042-87 Ordinance - RECORD OF ORDINANCES - I National Graphics Corp., Cols., O. ~ Form No. 2806-A Ordinance No. ______4.2-~.JH______ Passed m__m_ ______mnm nnnmmmnn19_ AN ORDINANCE ADOPTING THE MEMORANDUM OF AGREEMENT BETWEEN THE VILLAGE OF DUBLIN AND SHERMAN SHELDON, AND DE- CLARING AN EMERGENCY. WHEREAS, Council has considered and approved the Memorandum of Agreement between the Village of Dublin and Sherman Sheldon, which is attached hereto and incorporated herein as Exhibit "A" as if fully rewritten. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 5 of the elected members concurring: Section 1. The Village Council hereby approves and adopts the Memorandum of Agreement between the Village of Dublin and Sherman Sheldon. Section 2. Due to the fact that the above referenced Memorandum of Agreement serves to fully release the Village of Dublin, its Council, and future Councils from all further obligations related thereto, this Ordinance is declared to be an emergency for the immediate preservation of the public health, safety and welfare and shall take effect and be in force immediately upon its passage. WHEREAS, Sherm Sheldon has served the Village of nublin since 1962 in various capacities including Councilman, Clerk/Treasurer, Village Administrator and Village Manager, and WHEREAS, Sherm Sheldon has worked untold hours not only faithfully performing the duties and responsibilities inherent to the said positions, but also various and sundry other duties in the service of the Village of Dublin, and WHEREAS, As a result thereof Sherm Sheldon has accumulated a significant amount of unpaid vacation leave, sick leave and comp time, WHEREAS, Council realizes that it is . .. 1 to ~mposs.lo....e calculate the value of Sherm Sheldon's years of dedicated service to the Village of Dublin, and WHEREAS, Council, nonetheless, recognizes its legal obligation to fairly compensate Sherm Sheldon, NOW THEREFORE, in full consideration thereof, the Council of the Village of nublin and Sherm Sheldon agree as follows: -1- ~ i , .. , . She~m Sheldon will be retained on the payroll of ". the Village of Dublin at his present salary and benefits through March 5, 1988. 2. Due to Sherm Sheldon's accumulated vacation leave, sick leave and comp time, no work or se~vices will be required of Mr. Sheldon during the period set forth in Item One herein, nor shall Mr. Sheldon be authorized to act in any official capacity for the Village of Dublin. 3. Further, to fairly and equitably compensate Sherm Sheldon for his accumulated comp time balance, on March 5, 1988, Dublin shall pay to Mr. Sheldon 25% of his accumulated comp time not previously used as of March 5, 1988. 4. It is the intent of Mr. Sheldon and Council that in consideration of the mutual covenants and promises set forth herein, that this agreement shall serve to fully release the Village of Dublin, its Council and future Councils, and Mr. Sheldon from all further obligations as relates to the provisions set forth herein. This Agreement shall be binding on and inure to the benefit of the parties hereto, the legal representatives, successors in interest, heirs and assigns, respectively, of each party.
