Reconsideration Case Rezoning Application Z86-006 - Brand Road and Dublin Road (Page 7 of Minutes of Meeting) Mr. Berlin moved to approve the rezoning application 286-006 with the following conditions: 1. With regard to the road beside the park, the Village would expect the developer and staff to make the decision on whether that should be a 36' roadway. 2. Would like to see a proper determination of the traffic study as to the relocation of Brand Road at the intersection, with the implications on traffic coming north and south, and for staff and the developer to agree on this location. 3. A commitment on the bike path on Dublin-Be1lpoint Road being worked out with the developer and staff on the premise that staff can decide what they want. 4. A commiment from the developer for additional right-of-way on S.R. 745 and Brand Road. 5. No storm water detention or retention in the park land. 6. The agreement that all of the above will be shown on the preliminary plat for the Commission's review. The applicant, represented by Mr. Hale, agreed to the above conditions. The proposed location and size of areas of residential use, indicating dwelling unit densities, dwelling unit types, the total number of dwelling units for each density area and the total number of dwelling units proposed in the development plan: . The proposed size, location and use of nonresidential portions of the tract, including usable open areas, parks, playgrounds, school sites and other areas and spaces with the suggested ownership of such areas and spaces: All as shown on the plan. The park land within the 9.77 acres denominated the "Starkey property" on the plan at the southwest corner of the site shall be dedicated to ., the Village of Dublin when the first residential lot within said 9.77 acres is platted. Such construction shall include an entry feature for the S.R. 745 entry. The cost of constructing such relocated Brand Road and entry feature shall be paid by the Village of Dublin. E. The proposed schedule of site development, construction of structures and associated facilities, including sketches and other materials indicating design principles and concepts to be followed in site development, construction, landscaping and other features. Such schedule shall include the proposed use or reuse of existing features such as topography. structures, streets and easements: The development will commence from whichever point of access onto Brand Road or S.R. 745 is serviceable first with sanitary sewer and water. The site will be developed in secitons of not less than 30 lots, and water, storm and sanitary facilities, will be extended to each lot upon development of that section. Each lot shall be entitled to one single-family house and appertenant facilities and structures. F. The relationship of the proposed development to existing - and future land use in the surrounding area, the street system, community facilities, services and other public improvements: 1. The proposal as indicated on the plan shows large lot single-family along the northern Brand Road frontage and eastern S.R. 745 frontage, which are compatible with the large lot residential character of those streets. A "no build" zone has been provided along the northern and eastern perimeter to assure adequate buffer setback from these roads. 2. The site abuts property with an anticipated use of oriented office along its south boundary, to which a buffer has been provided. 3. The park given as a part of the development as provided above will abut the western boundary of I I .. . ... the development, to which single family residential is very compatible and appropriate. 4. The street system is as shown on the plan, with one access point on to Brand Road and S.R. 745. S.R. 745 and Brand Road as an arterial and collector respectively, provide adequate access to the heart of the Village and the S.R. 33-161 corridor and I-270 interchange. There is also provided a street into the McKitrick office park. This street will provide access to the high school, municipal building and other areas of Dublin without the need # to use existing streets. 5. The site is adjacent to the high school and within minutes of virtually all pubic amenities avaialbe in the Village. G. Evidence that the applicant has sufficient control over the land to effectuate the proposed development plan.
