the requirements of this chapter which permits construction in a manner that would otherwise be prohibited by this chapter. 1313.04(b) Revise Basis for Establishing the Areas of Special Flood Hazard The areas of special flood hazard have been identified by the Federal Emergency Management Agency in a scientific and engineering report ent it led "Flood Insurance Study for Dublin, Ohio". This study, with accompanying Flood Boundary and Floodway Maps and/or Flood Insurance Rate Maps dated September 4, 1985, and any revisions thereto is hereby adopted by reference and declared to be a part of this ordinance. Floodways are delineated in the Flood Boundary and Floodway Map or the Flood Insurance Rate Map of the Flood Insurance Study. Floodways may also be delineated in other sources of flood information. If the proposed development is located within a designated floodway, assure that the encroachment provision of Section 1313.1( (a) . 1313.06(b) Revise Use of Other Base Flood Elevation and Floodway Data Areas of special flood hazard where base flood elevation data have not been provided by the Federal Emergency Management Agency in accordance with Section 1313.04(b), BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD, are designated as Zone A on the community's Flood Insurance Rate Map. Within these areas, the Manager shall obtain, review and reasonably utilize any base flood elevation and floodway data available from a Federal, State, or other source, in order to administer Section 1313.09(a), SPECIFIC STANDARDS, Non-residential Construction; and 1313.10, FLOODWAYS. 1313 .06 ( c) Revise Information to be Obtained and Maintained. Where base flood elevation data are utilized within areas of special flood hazard on a community's Flood Hazard Boundary Map or Flood Insurance Rate Map, regardless of the source of such da_ta, the following provisions apply: (1) Obtain and record the actual elevation (in relation to mean sea level) of the lowest floor, including basement, of all new or substantially improved structures, and whether or not such structures contain a basement. (2) For all new or substantially improved flood-proofed structures: (A) verify and record the actual elevation (in relation to mean sea level) to which the structure was flood- proofed; and, (B) maintain the floodproofing certifications required in Section 1313.05(3). (3 ) Maintain for public inspection all records pertaining to the provisions of this ordinance. 1313 .06(e) Revise Interpretation of Flood Boundaries Make interpretations, where needed, as to the exact location of the boundaries of the areas of special flood hazards (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). Where a map boundary and elevations disagree, the elevations de lineated in the flood elevation profile sha 11 preva i l. The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation as provided in Section 1313.07. 1313 .08(a) Revise Anchoring (1) All new construction and substantial improvements sha 11 be anchored to prevent flotation, collapse, or lateral movement ", RECORD OF ORDINANCES 433 National Graphics Corp., Cols., O. ~ Form No. 2806-A Ordinance No ._______6Q___8_?mmn P assed_______ __u__ ______________n___________ __________19 _____ -- Page Four of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy. (2) All manufactured homes not otherwise regulated by the Ohio Revised Code pertaining to manufactured home parks sha 11 be anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy. Methods of anchor- ing may include, but are not to be 1 imited to, use of over- the-top or frame ties to ground anchors. 1313 .08 (b) Revise Construction Materials and Methods (1) All new construction and substantial improvements sha 11 be constructed with materials resistant to flood damage. (2) All new construction and substantial improvements sha 11 be constructed using methods and practices that minimize flood damage. (3) All new constructed and substantial improvements shall be constructed with electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities that are designed and/or located so as to prevent water from entering or accumulating within the components during condit ions of flooding. 1313 .08 ( d) Revise Subdivision Proposals (1) All subdivision proposals, including manufactured home sub- divisions, shall be consistent with the need to minimize flood damage; (2 ) All subdivision proposals, including manufactured home sub- divisions, shall have public utilities and facilities such as sewer, gas, electrical, and water systems located and constructed to minimize flood damage; (3) All subdivision proposals, including manufactured home sub- divisions, shall have adequate drainage provided to reduce exposure to flood damage; and, (4) Base flood elevation data shall be provided for subdivision proposals, including manufactured home subdivisions, and other proposed developments which contain at least 50 lots or 5 acres (whichever is less). 1313 .09(b)( l)C. Revise C. Be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting the standards of this subsection. Such certification shall be provided to the official as set forth in Section 1313.05(a)3. 1313.09(c) Revise Manufactured Homes The following standards shall apply to all new and substantially improved manufactured homes not subject to the manufactured home requirements of Section 3733.01, Ohio Revised Code. (1) Manufactured homes shall be anchored in accordance with Section 1313.08(a)(2). (2) Manufactured homes shall be elevated on a permanent foundatior such that the lowest floor of the manufactured home is at or above the base flood elevation. . , :'" RECORD OF ORDINANCES 4 3 7 National Graphics Corp., Cols., O. ~ Form No. 2806-A Ordinance No. _______?_?_-:_~_?_______ P assed____m_____ __n____________________n_ _____ ____19 ----- -- Page Five - 1313.09(d) Add Enclosures Below Base Flood Elevation The following provisions apply to all new and substantially- improved residential and nonresidential structures which are elevated to or above base flood elevation using pilings, columns, or posts or which contain a crawl space. These structures may enclose the area below the base flood elevation provided the following conditions are met: (1) Fully enclosed areas below the base flood elevation shall be designed to automatically equalize hydrostatic flood forces on esterior walls by allowing for the entry and exit of floodwaters. Designs for meeting this require- ment must: (a) be certified by a registered professional engineer or architect; or, ~~ 1 (b) must meet or exceed the following criteria: ~. Floodways may also be delineated in other ~l ~ i sources of flood information as specified in Section 1313.06(b). ~'! ~~ The floodway is an extremely hazardous area due to the velocity .;i~~ of flood waters which carry debris, potential projectiles, and ::El !!:~ erosion potential. Section 2.
