NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Ohio, 6 of the elected members concurring: Section 1. That the City of Dublin, Ohio, does adopt the attached Park Rules and Regulations (Appendix A). Setion 2. '~';!1,;I, Dublin, Ohio "Ex};ibit A" RULES AND REGULATIONS Division of Water Department of Public Utilities and Aviation City of Columbus, Columbus, Ohio RE: FIRE HYDRANT USE Fire hydrants on the distribution system of the City of Columbus, Division of Water are for the purpose of fighting fires, and the protection and preservation of public health, peace, property and safety. Any other use permitted by the City of Columbus, Division of Water or the Division of Fire, shall be a privilege, not a right. In accordance with Section 1113.03 and 2517.04 of the Columbus City Codes, 1959, the following regulations are hereby established for the use of water from fire hydrants on the distribution system of the City of Columbus, Division of Water, including areas serviced by the City of Columbus. Fire hydrant permits on the distribution system of the Columbus Division of Water may be used for the following purposes in accordance with established guidelines: 1. New Construction - metered service not available. 2. Nurseries using water for new sod. 3. Water hauling. 4. Street cleaning. 5. Dust control during demolition. 6. Public/charity events (carnivals, carwashing, operation cool down, etc.) with the approval of the appointing authority. Fire hydrant permits on the distribution system of the Columbus Division of Water are not to be used for any of the following reasons: 1. Watering established lawns. 2. Filling swimming pools. 3. Drawing water from hydrants within a designated watering restricted area. 4. Water from hydrant to circumvent the metered system. FOR FIRE HYDRANTS LOCATED WITHIN THE CITY OF COLUMBUS: A permit must be issued by the City of Columbus, Division of Water, and the Division of Fire prior to usage of any water from fire hydrants within the City of Columbus. Only fire hydrants on water mains 12" and larger shall be availabl8 for use, unless authorized by the Administrator of the Division of Water. The charge for water used from a fire hydrant shall be $25.00 per permit and $30.00 per day (per hydrant) for every work day that the permit holder has use of the fire hydrant and shall be paid to the City of Columbus, Division of Water in advance. The first day shall be the day the permit is signed by the Division of Water. The last day shall be the ending date on the permit. No proration of these charges shall be made, nor shall any metering system be allowed with the connection for the purpose of bill i ng . Re: Fire Hydrant Use City of Columbus Page Two This permit sha 11 be signed by the authorized agent of the Division of Water, Division of Fire and the applicant prior to any use of the permitted fire hydrant. The applicant's original copy of this permit shall be kept at the location of the fire hydrant whenever used, and shall be presented to any person employed by the City of Columbus when requested. Each permit shall apply to only one (1) fire hydrant and for the time period and purpose stated in the permit. The use of any other hydrant or purpose by the permit holder is a violation of this rule and regulation. A proper fire hydrant wrench shall be used to operate the fire hydrant. An approved backflow prevention device must be used on all fire hydrant connections. This backflow connection can be purchased from the Division of Water at cost. A limited number of these connections will be available for loan for occasional use. A deposit of $150.00 must be made on any connection loaned out by the Division of Water. There sha 11 be someone at the hydrant from the time that the connection is made to the time the connection is removed. All fittings shall be removed from the permitted fire hydrant whenever not in use. The barrel of any fire hydrant used between the dates of September 15th and April 15th shall be pumped dry to the foot valve of the hydrant, by the applicant, immediately after each time the fire hydrant is operated. Duration of permits for use of water from fire hydrants shall not exceed thirty (30) days. Upon the expiration of the permit, based upon the arrangements made with the Division of Water and Fire, an inspection of the permitted fire hydrant will be made by the Division of Water or the Division of Fire. Pursuant to Columbus City Code Sections 1113.03 and 2517.04, anyone violating the above rule and regulation shall be charged for unauthorized use of water through a fire hydrant in the amount of $300.00 per occurrence, plus the cost of