AN ORDINANCE TO ACCEPT A PETITION
FOR ANNEXATION TO THE VILLAGE OF
DUBLIN, OHIO, OF A 7.105~ ACRE
TRACT LOCATED IN WASHINGTON TOWN-
SHIP, FRANKLIN COUNTY.
WHEREAS, said annexation has been approved by the Franklin County
Commissioners; and,
WHEREAS, the Dublin Village Council is of the opinion that said
territory should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio, 5 of the elected members concurring.
Section 1. That the petition of Peter H. Edwards for the annexation
to the Village of Dublin, Ohio, of a 7.10S! acre tract in the County
of Franklin (see attached legal description hereby made an official
part of this Ordinance), with an accurate map and a certified transcript
of the proceedings of the Franklin County Commissioners, allan
file in the office of the Village Manager be, and the same hereby is,
accepted.
Section 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

Dear Mr. Smith:
Enclosed is a copy of the resolution adopted on November 18, 1986, by the Board of
County Commissioners, setting the time and place of public heari ng for the
annexation petition which you, as agent, filed with thi s offi ce on November 6,
1986.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised Code, you,
as agent, are responsible for the following:
(1) Notification of the date of fi 1 i ng of your petiti on with the Board of
County Commissioners to be delivered to the Clerk of the municipality to
which annexation is proposed and the clerk of each township which is
included in the annexation. (A map, description and a copy of the
petition should be presented to each clerk).
(2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the County.
(The enclosed resolution wi 11 satisfy the statutory requirements and
should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the notice
wit h i n seven (7) days after the Frankl in County Commi ssi oners set the
date for the public heari ng on the annexation petiti on, is before
November 25, 1986.
(4) Preparation of an affidavit stating the name of the agent, the number of
owners of real estate at the ti me of the fil i ng of petiti on and the
number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which the
annexation is proposed, by ordi nance or reso 1 uti on, adopts a statement
indicating what services, if any, the municipal corporation will provide
to the territory proposed for annexation, upon annexation.
Proof of compliance with the above is required to be submitted to this office no
later than December 31, 1986.

WHEREAS, a petition for the annexation of 7.105 acres from Washington
Township was duly filed by Harrison W. Smi th, Jr. , the Agent for the
petitioner; and
WHEREAS, a public hearing will be required before the Franklin County
Commissioners; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior
to said hearing, the Municipal Authority shall adopt a statement in-
I dicating what services, if any, the Municipal Corporation will provide
to the territory proposed for annexation:
NOW, THEREFORE BE IT RESOLVED by the Council of the Village of Dublin,
, State of Ohio, 7 of the elected members concurring:
i SECTION 1. That the Village of Dublin will provide the following municipal
services for the 7.105 acres in Washington Township-Franklin County upon
the annexation of said area to the Village of Dublin, Ohio:

! POLICE. The Village provides Police service on a full twenty-four hour
I, basis and communications are contracted from Perry Township. The Vi llage
also has mutual aid agreements with other municipalities.
~, Fire protection is currently provided by well staffed departments
FIRE.
in Washington and Perry Townships in Franklin County and Concord Town-
ship in Delaware County. They too have mutual aid agreements with other
~, munic ipa li ties.
SANITATION. Residential refuse collection services are contracted by the
\ Village and would be available.
STREET MAINTENANCE. The Village has a Street Maintenance Department which
provides excellent service in the area of street and road maintenance.

I SECTION 2. The Village has SEWER and WATER service area contracts with
the City of Columbus and the subject property is within said service
area's and, conditioned on the ability of the City of Columbus to provide
WATER and, to provide sufficient SEWERAGE disposal capacity, the Vi llage
will have the ability to service the area.
SECTION 3. That this Resolution shall take effect and be in force from
and after the earliest period allowed by law.

TOWNSHIP OF WASHINGTON
TO THE BOARD OF COUNTY COMMISSIONERS
OF FRANKLIN COUNTY, OHIO:
The undersigned, petitioners in the premises, and being a
MAJORITY OF OWNERS OF REAL ESTATE in the territory hereinafter
described, consisting of 7.105 acres, more or less, in
the Township of Washington , which area is contiguous
and adjacent to the Vlllage ot Dublln , do hereby pray
that said territory be annexed to the Village of Dublin ,
according to the statutes of the State of Ohio.
A full and accurate description and a plat of said territory
so prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners state that there
are within the territory so prayed to be annexed 1 OWNERS
OF REAL ESTATE.
Harrison W. Smith, Jr. , is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the
Revised Code of Ohio. Said Agent is hereby authorized to make
any amendment and/or deletion which in his absolute and complete
discretion is necessary or proper under the circumstances then
existing, and in particular to make such amendment in order to
correct any discrepancy or mistake noted by the Franklin County
Engineer in this examination of the Petition and Plat. Said
amendment shall be made by the presentation of an amended plat
and description to the Board of County Commissioners on, before,
or after the date set for hearing on this Petition.

situate in the state of Ohio, County of Franklin, Township
of Washington, being in Virginia Military Survey Number 2419,
being part of 42.373 acre tract conveyed to Peter H. Edwards by
deed of record in OR7009D14, and being part of the original
87.394 acre tract conveyed to The Borror corporation formerly
Beasley Industries, Inc. by deed of record in O.R. 4445G06,
records of the Recorder's Office, Franklin County, Ohio and being
more particularly described as follows;
Beginning at a point in the northerly right-of-way line of
Tuttle Road (being 30.00 feet northerly of, as measured by right
angles, the centerline thereof) being in the easterly line of
said 42.373 acre tract, in the westerly line of the Llewellyn
Farms, Ltd. original 43.624 acre tract beirig at an angle point in
the existing corporation Line of the Village of Dublin as
established by Ordinance Number 49-80 shown of record in OR505C10
and being at an angle point for the pending Annexation to the
village of Dublin;

Thence S 780 46' 13" W, a distance of 450.03 feet along said
southerly right-of-way line of Tuttle Road and along said
existing Corporation Line of(~he City of Columbus, to a point;
Thence N 120 07' 10" W, a distance of 744.41 feet parallel
with the common line of said 42.373 and 43.624 acre tracts,
