AN ORDINANCE AMENDING THE
TITLE OF ORDINANCE NO.
141-87 DUE TO A TECHNICAL
ERROR IN SAID TITLE, AND
DECLARING AN EMERGENCY
WHEREAS~ the title of Ordinance No. 141-87 repeals certain enumerated
sections of Chapter 1333 of the Codified Ordinances (1333.02-1333.08
and 1333.18); and
WHEREAS~ the above referenced sections (1333.02-1333.08 and 1333.18)
should have read 1333.01-1333.07 and 1333.18; and I
WHEREAS, the title of Ordinance No. 141-87 needs to be amended to correcf
the above referenced technical error;
NOW~ THEREFORE~ BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 6 Of the elected members concurring:
Section 1. That the title of Ordinance No. 141-87 is hereby amended as
follows:
AN ORDINANCE ADOPTING NEW
REGULATIONS FOR THE COL-
LECTION OF COMMERCIAL BUILD-
ING CODE FEES AND REPEALING
CHAPTER 1333~ SECTIONS 1333.01-
1333.07 AND 1333.18 OF THE
DUBLIN CODIFIED ORDINANCES."
Section 2. That this Ordinance be, and the same hereby is, declared to
be an emergency measure necessary for the preservation of the public
health, safety, and welfare and, therefore, this Ordinance shall take
effect and be in force immediately upon its passage.

Attached for your consideration is Ordinance No. 74-89 amending the
title of Ordinance No. l4l-87. When Ordinance No. l41-87 was passed
on December 2l, 1987, it repealed certain sections of Chapter l333
("Building Code Fee Schedule") of the Dublin Codified Ordinances and
established new regulations for the collection of commercial building
code fees. However, the title of Ordinance No. l4l-87 was incorrect
in that it indicated the repeal of sections l333.02 - l333.08 and
1333. l8 instead of sections l333.0l - l333.07 and l333.l8, as staff
intended.
The effected section (l333.08) establishes the authority of the City
to charge re-inspection fees and hence carries the title "Reinspection
Fees". As passed on December 2l, 1987, the title of Ordinance l4l-87
gives the appearance that section l333.08 ("Reinspection Fees") has
been repealed. That was clearly never the intention of staff.
Therefore, since Ordinance No. l4l-87 contains the aforementioned
technical error, it must be amended by appropriate legislation, hence,
Ordinance No. 74-89 is hereby attached for your consideration.
Please note that Ordinance No. 74-89 contains emergency language.
Staff believes that this technical error should be corrected
immediately in order to avoid any possible confusion regarding the
City's intention regarding Section l333.08 ("Reinspection Fees").