repair for any damage to the fire hydrant. Failure to pay the $300.00 charge and/or violation of the rule and regulation in excess of two times in a one year period will result in revocation of all current and future fire hydrant permits (Columbus City Code Sections 1113.035 and 2517.045). Anyone violating the above rule and regulation shall be subject to prosecution, pursuant to Section 2501.00 of the Columbus City Code. John R. Doutt, P.E. This rule and regulation will go into effect Nay 1 , 1989. The regulation is necessary to control the improper use of fire hydrants. Damaged fire hydrants threaten the property and safety of the citizens of Columbus. Director Public Utilities and Aviation Published in City Bulletin - - . .- -' APPENDIX wAw PARK RULES AND REGULATIONS Definitions (1) "Park" shall mean any land or water area owned, leased or otherwise controlled by the City of Dublin, Ohio for recreational open space or similar and related purposes. (2) "Director" shall mean the Director of Parks and Recreation of the City of Dublin, Ohio. (3) "Manager" shall mean the City Manager of the City of Dublin, Ohio. ( 4) "Officer" shall mean a Dublin Police Division Officer of t:he City of Dublin, Ohio, the Parks and Recreation Director or any agent or employee of either. (5) "Person" shall mean any individual, company, partnership, corporation or association or any combination of individuals, or any employee, agent or officer thereof. ( 6) "Park waters" shall mean any lake, pond, reservoir, stream, pool, channel, lagoon, or other body of water, or any part thereof, whether natural or artificial, located in or adjoining a park. ( 7) "Fish or fishing" shall mean taking or attempting to take fish by any method, and all other acts such as placing, setting, drawing or using any device commonly used to fish whether resulting in such taking or not. ( 8) "Animal or animals" shall mean and include, but not be linli ted to, quad- rupeds, birds, fish, reptiles, amphibians, crustaceans, mc\llusks and insects. (9) "Vehicle" shall mean every conveyance with wheels, treads, or other means of locomation. ( 10) "Motor vehicle" shall mean any vehicle propelled or drawn by power other than muscular power. Removal or Destruction of Property and Natural Features (1) No person in a park shall remove any property, natural feature or part thereof included, but not limited to, any building, equipment, sign, rock, stone, mineral formation, earth, wood, tree, shrub, flower, plant, nut or other seed from a park without a permit from the Director. (2) No person in a park shall injure, destory, break, cut, chop, write upon, mutilate, set fire to, deface, dig, paint or damage in any manner any property, natural feature or part thereof, including but not limited to, any building, equipment, sign, rock, stone, mineral formation, earth, wood, tree, shrub, flower or plant. (3) No person in a park shall impound or cause to be impounded any park water or in any other way alter or affect the natural flow of such waters without a permit from the Director. ( 4) Whoever violates this section is guilty of a first degree misdemeanor. Park Rules and Regulations Page Two Deposit of Material ( 1) No person shall deposit, discard, dump or leave behind any material of any kind in a park without a permit from the Director except materials arising from the normal use and enjoyment of a park and then only in receptacles which may have been provided for this purpose. ( 2) No person shall, adjacent to a park, deposit, discard, dump or leave behind any noxious or waste material included, but not limited to, paper, garbage, ashes or refuse which may blow, wash, or be otherwise transported into a park. (3) No person in or adjacent to a park shall place or permit to be placed in any park waters any noxious or deleterious substance, either solid or liquid which may render such waters harmful or inimical to the public health or to animal and plant life. ( 4) Whoever violates this section is guilty of a minor misdemeanor. Protection of Animals: Hunting and Fishing (1) No person in a park shall hunt, capture, take, trap or in any other way abuse, molest, injure, pursue or destroy any animal without a permit from the Director other than by fishing. (2) No person in a park shall move, injure or destroy any bird nest or egg or any animal habitation. (3) No person in a park shall fish in park waters in violation of any sign or signs prohibiting fishing or a manner thereof. ( 4) Whoever violates this section is guilty of a first degree misdemeanor. Animal Control ( 1) No person shall bring into, have or keep in a park any dog, cat or other animal