013-90 Ordinance -. - RECORD OF ORDINANCES Dayton Legal Blank Co, Form No. 30043 . 13-90 Ordinance No. __m_ Passed ._. ____., ______ __19_ AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT, WITHOUT ADVERTISING AND COMPETITIVE BIDDING, FOR THE PURCHASE AND IN- STALLATION OF PHASE II OF AN OUTDOOR EMERGENCY WARNING SYSTEM FOR THE CITY OF DUBLIN, AND DECLARING AN EMERGENCY. WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or resolution adopted by a vote of at least two-thirds of its members, to authorize, without advertising and competitive bidding, contracts and expenditures for any purpose where the statutory or Common law of Ohio does not require competitive bidding; and, WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of a City to authorize, by a two-thirds vote of its members elected thereto, the City Manager, or other duly authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with the operation of any department, division, commission, bureau or board of the municipality; and, WHEREAS, City Council perceives that a real and present emergency exists in that severe weather, hazardous material spills, and other disastrous incidents pose a consistent threat to the Citizens and visitors of Dublin and may occur at any time without warning; and, WHEREAS, Council desires to provide a reliable, effective, and high quality outdoor emergency warning system for the Citizens and visitors of Dublin to mitigate and prepare for any potential disastrous incident; and, WHEREAS, Phase II, as a continuation of Phase I of the outdoor emergency warning system, is needed to increase coverage to approximately 95 percent of Dublin's geographic area; and, WHEREAS, Council desires Phase II to be compatible with Phase I and be installed in a high quality and expeditious manner; NOW, THEREFORE, ,E IT ORDAINED by the Council of the City of Dublin, State of Ohio, _____ of the elected members concurring: Section 1. That the City Manager be, and hereby is, authorized to enter into contract with the Whelen Engineering Company, Inc. and West End Electric Company, Inc. for the purchase of sirens and related equipment and installation of the same, without formal bidding and advertising, pursuant to Section 735.051 of the Ohio Revised Code. Section 2. That an expenditure not to exceed $150,000 for the purchase and installation of Phase II of said outdoor emergency warning system be, and hereby is, authorized. I Section 3. That this Ordinance be, and hereby is, declared to be an I emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Installation: Average Siren Installation Phase I Initial Bid - $3,420/site Final Cost - $5,841/site (This $2,421 increase per site was due to change orders caused by rock excavation and adjustments to sites.) Estimated Average Siren Installation for Phase II $3,420.00 - Average Initial Installation Cost 1,077.20 - Rock Excavation and Site Adjustments $4,497.20 x 9 = $40,474.80 Total Estimated Cost of Sirens and Installation = $117,064.80 While $117,064.80 is well below the $150,000 budgeted amount, there exists a great deal of unknowns regarding sub-surface rock and site preparation, as well as, the need for easements.
