AN ORDINANCE TO VACATE A .997
ACRE PORTION OF TULLER ROAD
AND TO DECLARE AN EMERGENCY.
WHEREAS, Council has accepted a plat to relocate Tuller Road; and
WHEREAS, the owner of the contiguous properties is also the developer
responsible for constructing relocated Tuller Road;
NOW, THEREFORE, BE IT ORDANED by the Council of the Village of Dublin,
State of Ohio, 7 of the elected members concurring, that:
Section 1. That a 0.997 acre portion of Tuller Road as described in
the attached legal description, Exhibit A, be, and hereby is vacated.
Section 2. That this Ordinance is hereby declared to be an emergency
measure necessary for the immediate preservation of the public peace,
health, safety and/or welfare, it shall take effect immediately after
passage and approval by the mayor; otherwise it shall take effect and
be in force from and after the earliest period allowed by law.

DESCRIPTION OF A 00997 ACRE PORTION OF
TULLER ROAD, A DEDICATED PUBLIC STREET, TO BE
VACATED, LOCATED SOUTH OF INTERSTATE ROUTE 1-270
AND WEST OF SAWMILL ROAD, IN THE VILLAGE OF
DUBLIN, COUNTY OF FRANKLIN, STATE OF OHIO
situated in the State of Ohio, County of Franklin, Village
of Dublin, being in Quarter Township 2, Township 2, Range 19,
United States Military Lands, being a 0.997 acre area of land,
more or less, part of said 00997 acre area of land being in Lot
Noo 1 as the same is numbered and delineated upon the recorded
plat of the Lands of Chauncey McGurer, of record in Plat Book
12, Page 27 and being a part of Tuller Road, sixty feet in
width, as said Tuller Road is shown and delineated upon the
recorded plat of Dublin Village Center (Dedication of Federated
Boulevard, Dublin Center Drive, Tuller Road and Easements), of
record in Plat Book 65, Pages 27 and 28, both being of record in
the Recorder's Office, Franklin County, Ohio, said 0.997 acre
area of land being more particularly described as follows:
Beginning, for reference, at the centerline intersection of
Tuller Road and Dublin Center Drive as said intersection is
shown and delineated upon said recorded plat of Dublin Village
Center; thence S-86024'12"E, with the centerline of said Dublin
Center Drive, a distance of 54.03 feet to a point; thence
N-3035'48"E, a distance of 50.00 feet to a 3/4-inch (I.D.) iron
pipe at the true point of beginning, the same being a point of
curvature in the northerly right-of-way line of said Dublin
Center Drive; ,
Thence, from said true point of beginning, N-86024'12"W,
parallel with and 50000 feet northerly from, as measured at

We hereby certify that the foregoing description was
prepared from information obtained from actual field surveys
conducted by Bauer, Davidson & Merchant, Inc. in September of
1985 and in November of 19860
. All of the iron pipe survey markers noted in the foregoing
, description were in place in November of 1986.
The bearings given in the foregoing description correspond
to the bearings given for the centerline of survey made by the
Ohio Department of Highways for Interstate Route 1-270
(FRA.-270-10.33 N).

SUBJECT: Tuller Road Vacation
DATE: February 24, 1987
Council accepted a plat as approved by the Planning Commission to relocate Tuller
Road. Tuller was moved from its platted location because the limited access
right-of-way along Sawmill could not be vacated. When the latest plat was accepted,
the paperwork did not include the vacation of the previously platted right-of-way.
This Ordinance is not to vacate what was the old traveled Tuller roadway. The
only thing being vacated is the first relocation attempt by the developer. Re-
located Tuller Road is now constructed and accepted 80' west of the right-of-way to
be vacated.
