WHEREAS, Council has accepted a plat to relocate Tuller Road; and WHEREAS, the owner of the contiguous properties is also the developer responsible for constructing relocated Tuller Road; NOW, THEREFORE, BE IT ORDANED by the Council of the Village of Dublin, State of Ohio, 7 of the elected members concurring, that: Section 1. That a 0.997 acre portion of Tuller Road as described in the attached legal description, Exhibit A, be, and hereby is vacated. Section 2. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and/or welfare, it shall take effect immediately after passage and approval by the mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law. '_ "'_.~ MEMORANDUH TO: Council Members FROM: Patrik Bowman SUBJECT: Tuller Road Vacation DATE: February 24, 1987 Council accepted a plat as approved by the Planning Commission to relocate Tuller Road. Tuller was moved from its platted location because the limited access right-of-way along Sawmill could not be vacated. When the latest plat was accepted, the paperwork did not include the vacation of the previously platted right-of-way. This Ordinance is not to vacate what was the old traveled Tuller roadway. The only thing being vacated is the first relocation attempt by the developer. Re- located Tuller Road is now constructed and accepted 80' west of the right-of-way to be vacated. PGB:fmu