unless such animal is kept in a vehicle, suitably caged; or restrained by a leash, in such a manner as to be under the person's control at all times, except where permission has been obtained in advance in writing from the Director. (2) No person being the owner or having charge of any animal on any public or private property other than the property of the owner or person having charge of such animal, shall fail to have in his possession a wood, plastic, or metal device or other container for the purpose of picking up and properly disposing of any fecal matter left by his/her animal. Failure of any such person to have in his possession such suitable device or container is prima-facie evidence of a violation of this section. (3) No person in a park shall ride or have under his control a horse except in areas designated for such purpose. (4) No person in a park shall ride a horse, where such is permitted, in such a manner as to endanger the rider, the horse or any other person or any property. Park Rules and Regulations Page Three (5) No person in or adjacent to a park shall abandon any animal. ( 6) No person shall herd, graze, drive or permit any animal to run at large in a park. (7 ) Whoever violates this section is guilty of a minor misdemeanor. Aerosol Pain Cans (1) No person in a park except an Officer or the Director or her/his agents shall carryon or about his or her person a container capable of propelling paint by means of a gaseous charge without having first obtained written permission from the Director. ( 2) Whoever violates this section is guilty of a minor misdemeanor. Personal Conduct (1) No person in or adjacent to a park shall conduct herself/himself by work or by act, in a riotous, disorderly boisterous or other manner so as to disturb the peace and good order in a park. (2 ) No person in or adjacent to a park shall operate or play a radio, television set, muscial instrument, amplifying of sound equipment, or operation of a radio-controlled device so as to disturb the peace and good order in a park. (3) No person in a park shall solicit or procure participants for, engage in, or promote any game which is played for money or other thing of value, except where permission has been obtained in advance in writing from the Director. ( 4) No person in a park shall use insulting, abusive, threatening, profane, or indecent language. (5) No person in a park shall loiter in the vicinity of a toilet and no person over the age of six (6) shall enter the toilet facilities provided for the exclusive use of the opposite sex. ( 6) No person in a park shall wilfully resist, obstruct or abuse an Officer or Director while such Officer or Director is engaged in the execution of her/his office. (7) No person in a park shall assault or commit bodily injury upon another or engage in or abet or aid in any fight, quarrel, or other disturbance. ( 8) No person or groups of persons shall assemble in or adjacent to a park for any unlawful purpose or in riotous assemblage or with intent to annoy, harass, or inflict property damage or bodily injury upon another person or persons or inflict damage to a park. (9) No person in a park shall solicit or attempt to solicit another to engage in an act of sex perversion or solicit or request another to Gommit, perform, or engage in any lewd, lascivious, obscene, or indecent act of behavior. (10) No person in a park shall appear in a state of nudity or commit, perform or engage in any lewd, lascivious, obscene, illicit, carnal o:c indecent act of behavior and no person shall make any indecent exposure of her or his person. Park Rules and Regulations Page Four (11) No person in a park shall openly display, sell, offer for sale, or be under the influence of intoxicating liquors or alcoholic beveragHs in a park; such beverages may be confiscated by an Officer or Director. (12) No person in a park shall sell, offer for sale, possess, rHceive, use, administer or to his or herself or others, be under the influence of or possess any equipment for administering any narcotic drug, opiate, hallucinogen, amphetamine or barbituate except as provided by law. " Narcotic drugs, opiates, hallucinogens, amphetamines or ba:rbi turates in a park may be confiscated by an Officer or Director, excepting those as provided by law. (13) Whoever violates this section is guilty of a first degree lnisdemeanor. Fires ( 1) No person in a park shall start or maintain a fire except .in a place or at a site designated for this purpose. (2) No person in a park shall build a fire at a time or period when the Director has prohibited the building of fires. (3) Whoever violates this section is guilty of a first degree misdemeanor. Camping (1) No person in a park shall establish or maintain any camp or other temporary lodging or sleeping place within a park without a permit from the Director. (2) Whoever violates this section is guilty of a minor misdemea.nor. SWinuning, Wading, Boating and Ice Skating (1) No person in a park shall engage in the activities of swirnning, wading, boating and ice skating in areas or at times which have not been set aside for these purposes by appropriate signage. (2) Whoever violates this section is guilty of a first degree misdemeanor. Firearms and Weapons (1) No person in a park except Officers or the Director shall carryon his or her person firearms of any description, knives, bows and arrows, crossbows, air and gas guns, missiles or mil1ile-throwing devices, or oth,er dangerous weapons without having first obtained written permission from the Director. ( 2) No person except Officers or the Director shall discharge .into a park a firearm, arrow, air or gas gun, missile, slingshot or any missile-throwing device without having first obtained written permission from the Director. (3) No person in a park except Officers or the Director shall shoot an arrow or discharge a firearm, air or gas gun, missile or slingshot ltlithout having . ( 4) Firearms, bows and arrows, knives, air or gas guns, missiles, slingshots or other missile-throwing devices or any snares or traps in a park may be confiscated by Officers or the Director. ( 5) Whoever violates this section is guilty of a first degree misdemeanor. Commercial Activities ( 1) No person in a park shall sell or offer for sale any article, privilege, or service without having first obtained written permission fcc-om the Director. ( 2) No person in a park shall beg, peddle or solicit for money, a privilege or a service. (3) Whoever violates this section is guilty of a minor misdemeanor. Erecting and Attaching Signs ( 1) No person in a park shall erect a sign or attach a sign to property owned or controlled by the City of Dublin, Ohio, nor shall any person display any placard, notice, advertisement, circular, banner, or statement of any other kind other than a permanent sign on a vehicle without a pe,c-mi t from the Director. (2) Whoever violates this section is guilty of a minor misdemeanor. Hours of Use (1) No person shall enter or remain in a park except during the hours of a legally permitted activity, those hours in Dublin, Ohio, being from dawn to dusk. (2) Whoever violates this section is guilty of a minor misdemeanor. Unauthorized Structures (1) No person in a park shall construct, erect, or in any other way build any structure without a permit from the Director. (2) Whoever violates this section is guilty of a minor misdemeanor. Fireworks and Explosives ( 1) No person in a park shall have in his or her possession any fireworks or explosives or shall cause any fireworks or explosives to ignite or detonate without having first obtained in writing a permit from the Director. (2) Whoever violates this section is guilty of a first degree raisdemeanor. . Park Rules and Regulations Page Seven Vehicles and Traffic (1) No person in a park shall operate any motor vehicle in or on any portion of a park not designated as a park drive nor shall any person park any motor vehicle in or on any other portion of a park not designated as a parking area. (2) No person in a park shall operate a snowmobile or an unlicensed motor vehicle of any kind except in designated areas. (3) No person in a park shall operate a vehicle in such a manner as to endanger the operator or any other person or any property. (4) No person in a park shall drive around, cause to be moved or damage any barricades or barrier so placed to temporarily or permanently close a road to traffic. (5) No person in a park shall operate a vehicle in excess of the posted speed limit. (6) No person shall leave a vehicle in a park during the hours when a park is closed. (7) Vehicles in parks in violation of these Rules and Regulations shall be removed or cause to be removed by Officers to a location, in or outside of a park, where the same may be kept until the owners or their authorized representatives obtain an order from the Director or her/his representative releasing such vehicles to the owners thereof or their authorized representa- tives. The City of Dublin, Ohio, shall not be responsible for any fee, charge or damage arising from such impoundment. (8) No person in a park shall accelerate a motor vehicle causing the rubber tires to mark or deface park roadway surfaces. (9) Whoever violates this section is guilty of a minor misdemeanor.
